RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: AUGUST 1, 2022 Page 1 of 3 ___________________________________________________________________________ The Council of Ashville convened in Regular Session from 6:42 PM to 7:37 PM in the Council Meeting Room at 200 East Station Street, Ashville, Ohio 43103. Mayor Wise the meeting to order with the Pledge of Allegiance and a moment of silence. The following members and visitors were present: Mr. STEVE WELSH Present Mr. NELSON EMBREY Present Mr. ROGER CLARK Present Mr. DAVID RAINEY Present Mr. RANDY LOVELESS Present Mr. MATT SCHOLL Present EMPLOYEES: Franklin Christman, Brenda Stewart, Samantha Pemberton, Jim Welsh, Adam Kehoe and Chief George GUESTS: Mark Leatherwood, Sandi Oliver, Lacy Moore and Danny Byrom MINUTES OF PREVIOUS MEETING: Randy Loveless moved, seconded by Roger Clark, to approve the July 25, 2022 Regular Session minutes as presented. All votes were yea. DEPARTMENTAL REPORTS VILLAGE ADMINISTRATOR: Franklin Christman reported that the Planning & Zoning Board will have a Public Hearing for multiple zoning projects on July 26 at 6:30 PM and that an Ashville Foundation meeting is scheduled for August 25 at 6:30 PM. Christman introduced Mark Leatherwood who stated that the title company is requiring a release of obligation from the Village of Ashville for the design plat for the 40.376 acres of property known as Prairie Acres LLC. David Rainey moved, seconded by Roger Clark, to release the plat from any obligation the Village of Ashville has. All votes were yea. LEGISLATION ORDINANCE FOR THIRD READING 2022-12 AN ORDINANCE AUTHORIZING THE VILLAGE ADMINISTRATOR AND FISCAL OFFICER TO EXECUTE A SERVICE AGREEMENT FOR THE PLANNING, DESIGN, AND FUNDING OF A NEW WATER PROCESSING FACILITY WITH JONES & HENRY ENGINEERS, LTD AND DECLARING AN EMERGENCY. The Village Administrator requested the Third Reading be tabled until the solicitor has finalized his review of the agreement. The VA said it should be in by the next Council meeting. Nelson Embrey moved, seconded by Randy Loveless, to table the Third Reading until the August 15, 2022 Council meeting. All votes were yea. ORDINANCES FOR FIRST READING 2022-13 AN ORDINANCE TO ADD CHAPTER 559 DISCRIMINATION PROHIBITED; GUARANTEE OF EQUALITY AND INCLUSION TO THE VILLAGE OF ASHVILLE CODIFIED ORDINANCES AND DECLARING AN EMERGENCY. David Rainey moved, seconded by Matt Scholl, to have the First Reading. All votes were yea. After the reading, Nelson Embrey moved, seconded by Matt Scholl, to accept the First Reading, suspend the Rules of Council, waive the Second and Third Readings, and adopt as an emergency measure. All votes were yea.  RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: AUGUST 1, 2022 Page 2 of 3 ___________________________________________________________________________ 2022-14 AN ORDINANCE TO AMEND 2003-11, 2006-02, 2006-08, 2009-09, 2009-20, 2013-02, 2013-05, 2014-05, 2016-06, 2017-05,2019-01, 2019-09, 2019-18, 2020-02, AND 2020-12 TO REFLECT CHANGES IN THE VILLAGE OF ASHVILLE PAY ORDINANCE. THIS ORDINANCE DESIGNATES CERTAIN VILLAGE EMPLOYMENT POSITIONS AS HOURLY POSITIONS AND SALARIED. IT ESTABLISHES MINIMUM AND MAXIMUM PAY RATES OF COMPENSATION FOR SUCH PERSONS EMPLOYED IN SUCH POSITIONS, AND TO DECLARE AN EMERGENCY. Nelson Embrey moved, seconded by Randy Loveless, to table the First Reading until the August 15, 2022 Council meeting. All votes were yea. RESOLUTION FOR THIRD READING 11-2022 A SECOND RESOLUTION AUTHORIZING THE VILLAGE ADMINISTRATOR AND FISCAL OFFICER TO EXECUTE AN AGREEMENT AND/OR PURCHASE ORDERS TO ADDRESS ISSUES IDENTIFIED BY STRAND ASSOCIATES REPORT AND TO EXECUTE OTHER CONTRACTS AS REQUIRED. Nelson Embrey moved, seconded by Randy Loveless, to table the First Reading until the August 15, 2022 Council meeting. All votes were yea. EXECUTIVE SESSION: At 6:58 PM Nelson Embrey moved, seconded by Randy Loveless, to go into Executive Session to discuss a legal matter. All votes were yea. The Regular Session resumed at 7:12 PM with no action taken. PUBLIC COMMENTS: • Sandi Oliver asked for an update on South Central Power allowing the Village and Ashville Community Men’s Club to hang flags, banners, and Christmas decorations on the electric poles. Franklin Christman said he has been corresponding with a rep at SCP. Oliver said she will be at every meeting asking for updates until the matter is resolved. • Lacy Moore and Danny Byrom said their basement flooded with fecal waste as a result of an inoperative pump at the wastewater plant. The homeowners said this isn’t the first time this has happened but were surprised it happened on a day when the weather was sunny and clear. Adam Kehoe said the level transducer was out and failed to alert him of the problem and that this is one of the problems that will be corrected with the pending electrical repairs. Council asked if there was a way to rig the equipment to get the plant through until the electric repairs are made. Kehoe replied that he received a quote last year from Hoskins Solutions to fix the issue but the requisition was denied. Council asked how much the repair would be and if it will prevent this from happening again. Kehoe said the original quote was about $6000 and that it will work. Roger Clark moved, seconded by Nelson Embrey, to have Adam Kehoe move forward with the needed software repairs. All votes were yea. Nelson Embrey then moved, seconded by Matt Scholl, to have the VA prepare legislation that requires all new construction to have backflow preventers installed. All votes were yea. At 7:37 PM, Nelson Embrey moved, seconded by David Rainey, to adjourn the meeting. All votes were yea and the meeting adjourned.
