Call To Order Chairman Arnett called the meeting to order at 10:00 a.m. Roll Call Present: 3- Alderwoman Pindell Charles, Alderwoman Finlayson and Alderman Arnett 2. Legislation before Committee CA-2-16 Amending the City’s Maximum Penalty- For the purpose of amending the Maximum Penalty applicable to misdemeanors, infractions and violations to that proscribed by State Law. Alderwoman Finlayson moved to recommend CA-2-16 with the Rules and City Government amendment as follows: Amendment #1 Page 2, line 11, strike: “IN THE DISCRETION OF” Page 2, line 11, after COUNCIL strike: “, AN ORDINANCE THE CITY COUNCIL MAY IMPOSE FINES, INCARCERATION, OR OTHER PENALTIES OR REMEDIES AS PERMITTED BY LAW. Seconded CARRIED on voice vote. Aye: 3- Alderwoman Pindell Charles, Alderwoman Finlayson and Alderman Arnett O-25-16 City Code Maximum Penalty Provision - For the purpose of amending the City Code to be consistent with the Charter concerning the Maximum Penalty applicable to misdemeanors, infractions and violations proscribed by State Law. City of Annapolis Page 1 Rules & City Government Standing Committee Minutes June 17, 2016 Committee Aye: 3- Alderwoman Pindell Charles, Alderwoman Finlayson and Alderman Arnett O-21-16 Title 4 - Elections - For the purpose of amending and updating Chapters 4.28 and 4.44 of the Code of the City of Annapolis concerning absentee voting and fair election practices; and matters generally relating to absentee voting and fair election practices. Cliff Myers, Eileen Leahy, and Arnold Brown representing the Board of Supervisors of Elections gave a joint presentation of the board's proposed amendments and answered questions from the committee. Alderwoman Finlayson moved to recommend with amendments the Board of Supervisor of Elections Proposed Amendments 1,2,3,4,5,6,7,9,10 and 12 as written (see attached) and the Rules and City Government proposed amendents 1-4 as follows: Amendment #1 Page 2, line 22, after shall insert: "PROVIDE BY" Page 2, line 22, after mail insert: "OTHER MEANS" Page 2, line 22, after mail strike: "DELIVER" Upon receipt of the application, the board shall PROVIDE BY mail OR DELIVER OTHER MEANS an absentee ballot to the voter entitled to the ballot. Amendment #2 Page 4, line 4, strike: AS SOON AS PRACTICABLE. Amendment #3 Page 5, line 26-33 un-strike: “paragraph D” Amendment #4 Page 8, line 11, unstrike: “or cause to be published or distributed any” and insert: new language “BY ANY WRITTEN OR ELECTRONIC MEANS INCLUDING BUT NOT LIMITED TO” following the last distribute” Seconded. CARRIED on voice vote. Aye: 3- Alderwoman Pindell Charles, Alderwoman Finlayson and Alderman Arnett Alderwoman Finlayson moved to recommend favorably O-21-16 as amended. Seconded. Aye: 3- Alderwoman Pindell Charles, Alderwoman Finlayson and Alderman Arnett R-17-16 Emergency Meeting Memorandum of Understanding - For the purpose of approving an Emergency Meeting Memorandum of Understanding City of Annapolis Page 2 Rules & City Government Standing Committee Minutes June 17, 2016 Committee between the City of Annapolis and Anne Arundel County Public Schools for use of certain County property in the event of an emergency. Aye: 3- Alderwoman Pindell Charles, Alderwoman Finlayson and Alderman Arnett R-10-16 Position Classifications and Pay Plan - For the purpose of approving the FY 2017 position classification and pay plan effective July 1, 2016. Seconded. CARRIED on voice vote. Aye: 3- Alderwoman Pindell Charles, Alderwoman Finlayson and Alderman Arnett Alderwoman Finlayson moved to returned Littmann Amendment 1-4 without recommendation. Seconded. CARRIED on voice vote. Aye: 3- Alderwoman Pindell Charles, Alderwoman Finlayson and Alderman Arnett R-09-16 Public Safety Employee Funeral Representation - For the purpose of establishing a policy that upon the death of a retired or active duty public safety employee, a public safety representative shallSHOULD attend the funeral of the employee with the consent of the legal authorized representative of the deceased employee’s family.
