Call to Order The meeting was called to order by Council President Vargas at 7:00 p.m. Announcements & Upcoming Meetings: Bellingham City Council meets all requirements of the State of Washington Open Public Meetings Act. Pledge of Allegiance Led by Council President Vargas. Roll Call Present: April Barker, Council Member, First Ward Gene Knutson, Council Member, Second Ward Daniel Hammill, Council Member, Third Ward Pinky Vargas, Council Member, Fourth Ward Terry Bornemann, Council Member, Fifth Ward Michael Lilliquist, Council Member, Sixth Ward Roxanne Murphy, Council Member, At Large Excused: 15-Minute Public Comment Period Michael Ross, relayed a letter he sent to Council Members regarding the tax charges on his bill from Sanitary Services. He feels the taxes are inappropriate and do not comply with City guidelines for garbage and recycling tax. Joseph McDonald, complained about the religious demonstrators that rally at various events throughout the City. City of Bellingham Regular City Council Meeting Page 1 of 7 5/2/2016  Tim Paxton, commented on a street vacation that the Council will be voting on soon. He reported that the street will be vacated in order for a school to be built. His concern is that the school will be built over a 10 inch natural gas pipeline. Laura Rawes, briefly addressed the Council on homelessness in the City. Chris Diele, spoke on helping the poor and social injustices. Irene Morgan, thanked the Council for rejecting the jail tax proposal. She relayed that she is happy that the Council has looked at alternatives to incarceration for offenders and feels we are on the right track. Parks and Recreation 21221 1. Approve and Authorize the Mayor to Enter into an Interlocal Agreement Between the City of Bellingham and Lake Whatcom Water and Sewer District to Finance the 2016 Aquatic Invasive Species (AIS) Boat Inspection Program Dan Hammill / Gene Knutson moved to authorize the Mayor to enter into an Interlocal Agreement between the City of Bellingham and Lake Whatcom Water and Sewer District to Finance the 2016 Aquatic Invasive Species (AIS) Boat Inspection Program. Resolution Authorizing Housing and Urban Development Annual Action Plan A RESOLUTION RELATING TO THE 2016 ACTION PLAN, THE USE OF COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG), HOME INVESTMENT PARTNERSHIP PROGRAM (HOME) AND BELLINGHAM 2012 HOUSING LEVY FUNDS, THE ALLOCATION OF FUNDS TO SUPPORT SELECTED CITY HOUSING AND HUMAN SERVICES AGENCIES AND DIRECTING THE MAYOR TO SUBMIT THE 2016 ACTION PLAN TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT April Barker / Terry Bornemann moved final approval of Resolution #2016-12. Resolution Amending the 2012 Housing Levy Administrative & Financial Plan A RESOLUTION AMENDING THE HOUSING LEVY ADMINISTRATIVE AND FINANCIAL PLAN REGARDING THE USE AND EXPENDITURE OF HOUSING LEVY FUNDS AUTHORIZED BY THE VOTERS IN PROPOSITION NO. 1 April Barker / Gene Knutson moved final approval of Resolution #2016-13. Presentation on ChooseWhatcom.com, a Newly Created Portal for Businesses Choosing to Start, Grow or Locate in Whatcom County Information only. Committee Of The Whole 21229 1. The Northwest Clean Air Agency will Present its New Website Katie Skipper, of Northwest Clean Air Agency presented information on their new website. The web address is www.nwcleanairwa.gov. A link to the website will be added to our ChooseWhatcom.com website. Information only. 21230 2. Preliminary Findings Regarding the City's Commercial Zoning Code Western Washington University Graduate Students presented an overview of their findings from focus groups for their study of the City's Commercial Zoning Codes. They plan to give a more extensive presentation next month at a Council Meeting. 21195 3. Resolution in Support of the Proposed Emergency Medical Services Levy RESOLUTION OF THE CITY OF BELLINGHAM APPROVING A COUNTYWIDE BALLOT PROPOSITION FOR A LEVY TO FUND A COUNTYWIDE EMERGENCY MEDICAL SYSTEM FOR THE PERIOD FROM JANUARY 1, 2017, THROUGH DECEMBER 31, 2022, PURSUANT TO RCW 84.52.069 Pinky Vargas / Gene Knutson moved final approval of Resolution #2016-14. MOTION CARRIED 7-0. 21231 4. Brief from the 2016 Legislative Session The City of Bellingham, Whatcom County and the Port of Bellingham requested several items from the state legislature. This past legislation session's highlights included:  We received funding for emergency services for homeless persons as requested  We received funding for the northbound on-ramp at Bakerview and Interstate-5 and the Orchard Street project  We received funding for Municipal Research and Services Center (this was scheduled to be cut) City of Bellingham Regular City Council Meeting Page 4 of 7 5/2/2016   We did not receive funding for the Aquatic Invasive Species Control  We did not receive incentives to promote installation of solar systems and local investments in solar generation  Paid Safe and Sick Leave legislation did not pass in the State Senate but may be on the Ballot in November 2016  Legislation to create a state tourism program did not pass in the State Senate 21232 5. Discussion of Draft Comment Letters Regarding Oil Transport by Rail Deputy Administrator, Brian Heinrich, presented two draft letters of comment for consideration. The letters pertain to oil transport by rail and oil spill contingency plans. Pinky Vargas / Michael Lilliquist moved in support of the draft letters. MOTION CARRIED 7-0. 6. Approval of Minutes Gene Knutson / April Barker moved approval of the April 11, 2016 minutes of the regular City Council meeting as submitted. MOTION CARRIED 7-0. Old/New Business Roxanne Murphy reported she hopes to bring forward a Resolution in support of Initiative 1433 at the next Council Meeting, May 16, 2016. Mayor Linville expressed that she supports the protest, The First Annual Peace Out, that was held at City Hall today. 21233 1. An Ordinance Regarding the Administration of a Donation Made for the Assistance of the Families of Fire Fighters Who Have Lost their Lives or Been Killed, Especially in the Line of Duty AN ORDINANCE OF THE CITY OF BELLINGHAM, WASHINGTON AUTHORIZING THE MAYOR TO CONTRACT WITH THE BELLINGHAM/WHATCOM FIRE FIGHTERS BENEVOLENT FOUNDATION TO ADMINISTER FUNDS DONATED TO THE CITY TO ASSIST THE FAMLIES OF FIRE FIGHTERS WHO HAVE LOST THEIR LIVES OR BEEN DISABLED, ESPECIALLY IN THE LINE OF DUTY City of Bellingham Regular City Council Meeting Page 6 of 7 5/2/2016  Gene Knutson / Terry Bornemann moved approval for third and final reading.
