CITY COUNCIL MEETING MINUTES Tuesday, October 04, 2022 at 7:00 PM Baxter City Hall, 13190 Memorywood Drive, Baxter, MN “A Growing Community” CALL TO ORDER Mayor Olson called the meeting to order at 7:08 p.m. ROLL CALL Mayor Darrel Olson and Council Members Connie Lyscio, Zach Tabatt, John Ward and Mark Cross were present. City Administrator Brad Chapulis, Assistant City Administrator Kelly Steele, Community Development Director Josh Doty, Finance Director Jeremy Vacinek, Assistant Police Chief Matt Maier, and Public Works Director Trevor Walter were present. PLEDGE OF ALLEGIANCE All joined Mayor Olson in reciting the Pledge of Allegiance. PRESENTATIONS 1. Mayoral Proclamation Mayor Olson read a mayoral proclamation recognizing the second Monday of October as Indigenous- American Peoples’ Day. ADDITIONS OR CHANGES TO THE AGENDA None. PUBLIC COMMENTS - Comments received from the public may be placed on a future meeting agenda for consideration. CONSENT AGENDA - The following items are considered non-controversial by staff and are recommended to be read and passed in one motion. Any council person, staff, citizen, or meeting attendee can request one or more items be pulled from the Consent Agenda and the item will be pulled and addressed immediately after the passage of the Consent Agenda; otherwise, the following items will be passed in one motion: 2. Approve City Council Work Session Minutes from September 20, 2022 3. Approve City Council Minutes from September 20, 2022 4. Approve the Payment of Bills and Finance Report (Addendum A) 5. Authorize Staff to Advertise Kiefer Rescue Paddle Board, Junkin Stretcher with Head Stabilizer, and Two Sand Digger Playground Equipment on Minnesota Surplus Site. 6. Approve SEH Contract for Railroad Quiet Zone Design, Implementation, and Notification in the Not to Exceed amount of $81,000.00 10/4/2022 City Council Meeting Minutes Page 2 7. Adopt Resolution No. 2022-085 for Authorization of the Federal Aid Funding Agreement No. 1049793-Amendment No. 1 for the 2022-TH 210/Inglewood Drive Improvement Project 8. Schedule a Public Hearing for Certification of Delinquent Utility Bills, Invoices, and Abatements for Tuesday, November 15, 2022 at 7:00 p.m., or shortly thereafter 9. Approve Purchase of Two Squad Computer Replacements in the Amount of $7,145 10. Adopt Resolution No. 2022-086 Adopting Assessment for the 2022 Trunk Highway 210 & Inglewood Drive Railway Crossing Improvements Project MOTION by Council Member Cross, seconded by Council Member Lyscio to approve the consent agenda. Motion unanimously approved. PULLED AGENDA ITEMS OTHER BUSINESS COUNCIL COMMENTS 11. Connie Lyscio – Discussed holding the annual Brighten Baxter holiday light contest with the Brainerd Dispatch again this year. 12. Zach Tabatt – No comment. 13. John Ward – No comment. 14. Mark Cross – No comment. 15. Darrel Olson – No comment. CITY ADMINISTRATOR'S REPORT City Administrator Chapulis asked the council to enter into a closed session under Minnesota Statute 13D.03, Labor Negotiations. CITY ATTORNEY'S REPORT 16. Closed Session – Minnesota Statute 13D.03, Labor Negotiations MOTION by Council Member Cross, seconded by Council Member Ward to enter into a closed session at 7:13 p.m. Motion unanimously carried. MOTION by Council Member Tabatt, seconded by Council Member Lyscio to return to the open session at 8:23 p.m. Motion unanimously carried. Upon returning to the open session the council did not take any action.
