Village of Arcanum Council Meeting September 29, 2020 7:00 p.m. Call to Order Mayor Bonnie Millard opened the meeting with the Pledge of Allegiance along with all present members of council. Roll Call Council Members present included Tim Philpot, Jacob Banks, Jerry Boolman, Tammy Bruner, Taylor Somers and (via remote conference) Rick Genovesi. Also present were Village Administrator Bill Kessler, Solicitor Nicole Pohlman, Police Chief Marcus Ballinger, Nate Kubik (Daily Advocate) and resident Missie Shilt. Meeting Minutes – Corrections and Approvals Mayor Millard asked for the approval of the meeting minutes from September 8, 2020. Council President Boolman moved to approve meeting minutes from September 8, 2020. Council Member Somers seconded. All present council members voted yea. Motion passed. Amendments to Agenda Comments from the Public Administrative Reports Mayor: Mayor Millard presented a Zoning Amendment application (attached herein) submitted by Tim Shellabarger and TAS Real Estate and received by the Planning Commission for the property annexed under Ordinance 2020-05 to the East of East Woodside Dr. A recommendation was made to bring before Council for a Public Hearing to rezone from A-1 to PUD/R-2 and R1-C. Council President Boolman recommended a Public Hearing to be rescheduled for Tuesday, November 10 at 6:30pm. Solicitor: Village Administrator: VA Kessler attended the AMP yearly conference (virtually). The prospect for energy over the next two years follows a downward trend in utility cost. The Village portfolio should look somewhat the same with maintaining generation. North Main Street/east South Street – ODOT manhole issues and lack satisfaction/completion was expressed. VA Kessler is working with the state to correct. The pool is painted and looks great. The pool should be open on-time next year. All work is complete. Hands- free sinks, toilets and dryers are secured and the shower houses at the pool will be replumbed to accommodate. Fiscal Officer:  Acceptance of properly appropriated and funded expenditures.  A Motion Accepting The Percentage Share of the Local Government Fund for the Year 2021 as Allocated by the Darke County Budget Commission. The percentage is 4.5% or approx. $56,682.92. Council Member Philpot moved to accept the 4.5% share of the Local Government Fund for the year 2021. Council Member Somers seconded. All present council members voted yea. Motion passed.  The Village Records Commission met on September 9. RC-3 forms were submitted to the Ohio History Connection with no transfers being requested. The Records Commission voted to dispose of said documents. Documents are listed in the records retention files. The Village is now current and following the approved records retention schedule. Committee Reports Safety: Chairperson Genovesi reported:  Officer shortage - Since Jan 2020, the Village has not been covered 53 days. Question? Do we want a 24/7 Police Department? If so, Chief discussed a plan of action to resolve issue. One more full- time officer and one permanent part time officer.  Chief & Toni are working to stay on budget, preliminary figures look good and Chief will present it to the Finance Committee.  Sergeant Yount presented a plan on a possible training center at the site of the old sewage lagoon.  Discussion of utilizing Corona Relief Funds from the Federal Government and proposing the addition of a gear dryer for the Fire Dept to the list. Council Member Genovesi moved to use COVID-19 Cares Act Funds to purchase a gear dryer for the Fire Department in the amount of approximately $8700.00. Council President Boolman seconded. All present council members voted yea. Motion passed.  Chief Ballinger would like to apply for a grant to purchase 2 radios. Village match is 25%. Council Member Philpot moved to allow Chief Ballinger to apply for the grant for 2 police radios. Council Member Bruner seconded. All council members voted yea. Motion passed. Utility Committee: Chairperson Philpot reported:  Wastewater treatment plant punch list is complete except for the electric motor. Bill is to work with Heath Riffell at Mote & Assoc. to resolve.  Lagoon riprap placement is complete and will wait until next spring to assess how it will filter water.  Still continuing to advertise for a water treatment plant operator.  Grass will be planted in the leveled lagoon area soon.  The next meeting will be October 6, 2020 at 4:30pm. Finance & Audit: Chairperson Somers Reported:  Discussed police holiday pay as being from Midnight to Midnight of the Holiday, and not for duration of the shift.  Identified that Vacation hour accrual needs to be looked at, in that it might be best to do away with “accrual”. Need to check with Legal.  Began the review of the Budget (General Fund / Police / .25% / Other / Street / Fire), will continue at 4:30 on October 5th, 2020 at the next committee meeting.  Insurance Update was that Phalen might have quotes in 2-3 weeks. Service and Leisure: Chairperson Banks reported:  Pool - All major repairs are done. The pool is now painted. Will have the bathrooms replumbed with Covid funds. We are looking good for next year.  Baseball Fields/Playground - Bill received an updated proposal for the playground equipment. We would like to get this approved. If possible, we would like to get this done this year. (See attached quote). Council Member Philpot moved to purchase playground equipment in the amount of approximately $18,000. Council Member Banks seconded. All present council members voted yea. Motion passed.  Arcanum Junior Baseball members attended and stated there was a missing vent on the concession stand that needs replaced. They also asked about getting the fences stretched. Bill said he would have it done. Bill will be getting a count and price for new picnic tables.  Most sidewalks have been repaired.  West North Street - Bill found and addressed an oil leak from a car that was sitting on the new road. The oil was cleaned up and Bill will be sending an invoice to the property. Personnel: Nothing at this time. Planning: Nothing at this time. Old Business Ordinance 2020-34 – An Ordinance Authorizing The Transfer Of Real Estate To The Village Of Arcanum Community Improvement Corporation. 2nd Reading. Council President Boolman moved to waive the three- reading rule of Ordinance 2020-34. Council Member Banks seconded. Council Members Genovesi, Banks, Somers, Bruner and Boolman voted yea. Council Member Philpot abstained. Motion passed. Council President Boolman moved to adopt Ordinance 2020-34. Council Member Banks seconded. Council Members Genovesi, Banks, Somers, Bruner and Boolman voted yea. Council Member Philpot abstained. Motion passed. New Business Ordinance 2020-35 – An Ordinance Providing For An Amendment To The 2020 Appropriations For Current Expenses And Other Expenditures Of The Village Of Arcanum, Darke County, Ohio And Declaring An Emergency (General Fund, Parks Pool & Rec Levy Fund And Electric Fund). Council Member Banks moved to waive the three-reading rule of Ordinance 2020-35. Council President Boolman seconded. All present council members voted yea. Motion passed. Council Member Banks moved to adopt Ordinance 2020-35. Council President Boolman seconded. All present council members voted yea. Motion passed. Council Member Banks moved to declare Ordinance 2020-35 an emergency. Council President Boolman seconded. All present council members voted yea. Motion passed. Resolution 2020-22 – A Resolution Accepting The Amounts And Rates As Determined By The Budget Commission And Authorizing The Necessary Tax Levies And Certifying Them To The County Auditor. 1 st Reading. Council President Boolman moved to waive the three-reading rule of Resolution 2020-22. Council Member Somers seconded. All present council members voted yea. Motion passed.
