Call to Order The meeting was called to order by Council President Hammill at 7:00 p.m. Announcements & Upcoming Meetings: Bellingham City Council meets all requirements of the State of Washington Open Public Meetings Act. Public Hearing on the Consideration of Application for Bureau of Justice Grant in the Amount of $22,685 Flo Simon, Deputy Police Chief, relayed information on a grant from the Police Department applied for from the Bureau of Justice. The grant would be used to purchase three commercial refrigerators and three commercial freezers for the Evidence and Identification Unit. Council President Hammill opened the Public Hearing. No citizens spoke and the public hearing was closed. City of Bellingham Regular City Council Meeting Page 1 of 6 9/9/2019 Minutes  Council Member Lilliquist asked about conditions listed in the Appendix B of the grant application. The conditions of compliance with Federal law that include immigration enforcement in order to receive grant funds. Deputy Simon explained that during the application process, a copy of the 2017 immigration ordinance and the City's immigration policy were submitted in the application packet. The application was only submitted recently and there hasn’t been time yet to hear a reply. The City has not been denied grant funding in the past. 22414 2. Public Hearing to Consider a Draft Ordinance Amending Bellingham Municipal Code Title 20 to Allow On-Premise Accessory and Incidental Alcohol Service at Eating Establishments Anya Gedrath - Smith, Planner, provided information on the proposed ordinance. Specific amendments include updated eating establishment and drinking establishment definitions, modified conditional use permit requirements, and other related amendments for consistency throughout the code. Council President Hammill opened the Public Hearing. No citizens spoke and the Public Hearing was closed. April Barker / Gene Knutson moved for first and second reading. MOTION CARRIED 7-0. 22415 3. Public Hearing to Consider a Draft Ordinance Amending Bellingham Municipal Code Title 20 to Allow Recycling Collection and Processing Centers in Certain Industrial Zones and Modify Special Requirements for Such Uses Anya Gedreth-Smith, Planner, explained the proposed ordinance. The purpose is to allow recycling collection and processing centers in certain industrial zones and modify special requirements for such uses by amending various applicable sections of the land use development code. Council President Hammill opened the Public Hearing. Public Comment was taken. There being no further comments, the Public Hearing was closed. Mayor's Reappointment of Jan Hayes to the Design Review Board (Approval) Gene Knutson / Michael Lilliquist moved approval of the Mayor's reappointment of Jan Hayes to her fifth term, on the Design Review Board. Her term will expire on September 25, 2023, at which time she may be reappointed. MOTION CARRIED 7-0. 22417 2. Mayor's Appointment of Neha Harle and Michael Kutcher to the Parks and Recreation Advisory Board (Information) The Mayor appoints Neha Harle as the Student Representative for a one year term on the Parks and Recreation Advisory Board, expiring on August 29, 2020, at which time she may be reappointed. The Mayor appoints Michael Kutcher to his first term on the Parks and Recreation Advisory Board, expiring August 30, 2022, at which time he may be reappointed. Council Standing Committee Meetings: Public Works and Natural Resources Gene Knutson, Chair Terry Bornemann, April Barker 22418 1. Mitigation Bank Update Presentation during Committee. The City is actively developing a new Mitigation Bank for unavoidable wetland and stream impacts resulting from development. The goals of the Bank are to improve the success rate of mitigation projects, achieve restoration goals, address the mitigation needs for public and private entities, and reduce costs associated with mitigation, coordinate mitigation efforts, and streamline the mitigation process. Staff set an aggressive yet realistic timeline and in 2018 submitted an application to the US Army Corps of Engineers and Washington State Department of Ecology. The City also acquired three mitigation properties for future use in the bank. Lastly, the City hired a consultant to complete detailed mitigation design work City of Bellingham Regular City Council Meeting Page 3 of 6 9/9/2019 Minutes  and preparation of the next agency submittal, the Mitigation Banking Instrument. Information only. Planning and Community Development April Barker, Chair Terry Bornemann, Michael Lilliquist 22419 1. Authorize Exemption of System Development Charges to the Lighthouse Mission Ministries April Barker / Michael Lilliquist moved to authorize a system development charge exemption, for a reduction of the total cost of installation by $5,410.40 to the Lighthouse Mission Ministries. MOTION CARRIED 7-0. 22151 2. Urban Village Design Review Update Process Presentation during Committee. Recent assessments and adopted Comprehensive Plan policies indicate a need to update the City's Urban Village design review process. The Planning and Community Development staff presented an overview of the update process. Information only. Waterfront District Implementation Status Report Presentation during Committee. Rob Fix, Director of the Port of Bellingham, presented an update on Port and private projects in the Waterfront District. Information only. 22420 2. Adopt Resolution Regarding a Sales and Use Tax for Affordable and Supportive Housing Under Substitute House Bill 1406 Daniel Hammill / April Barker moved final approval of Resolution #2019-25. Staff provided a briefing of the next phases of the project and included options they are exploring. Information only. 4. Approval of Minutes April Barker / Terry Bornemann moved approval of the August 26, 2019 minutes of the regular City Council meeting as submitted. MOTION CARRIED 7-0. 5. Old/New Business Council Member Barker asked Brian Heinrich, Deputy Administrator if staff would be working to amend land use ordinances for allowing for more tiny home encampments. Brian Heinrich relayed that would be part of the process. Council Member Lilliquist remarked that many suitable sites for tiny home encampments are privately owned property. While the City would like to find a parcel for a shelter, there is a limited amount of publicly held properties that work for such a site. He also stated that the total cost of running tiny home encampments is expensive when considering the volunteer hours that are required. More tiny home villages would require additional volunteers to help facilitate the need of the camps. Council President Hammill reported that while he was in Denver last week to attend a Children's Funding Institute. He also met with providers of local jail alterative programs in Denver, that focus on prevention starting from early childhood. Ordinance Amending the 2019-2020 Biennial Budget, Adding One Position and Increasing Appropriation Authority in the Development Services Fund Terry Bornemann / Gene Knutson moved approval for third and final reading. Upon motion, said bill was placed on final passage and approved by the following roll call vote: AYES: Hammill, Barker, Knutson, Vargas, Bornemann, Lilliquist, Stone NAYS: (None) EXCUSED: (None) MOTION CARRIED and was thereafter named Ordinance #2019-09-027.
