CITY COUNCIL MEETING MINUTES Tuesday, August 01, 2023 at 7:00 PM Baxter City Hall, 13190 Memorywood Drive, Baxter, MN “A Growing Community” CALL TO ORDER Mayor Olson called the meeting to order at 7:00 p.m. ROLL CALL Mayor Darrel Olson and Council Members Connie Lyscio, Zach Tabatt, Jeff Phillips, and Mark Cross were present. City Administrator Brad Chapulis, Assistant City Administrator Kelly Steele, Community Development Director Josh Doty, Public Works Director Trevor Walter, and Assistant Police Chief Matt Maier were present. PLEDGE OF ALLEGIANCE All joined Mayor Olson in reciting the Pledge of Allegiance. PRESENTATIONS None. ADDITIONS OR CHANGES TO THE AGENDA None. PUBLIC COMMENTS - Comments received from the public may be placed on a future meeting agenda for consideration. None. CONSENT AGENDA - The following items are considered non-controversial by staff and are recommended to be read and passed in one motion. Any council person, staff, citizen, or meeting attendee can request one or more items be pulled from the Consent Agenda and the item will be pulled and addressed immediately after the passage of the Consent Agenda; otherwise, the following items will be passed in one motion: 1. Approve City Council Work Session Minutes from July 18, 2023 2. Approve City Council Minutes from July 18, 2023 3. Approve City Council Special Minutes from July 20, 2023 4. Approve the Payment of Bills and Finance Report (Addendum A) 5. Accept Donation From Baxter Lions Club for 2023 Night to Unite 6. Adopt Resolution No. 2023-051 Authorizing Advancement of Municipal State Aid Funds for the 2022- TH 210/Inglewood Drive Road Improvement Project, Municipal Project No. 4121 8/1/2023 City Council Meeting Minutes Page 2 7. Authorize the Execution of a Letter of Support for MPDG Application for the MN Highway 210 Brainerd/Baxter – Safety, Mobility, and Multimodal Improvements Project 8. Approve the Hiring of Mason Waldera as Intern for the Police Department 9. Approve Conditional Hire of Jason Borash as Patrol Officer 10. Approve Cooperative Agreement with Great River Greening for Environmental Improvement Projects at Mississippi River Overlook Park MOTION by Council Member Cross, seconded by Council Member Lyscio to approve the Consent Agenda. Mark Cross – Reminded motorists to watch out for motorcycles. 15. Darrel Olson – Thanked our staff for all their work and reminded everyone of Night to Unite to be held on August 8th at Oscar Kristofferson Park. CITY ADMINISTRATOR'S REPORT City Administrator Chapulis reminded the council of the August 10, 2023, improvement hearing for the south Forestview project and explained current city code prohibits the use of cannabis on city property. CITY ATTORNEY'S REPORT 16. Closed Session Under Minnesota Statute 13D.05, Subd. 3 (c) - Purchase Property PIDs 40050534 and 40050535 MOTION by Council Member Cross, seconded by Council Member Phillips to enter into a closed session at 7:04 p.m. under Minnesota Statute 13D.05, subd. 3 (c) to discuss the purchase of property as identified on the agenda. Motion carried unanimously. MOTION by Council Member Cross, seconded by Council Member Tabatt to return to an open session at 7:12 p.m. Motion carried unanimously. City Administrator Chapulis explained staff is looking for the council to make a motion to accept the offer to purchase the 13 plus acres of property from Good Samaritan for $490,000. MOTION by Council Member Cross, seconded by Council Member Lyscio to accept the offer to purchase the 13 plus acres of property from Good Samaritan for $490,000.
