Chambers, Jr. City Council Chambers Rules & City Government Committee Rules & City Government Standing Committee Meeting February 9, 2021 Committee Minutes Call To Order Chairwoman Finlayson called the meeting to order at 3:04 p.m. Roll Call Present: 3- Finlayson, Savidge and Arnett Approval of Agenda (any changes to the agenda should be made here) Alderman Savidge moved to adopt the Regular Meeting Agenda as amended to add O-2-21. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett 1. Business and Miscellaneous Approval of Minutes RCG02.02.2 Approval of Minutes for the Regular Meeting 1 Alderman Arnett moved to approve the minutes for the Regular Meeting. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett 2. Legislation before Committee O-46-20 Public Health and Safety - For the purpose of removing obsolete provisions; authorizing the Department of Public Works to establish regulations governing garbage and refuse; reassigning certain enforcement powers to the Deputy City Manager for Resilience and Sustainability; creating definitions; clarifying procedures and penalties concerning commercial solid waste collection and contract approval; and generally relating to public health and safety. Alderman Arnett moved to Recommend Favorably Tierney and Buckley Amendments: Amendment 1 On page 4, in line 13 strike “It” down through “WORKS” in line 17 and strike “WITHIN” in line 20 down through line 23. Amendment 2 On page 10, strike lines 22 down through 31 and substitute “Approved refuse containers shall be placed curbside by 6:00 a.m. on the scheduled collection day. Residents shall place materials to be collected in an approved refuse container or packaged as otherwise permitted in this chapter at the City of Annapolis Page 1 Rules & City Government Standing Committee Meeting February 9, 2021 Committee Minutes curb no earlier than 6:00 p.m. preceding the scheduled collection day. Approved refuse containers shall be removed from the sidewalk no later than 12:00 a.m.MIDNIGHT following the scheduled collection day. In the historic district, as defined in Title 21, approved refuse containers must be removed from public view.” Amendment 3 On page 12, strike lines 5 down through 9 and substitute “E. COMMERCIAL SOLID WASTE SHALL NOT BE SET OUT FOR COLLECTION EARLIER THAN 11:00 P.M. THE NIGHT PRECEDING A SCHEDULED COLLECTION DAY OR FOLLOWING THE CLOSING OF THE ESTABLISHMENT UNLESS A DIFFERENT ARRANGEMENT HAS BEEN MADE AND APPROVED BY THE DEPARTMENT OF PLANNING AND ZONING BASED ON UNIQUE CIRCUMSTANCES OR VARIABLE HOURS. COMMERCIAL SOLID WASTE SHOULD BE PICKED UP BY 8:00 AM. IT IS THE ESTABLISHMENT'S RESPONSIBILITY TO ENSURE THAT GARBAGE AND WASTE MATERIAL SET OUTDOORS FOR COLLECTION SHALL BE COLLECTED DAILY NO LATER THAN ONE HOUR FOLLOWING COLLECTION UNLESS A DIFFERENT ARRANGEMENT HAS BEEN MADE AND APPROVED BY THE DEPARTMENT OF PLANNING AND ZONING BASED ON UNIQUE CIRCUMSTANCES OR VARIABLE HOURS.” Amendment 4 On page 12, strike lines 18 down through 20. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett Alderman Savidge moved to Recommend Favorably Savidge Amendment: Amendment 5 On page 1 in lines 4 and 26, and on page 7 in line 34, strike “Deputy City Manager for Resilience and Sustainability” and substitute “DIRECTOR OF PUBLIC WORKS OR DESIGNEE”. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett Alderwoman Tierney, and Alderman Gay were present and addressed the Committee. Planning and Zoning Director Nash, and Public Works Director Johnson were present and answered questions from the Committee. Alderman Savidge moved to recommend favorably. Seconded. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett O-51-20 Emancipation Day - For the purpose of designating “Emancipation Day” as a City holiday to be observed on November 1st of each year. City Attorney Lyles was present and answered questions from the Committee. Alderman Gay was present and addressed the Committee. Alderman Gay would like to be added as a co-sponsor. Alderman Savidge moved to postpone O-51-20 until the next Rules and City Government Meeting, and invite Finance Director Dickinson, and City Manager Jarrell. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett O-19-19 Adequate Public Facilities - Auto transportation facilities - For the purpose of clarifying the circumstances that would require a traffic impact analysis for a proposed project; clarifying the standards to be used to determine adequacy; and generally relating to the adequacy of auto transportation facilities. Alderman Arnett moved to Recommend Favorably New Amendment 4: Page 2 Line 28 strike 250 and add "200". Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett Alderman Savidge moved to Recommend Favorably New Amendment 5: Page 2 line 39 "#2 or, when the Director of Planning & Zoning determines that the proposed development is near a high use pedestrian area and may have an impact on those areas,". Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett Alderman Arnett moved to Recommend Favorably Amendment 6: Page 2 Line 40 ADD A QUARTER OF A MILE (1,320 FEET);. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett Planning and Zoning Director Nash, Transportation Deputy Director Agyemang-Duah, City Attoreny Lyles, and Public Works Director Johnson were present and answered questions from the Committee. Alderwoman Tierney was present and addressed the Committee. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett O-2-21 City Council Meetings - Agenda - For the purpose of clarifying the content of City Council meeting agendas for regular and special monthly meetings; and generally relating to monthly City Council meeting agendas. No action taken ***Per the request of Madam Chair, O-19-19 has been moved to the third item on the agenda in order to have time to dispense with O-46-20, and O-51-50 first.
