Village of Arcanum Council Meeting September 8, 2020 7:00 p.m. Call to Order Mayor Bonnie Millard opened the meeting with the Pledge of Allegiance along with all present members of council. Roll Call Council Members present include Tim Philpot, Jacob Banks, Jerry Boolman, Tammy Bruner, and Rick Genovesi. Council President Boolman moved to excuse Council Member Somers. Council Member Philpot seconded. All present council members voted yea. Motion passed. Also present were Village Administrator Bill Kessler, Solicitor Nicole Pohlman, Police Chief Marcus Ballinger, Administrative Specialist Mary Stephens, Bruce Shank and Heath Riffell. Joining remotely via Zoom were Toni Stanley, Gregory T. Baumle and Mollie Gaines. Meeting Minutes – Corrections and Approvals Mayor Millard asked for the approval of the meeting minutes from August 25, 2020. Council President Boolman moved to approve meeting minutes from August 25, 2020. Council Member Philpot seconded. All present council members voted yea. Motion passed. Mayor Millard asked for the approval of meeting minutes from the Special Council Meeting on September 3, 2020. Council President Boolman moved to approve meeting minutes from September 3, 2020. Council Member Philpot seconded. All present council members voted yea. Motion passed. Amendments to Agenda Mayor Millard asked to bring all New Business before Comments from the Public. New Business Ordinance 2020-32 – An Ordinance Establishing A Planning Commission For The Village Of Arcanum, Ohio And Declaring An Emergency. Council President Boolman moved to waive the three-reading rule for Ordinance 2020-32. Council Member Banks seconded. All present council members voted yea. Motion passed. Ordinance 2020-33 – An Ordinance Authorizing The Placement Of Stop Signs At The Intersections Of South Locust Street And West First Street and South Sycamore Street And West First Street And Declaring An Emergency. Resolution 2020-21 – A Resolution In Support Of Anti-Discrimination Laws Throughout The State Of Ohio. 1st Reading. Council President Boolman moved to waive the three-reading rule of Resolution 2020-21. Council Member Banks seconded. All present council members voted yea. Motion passed. Mayor Millard congratulated Chief Ballinger. From the Court of Common Please, Judge James F. Stevenson - Plaintiff Andrew Ashbaugh and Defendant Village of Arcanum & Gregory T. Baumle dismiss all claims as they have been amicably resolved. The Plaintiff shall bear court costs and expenses. The Arcanum Preservation Society will be hosting Ohio Open Doors on September 19 from 9-12. The Village Leadership, Council and Administration does not condone any form of discrimination and has legislation in place. Chief Ballinger spoke about the vision and anti-discrimination policies implemented within the police department along with the handling of open criminal cases, investigations and procedures. Solicitor: Village Administrator: VA Kessler updated that ODOT’s repaving of Alt 49 is two weeks behind. The manholes are not complete, but VA Kessler follows up frequently for updates. The sidewalk repairs are on track with positive outcome from residents who have received letters. Fiscal Officer:  Acceptance of properly appropriated and funded expenditures. Council Member Philpot moved to accept the properly appropriated and funded expenditures. Council Member Boolman seconded. All present council members voted yea. Motion passed.  Acceptance of Reconciliation and final fund reports. Council Member Philpot moved to accept the reconciliation and final fund report. Council Member Banks seconded. All present council members voted yea. Motion passed. Committee Reports Safety: Committee Chairperson Genovesi reported that a safety meeting was held recently and discussions of how to allocate the Cares Act (relief disbursements) were held. The Village is preparing to make upgrades to public facilities including many hands-free features. The health/safety upgrades must be done by a specific date or the funds given to the Village will be returned. If the Village is able to spend all of the funds, they may qualify for the second round of disbursements later in October. Council Member Genovesi moved to allow VA Kessler to begin purchasing and moving forward with the spending of the Village Cares Act funds. Council Member Philpot seconded. All present council members voted yea. Motion passed. Utility Committee: VA Kessler asked for a sewer forgiveness at 602 West North Street in the amount of $463.50. Council Member Philpot moved to allow a sewer forgiveness in the amount of $463.50 at 602 West North Street. Council Member Genovesi seconded. All present council members voted yea. Motion passed. Finance & Audit: The Audit has been filed and council members received a report of recommendations, findings and the Village’s corrective response. Reconciliation discrepancy between the book and the bank statement was the most significant finding. Mayor Millard commended Fiscal Officer Stanley for her work on reconciling at the same variance for four months in a row. After six months with the same variance, the amount may be cleared from the books. Service and Leisure: Committee Chairperson Banks reported that the playground equipment at the ballparks was discussed and quotes are being looked at. VA Kessler is looking to remove the fence separating the playground from the homes surrounding. The committee is looking to replace picnic tables at the ballpark. Pool crack repairs are underway and valves will be dug up and repaired. The pool is ready to be primed. Heath Riffell from Mote & Assoc. updated on projects. The North Street project is complete. Warranty work on a valve has also been repaired. At 11 months, a warranty walkthrough will be complete. WWTP – a warranty walkthrough was done. They found an issue with the block leaking. A bond and sealer will be installed by the supplier (Wayne Builders). The block was pressure washed prior. NW Storm drainage – work will begin in November. A pre-construction meeting will be held. Council Member Philpot asked about a motor issue in the WWTP. The issue is not resolved as there is debate whether it is covered under warranty or not. Personnel: Planning: Old Business Ordinance 2020-28 - An Ordinance Adopting Rates, Terms, And Conditions For Electric Service Provided By The Village Of Arcanum, Ohio. Exhibit A. 3rd Reading. Council President Boolman moved to adopt Ordinance 2020-28. Council Member Philpot seconded. All present council members voted yea. Motion passed. Ordinance 2020-29 - An Ordinance Setting Water and Sewer Rates The Village Of Arcanum. Exhibit A. 3rd Reading. Council Member Philpot moved to adopt Ordinance 2020-29. Council Member Banks seconded. All present council members voted yea. Motion passed. Ordinance 2020-30 - An Ordinance For A One Time Credit To Certain Village Residents For Lead Testing Performed By The Village. Exhibit A. 3rd Reading. Council Member Philpot moved to adopt Ordinance 2020- 30. Council Member Banks seconded. All present council members voted yea. Motion passed. Announcements – Trash pickup will continue on schedule. The Village will determine whether Trick-or-Treat will be held.
