Call to Order Announcements & Upcoming Meetings:  The City Council will be in recess until September 8. Bellingham City Council meets all requirements of the State of Washington Open Meetings Act. Pledge of Allegiance Led by Council President Lehman. Roll Call Jack Weiss, excused. 15-Minute Public Comment Period Ken Holmes spoke in opposition to a rental registration ordinance. Judy Collins, 210 Horton Road, again requested city water service at her home. Patrick McKee is upset with the rezone proposal being considered for the Sunnyland Neighborhood as it is radically different from the Sunnyland Neighborhood Association (SNA) proposal. In his opinion the Mayor and staff have abandoned the Sunnyland Neighborhood. The proposal would amend city code in order to allow infill toolkit housing in one sub-area of the Sunnyland Neighborhood. [AB20496]. Mickey McDiarmid is also upset with the rezone proposal. The Sunnyland proposal has been highjacked to be the city Planning Department's proposal. The Sunnyland proposal called for varying sized lots so there could be small and smaller houses. This is City of Bellingham Regular City Council Meeting Page 1 of 7 8/11/2014  not the Sunnyland proposal and to pretend that it is, is dishonorable and deceitful. [AB20496] Presentation 20527 1. Presentation of the Bicycle Master Plan Ted Carlson introduced staff and reviewed the process to date. The Transportation Commission recommends approval. Staff presentation Kim Brown, Project Manager. Ms. Brown read the names of the Steering Committee members, and introduced Pete Lagerway, a consultant with Tool Design Group. Public engagement has included the Steering Committee, focus groups, open houses, an online survey and an interactive map. The Plan's key elements include: policy recommendations, bicycle network recommendations, design guidance, recommended programs to support bicycling and implementation strategies. The Plan's goals include safety, connectivity, equity, livability, public and environmental health, choice, education, mode shift and economy. Facility types planed, in addition to bike boulevards are: bike lanes, buffered bike lanes, climbing lanes, shared lanes and cycle tracks. The Plan's short term (2014-2020) recommendations include: 20 miles of projects, critical access to key destinations, connecting to the existing network and high return on investments. Ms. Brown also reviewed Medium Term (2021-2026) and Long Term (2027+) recommendations culminating in 82 miles of projects. Plan Implementation strategies are to:  maintain existing bike facilities,  continue to install bike facilities with resurfacing projects,  retrofit intersections with bike markings and signal detection,  seek grant funding for priority bike facilities,  fund "Further Study Needed" Bike Network links, and  develop a wayfinding system. Staff and council concurred that there would be a worksession on September 8, Public Works/Public Safety Committee, with a brief presentation followed by Q&A. Bid Award for Lake Whatcom Right-of-Way Retrofits - Water Quality Improvements, Bid #27B-2014 Terry Bornemann / Gene Knutson moved to award Bid No. 37B-2014 for Lake Whatcom Right-of-Way Retrofits to Faber Construction Corporation of Lynden, Washington as the lowest responsive, responsible bidder and to authorize the Mayor to enter into a contract with them for the amount of their bid, which is $294,419.26 and includes any applicable WSST. MOTION CARRIED 6-0. 20529 2. Bid Award for McLeod Road Culvert Replacement, Bid #41B-2014 Terry Bornemann / Gene Knutson moved to reject all bids due to complications with manufacturing. MOTION CARRIED 6-0. 20530 3. Update from the Fairhaven Parking Task Force Terry Bornemann / Michael Lilliquist moved to approve an extension to March, 2015 so that the task force can continue their work. MOTION CARRIED 6-0. 