BOARD OF APPEALS MINUTES JANUARY 17, 2018 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:00pm Roll Call for Board Members: John Sims, Eric Blair, Robert Whitfield Staff Members Present: Don Wilkinson, Building Official; Tom Engels, Senior Code Officer; Jason Francisco, Code Compliance Manager; Lisa Silkworth, Secretary Additions/Deletions to the Agenda: none Approval of Minutes: Mr. Blair made a motion to approve the minutes from the December 20, 2017, seconded by Mr. Sims Old Business: none Dangerous Buildings Show Cause Hearings: a. 15 Ridge Issue#EN17-12043 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the house was condemned during a police drug raid. Mr. Wilkinson stated the County Health Department condemned the home do to the toxic nature of the chemicals found during the police call. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Mr. Blair. Affirmed. New Business: 1. 12 Stone St Issue#EN17-12204 Code Compliance Officer: Tom Engels Housing Board of Appeals January 17, 2018 Page 2 of 2 Property owner, Ezequiel Carrera, present. Tom Engels, Senior Code Officer, stated the violations were found during a rental inspection and have not been repaired. Mr. Carrera stated he needed more time and money to make the repairs. MR. Carrera stated he would like at least two more months to get the repairs done. Mr. Sims made a motion to grant an extension to March 20, 2018, seconded by Mr. Blair. Extension granted. 2. 193 Post Ave Issue#EN17-10420 Code Compliance Officer: Tom Engels Property owner, not present. Tom Engels, Senior Code Officer, stated the violations were from a rental inspection. Mr. Sims made a motion to affirm the order as written, seconded by Mr. Blair. Affirmed. Public Comments: none Board and Staff Members Comments: Mr. Blair asked about a tolling period for cement work.
