Call to Order The meeting was called to order by Council President Hammill at 7:00 p.m. Announcements & Upcoming Meetings: Bellingham City Council meets all requirements of the State of Washington Open Public Meetings Act. 1. On March 27, 2019 at 6:30 PM in the City Council Chambers, there will be a Special Meeting for the Annual Lake Whatcom Joint Councils and Commissioners Meeting. Presentation of Project Awards to the City by the Environmental Protection Agency (EPA) Ted Carlson, Public Works Director, introduced the awards being presented by to the City of Bellingham, by Rick Green with the Environmental Protection Agency. City of Bellingham Regular City Council Meeting Page 1 of 6 3/25/2019 Minutes  Mayor Linville commended the innovative work of the staff and thanked the Council for their support. 15-Minute Public Comment Period Cheryl Crooks, Executive Director of Cascadia International Women's Film Festival, thanked the City for the sponsorship of the film festival. The festival begins April 11th and runs through April 14th at the Pickford Film Center, Mt Baker Theatre, Western Washington University and the Sylvia Center for the Arts. Dana Briggs, relayed concerns about climate change. He commended the efforts of local students who walked out of their classrooms to raise awareness on climate change a couple weeks ago. Anne Sadler, President of Manufactured Home Parks (AMHO), spoke in support of the legislation on tonight's agenda. {AB 22025} Jim Peterson, thanked Council for allowing HomesNow! to host Safe Haven. He would like to be considered for the Committee that will work on a cold weather plan and shelter. Council Standing Committee Meetings: Public Works and Natural Resources Gene Knutson, Chair Terry Bornemann, April Barker 22255 1. Interlocal Agreement with the Washington State Department of Ecology for the Squalicum Creek Reroute Water Quality and Biotic Integrity Improvements Phase 4 Project Gene Knutson / Michael Lilliquist moved to recommend the Mayor enter into an interlocal agreement with the Washington State Department of Ecology for the Squalicum Creek Reroute Water Quality and Biotic Integrity Improvements Phase 4 Project. MOTION CARRIED 6-0, Terry Bornemann excused. Planning and Community Development April Barker, Chair Terry Bornemann, Michael Lilliquist 22256 1. Potential Ordinance Regarding Restrictive Covenants that Affect Grocery Stores City of Bellingham Regular City Council Meeting Page 2 of 6 3/25/2019 Minutes  Discussion during Committee. The proposed ordinance provided an outline to limit negative use restrictions imposed by private parties on parcels formerly used as grocery stores for City Council's consideration. Council directed staff to amend the ordinance and bring back for further discussion. More information will be brought forth at a later work session. Committee Of The Whole Daniel Hammill, Chair April Barker; Gene Knutson; Pinky Vargas; Terry Bornemann; Michael Lilliquist, Hannah Stone 22257 1. Discussion of Capital Facilities Discussion during Committee. Staff provided additional information related to capital facilities and adopted City-wide policies that guide City investment in capital facilities. Information only. 22025 2. Discussion Regarding the Preservation of Manufactured Home Parks in Bellingham Discussion during Committee. There are ten manufactured home parks in Bellingham with a total of about 900 spaces. These parks and the units they contain, are some of the most affordable housing in the City. The City Council directed staff to explore methods to preserve some or all of the existing parks. More information will be brought back at a later meeting. Information only. 3. Approval of Minutes Gene Knutson / April Barker moved approval of the March 11, 2019 minutes of the regular City Council meeting as submitted. MOTION CARRIED 6-0, Terry Bornemann excused. 4. Old/New Business Dan Hammill / Gene Knutson moved to cancel the City Council retreat scheduled for April 27, 2019 and hold a high-level discussion at a later date within the City Council Chambers. MOTION FAILED, Lilliquist, Barker and Stone opposed, Terry Bornemann excused. Council Member Stone summarized that in lieu of the weekend retreat, the Council would have a work session scheduled for a 2-3 hours. City of Bellingham Regular City Council Meeting Page 3 of 6 3/25/2019 Minutes  Mayor Linville appreciates that the Council would want to conduct their retreat in a public forum. She suggested the work session or "retreat" be on an off Monday. Executive Session – Report and Action only. 1. Potential Litigation: Claim No. 2019-05 and Claim No. 2019-06 Staff provided information on a potential litigation matter. Michael Lilliquist / Gene Knutson moved to authorize the Mayor to enter into a settlement agreement with the following terms: resolution of claim number 2019-06 for the payment of $61,940.57 to the claimant for damages related to water main break. MOTION CARRIED 5-0 Pinky Vargas abstained, Terry Bornemann excused. 2. Clermont v. Sooter, et. al Staff provided information on a litigation matter. Gene Knutson / April Barker moved to authorize the Mayor to engage outside legal services to represent the City in this lawsuit. MOTION CARRIED 5-0, Pinky Vargas abstained, Terry Bornemann excused. Mayor's Report Standing time for briefings, updates and reports to Council by the Mayor, if needed. Information only. The Mayor relayed her desire to invite community partners that helped with the cold weather shelter to be recognized at a future Council Meeting. 22258 1. Mayor's Appointment of Steven James to the Mayor's Neighborhood Advisory Commission (Information) The Mayor appointed Steven James to the Mayor's Neighborhood Advisory Commission. Steven James will represent the Puget Neighborhood and serve his first term, which will expire on March 8, 2021, at which time he may be reappointed. Information only. Consent Agenda All matters listed on the Consent Agenda are considered routine and/or non-controversial items and may be approved in a single motion. An Ordinance Amending BMC 2.20.010 Reducing Membership on the Greenways Advisory Committee From Eleven to Nine Members Gene Knutson / April Barker moved approval for third and final reading. Upon motion, said bill was placed on final passage and approved by the following roll call vote: AYES: Hammill, Barker, Knutson, Vargas, Lilliquist, Stone NAYS: (None) EXCUSED: Bornemann MOTION CARRIED and was thereafter named Ordinance #2019-03-008.
