MEMBERS PRESENT: Commissioners Judith Mudge, Jennifer Cappell and Gary Green MEMBERS ABSENT: None STAFF PRESENT: Vicki Houser, Paul Engels, Martin Erskine and Howard Holt CALL TO ORDER: President Mudge called the meeting to order at 4:00 PM, noting a quorum was present. PETITIONS AND COMMUNICATIONS: There were no petitions or communications. APPROVAL OF MINUTES: 1. A motion was made by Comm. Green, supported by Comm. Cappell, to approve the Civil Service Commission April 22, 2013 meeting minutes. All yes, none opposed. Motion approved. REPORTS: There were no reports. OLD BUSINESS: Clerk Houser informed the Commission that the Fire Training Officer promotional exam was scheduled for July 15, 2013, with the Structured Oral Interviews tentatively scheduled for July 23, 2013. Comm. Mudge inquired as to the notification of the testing date and the study period. Clerk Houser confirmed the study period for the Fire Training Officer was sent out with a six week notice, stating the study information has always been sent at least six weeks in advance of the testing date. Ms. Houser also noted the Fire Inspector promotional testing period had eight weeks study time. 1 NEW BUSINESS 1. Removal and withdrawal of employment offer of one candidate from the “2012 Entry- level Firefighter Eligibility List” A. Michael Voss Paul Engels, Human Resources Director, discussed the contradictory information contained in Mr. Voss’ application, his physical testing and email correspondence. Mr. Engels noted that Mr. Voss had indicated an EMT B License on his application, but when asked for a copy of the license, Mr. Voss could not provide documentation until taking the EMT B License test in 2013. Mr. Engels noted Mr. Voss’ email response of May 6, 2013 that stated he did have the license when he applied with Battle Creek. Mr. Engels stated several attempts to talk with Mr. Voss were unsuccessful. Clerk Houser stated she had talked to the Michigan Department of Community Health, and they confirmed Mr. Voss had taken his MFR license test in 2008. Ms. Houser further stated the Dept. of Community Health stated Mr. Voss completed his EMT course on May 2, 2011, and needed to pass the EMT test within two years of his education, noting he passed the test on April 29, 2013 and his license was issued April 30, 2013. Comm. Mudge confirmed with Mr. Engels that the removal of Mr. Voss was based upon Section 38.501(2)(f) of Act 78 of 1935 which states “The commission may refuse to examine an applicant or, after examination, to certify as eligible, an applicant that falls under any of the following disqualifications: (f) Has made a false statement of a material fact or practiced or attempted to practice a deception or fraud in the application, in the examination, or in securing eligibility.” A motion was made by Comm. Green, supported by Comm. Cappell, to remove Michael Voss from the 2012 Entry-level Firefighter Eligibility List and to withdraw the offer of employment based upon Section 38.501(2)(f) of Act 78 of 1935. All in favor, none opposed. Motion approved. PUBLIC COMMENTS There were no public comments. COMMISSION COMMENTS Comm. Cappell announced her resignation from the Civil Service Commission affective after the August 2013 Civil Service Commission meeting. Comm. Mudge expressed her appreciation to Comm. Cappell for her years of service. Comm. Mudge thanked Comm. Cappell for her willingness to allow the Commission time to find her replacement.