20531 4. Waterfront District - District Specific Utilities - Final Recommendations Terry Bornemann / Gene Knutson moved to direct staff to move forward with staff recommendations regarding district specific utilities to be included in the Waterfront Utility Master plan. Based on the recommendations in the executive summary, Public Works staff recommend proceeding as follows: Development of a District Energy system via a public/private partnership if financially viable; development of a District Raw Water system as an expansion to the current City water utility; and postponing any development of a Micro-Hydro system until a Nooksack river diversion management strategy is finalized. MOTION CARRIED 6-0. Planning 20496 1. Consideration of an Ordinance to rezone approximately 4 acres of land in Areas 1, 1A, and 8 of the Sunnyland Neighborhood City of Bellingham Regular City Council Meeting Page 3 of 7 8/11/2014  "AN ORDINANCE OF THE CITY OF BELLINGHAM RELATING TO THE BELLINGHAM COMPREHENSIVE PLAN, AMENDING THE SUNNYLAND NEIGHBORHOOD PLAN AND REZONING THE PROPERTIES FORMERLY OWNED BY THE WASHINGTON STATE DEPARTMENT OF TRANSPORTATION (DOT) WITHIN AREAS 1, 1A, AND 8 OF THE SUNNYLAND NEIGHBORHOOD, AMENDING THE NEIGHBORHOOD PLAN LAND USE MAP, ZONING MAP, AND BELLINGHAM MUNICIPAL CODE (BMC) 20.00.200." Amendments recommended during committee are:  Replace Special Regulations with "All residential development is limited to those housing forms listed in Attachment 1".  Attachment 1, first line: remove "Housing Forms for" and replace with "development in"; and replace "are" with "is".  Attachment 1, add item 3. to read: "Single floor area limits specified in BMC 20.28 may be exceeded on the first story of a dwelling unit, provided the maximum floor area ratio allowed for each housing type is not exceeded." An Ordinance to reclassify one position in the Legislative Department "AN ORDINANCE AMENDING THE 2014 ADOPTED BUDGET AND UPGRADING ONE FULL TIME POSITION IN THE LEGISLATIVE DEPARTMENT WHERE NO ADDITIONAL APPROPRIATION IS REQUESTED." Michael Lilliquist / Gene Knutson moved approval for first and second reading. MOTION CARRIED 6-0. 20533 2. Ordinance to amend the 2014 Budget due to restructuring in the Executive Department resulting in the elimination of one position and the reclassification of two other positions "AN ORDINANCE AMENDING THE 2014 ADOPTED BUDGET UPGRADING TWO FULL TIME POSITIONS IN THE EXECUTIVE DEPARTMENT AND City of Bellingham Regular City Council Meeting Page 4 of 7 8/11/2014  DELETING ONE FULL TIME VACANT POSITION, WHERE NO ADDITIONAL APPROPRIATION IS REQUIRED." An Ordinance appropriating funds from estimated ending restricted reserve in the public education and government (PEG) access television fund to appropriate funds for the public access television pilot training program and startup expenses "AN ORDINANCE AMENDING THE 2014 ADOPTED BUDGET APPROPRIATING AN ADDITIONAL $35,000.00 FROM ESTIMATED ENDING RESTRICTED RESERVES IN THE PUBLIC EDUCATION AND GOVERNMENT (PEG) ACCESS TV FUND TO PROVIDE FOR THE PUBLIC ACCESS TELEVISION PILOT TRAINING PROGRAM AND STARTUP EXPENDITURES." An Ordinance Amending Bellingham Municipal Code (BMC) Section 2.56.020 to Correct a Scrivener's Error "AN ORDINANCE AMENDING BELLINGHAM MUNICIPAL CODE (BMC) SECTION 2.56.020 TO CORRECT A SCRIVENER'S ERROR." Cathy Lehman / Gene Knutson moved approval for first and second reading. MOTION CARRIED 5-1, Michael Lilliquist opposed. 4. Approval of City Council Committee and/or Special Meeting Minutes None submitted. 5. Old/New Business Council Member Knutson confirmed that currently, a regular council meeting is scheduled for November 24, 2014. Executive Session - Report and action only. 1. Litigation: Newlun v. Sucee, et al.: Staff provided an update on a litigation matter. Direction given. No action taken 2. Bargaining Authority and Strategy: Staff provided information on labor relations bargaining. Direction given. No action taken. Mayor's Report Standing time for briefings, updates and reports to Council by the Mayor, if needed. Information only. Mayor Linville bade everyone to enjoy the summer break and reminded that budget discussions will begin after the break. Additionally, she extended her thanks to a personal friend for her kindness.
