Belton City Council Meeting March 22, 2022 – 5:30 P.M. The Belton City Council met in regular session in the Wright Room of the Harris Community Center. Members present included Mayor Wayne Carpenter, Mayor Pro Tem David K. Leigh and Councilmembers Craig Pearson, Dan Kirkley, Guy O’Banion, John R. Holmes, Sr. and Daniel Bucher. Staff present included Sam Listi, Gene Ellis, John Messer, Amy Casey, Mike Rodgers, Jon Fontenot, Tina Moore, Chris Brown, Matt Bates, Bob van Til, Paul Romer, Larry Berg, Judy Garrett, Cynthia Hernandez, and Jo-Ell Guzman. The Pledge of Allegiance to the U.S. Flag was led by Councilmember Craig Pearson, and the pledge to the Texas Flag was led by City Clerk Amy Casey. The Invocation was given by Mayor Pro Tem David K. Leigh. 1. Call to order. Mayor Carpenter called the meeting to order at 5:31 p.m. 2. Public Comments. (Audio 2:04) Cherisse Bennett, 990 Lake Road – invited the Council to the Belton Police Foundation Awards Banquet at 6:00 PM on April 23, 2022, to honor all police employees and volunteers. Councilmember Craig Pearson thanked the City team for their work during the recent inclement weather. 3. Proclamation: Pete Fredenburg Day – March 22, 2022. (Audio 3:25) Coach Fredenburg was present to receive this proclamation and thanked the Council for the honor. Consent Agenda Items 4-5 under this section are considered to be routine by the City Council and may be enacted by one motion. Consider adopting the following resolutions for Community Development Block Grant (CDBG) related items for Grant Contract 722021 to replace water lines on N. East Street and E. 5th Avenue: A. Designating authorized signatories; B. Appointing a Labor Standards Officer; C. Designating a Civil Rights Officer; and D. Planning and Zoning 6. Z-22-08 Hold a public hearing and consider a zoning change from Agricultural (A) to Planned Development - Commercial-1 (PD-C-1) District on approximately 15.836 acres located at 2406 Lake Road (FM 439), generally located west of FM 2271 and east of Sparta Road, to establish an RV Park. Public Hearing: • Tony Gallagher (has worked with the applicant on the project), 510 Marshall – spoke in favor of the rezoning Belton City Council Meeting March 22, 2022 – Page 3 • Jason Williams (business partner of applicant), 6373 Eagle Point Main – spoke in favor of the rezoning • Zoe Grant (applicant’s engineer), 510 E Avenue J, Temple – spoke in favor of the rezoning • Sharma Piyush (applicant), 2502 Lake Road – spoke in favor of the rezoning • Cherie Ilse, 1605 Sandbar Circle – spoke against the rezoning • Kelsey Vitek, 1603 Sandbar Circle – spoke against the rezoning Upon a motion for approval of the rezoning by Councilmember O’Banion, and a second by Councilmember Kirkley, the rezoning was denied upon a vote of 3-4 as follows: In favor of the rezoning: Councilmembers Kirkley, Pearson and O’Banion; Against the rezoning: Mayor Carpenter, Mayor Pro Tem Leigh and Councilmembers Bucher and Holmes. Councilmember Craig Pearson recused himself from the following item and left the room. 7. Z-22-09 Hold a public hearing and consider a zoning change from Agricultural (A) to Single Family-1 (SF-1) Residential District on approximately 10.362 acres located at the southeast intersection of Elm Grove Spur and Capitol Way, generally east of Interstate 35 and south of Elm Grove Spur. (Audio 51:36) Planner Tina Moore presented this item. Public Hearing: Josh Pearson (applicant) 6575 FM 439 – was available to answer questions. Upon a motion by Councilmember Holmes, a second by Mayor Pro Tem Leigh, and upon a vote of 6-0-1 (Councilmember Pearson abstaining), the property was rezoned to Single Family-1 District. ORDINANCE NO. 2022-20 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM AGRICULTURAL TO SINGLE FAMILY-1 RESIDENTIAL DISTRICT ON AN APPROXIMATE 10.362 ACRE PROPERTY LOCATED AT THE SOUTHEAST INTERSECTION OF ELM GROVE SPUR AND CAPITOL WAY. Councilmember Pearson returned to the room. 8. Z-22-10 Hold a public hearing and consider a zoning change from Agricultural (A) to Single Family-3 (SF-3) Residential District on approximately 97.413 acres located at 1000 E. Avenue H, generally east of Interstate 35 on the northside of E. Avenue H and south of Nolan Creek. Following discussion, Mayor Pro Tem Leigh made a motion to postpone this item to a future meeting. Councilmember Holmes seconded the motion which passed upon a vote of 7-0. 9. Hold a public hearing and consider an ordinance amending Section 38 of the Zoning Ordinance, Sign Regulations, to allow Changeable Copy Message Signs, by right in certain zoning districts along IH 35 and IH 14. (Audio 1:23:49) Director of Planning Bob van Til presented this item. Public Hearing: Pastor Matt Thrasher, Crossroads Church, spoke in favor of the amendments. Following discussion, Mayor Pro Tem Leigh made a motion to postpone this item to the April 12, 2022, City Council meeting. Councilmember Holmes seconded the motion which passed upon a vote of 7-0. Miscellaneous 10. Hold a public hearing regarding a strategic partnership agreement with River Farm Municipal Utility District of Bell County. (Audio 1:55:05) City Manager Sam Listi presented this item. Public Hearing: No one spoke for or against. No action was required of Council at this time. Another public hearing will be held on this matter on April 12, 2022, and the agreement will be considered for approval at that time. 11. Consider a resolution allocating funding received from the Coronavirus State and Local Fiscal Recovery Funds, a part of the American Rescue Plan Act of 2021, to certain projects in response to the COVID-19 public health emergency. Mayor Pro Tem Leigh made a motion to approve the resolution with an amendment to combine the proposed $500,000 for water meter infrastructure replacement with the streets infrastructure category. Councilmember Holmes seconded the motion, and the following captioned resolution was approved upon a vote of 7-0.
