CALL TO ORDER BY THE MAYOR The meeting was called to order at 7:35 p.m. by Mayor Ryan followed by the Pledge of Allegiance and the Roll Call. Quorum present. ALSO PRESENT: Bryan Schafer, Planning Director; Bob Therres, Public Services Manager; Joe Huss, Finance Director; Chris Olson, Police Chief/Safety Services Manager; Jean Keely, City Engineer; Roark Haver, Communications Technician; Jason Sundeen, Senior Engineering Technician; Jane Cross, City Clerk; and Recording Secretary Linda Dahlquist. 2. PLEDGE OF ALLEGIANCE 3. Councilmember Bourke and Councilmember Herbst abstained from the Workshop Meeting Minutes of September 12, 2013 due to their absence. Moved by Mayor Pro Tem Swanson, seconded by Councilmember Herbst, that this Minutes be Approved. Motion adopted 3-0-3. 5. AWARDS - PRESENTATIONS - ORGANIZATIONAL BUSINESS 5.-1 PROC 13-06 PROCLAIMING EXTRA MILE DAY 2013 Mayor Ryan proclaimed November 1, 2013 as Extra Mile Day 2013 in the City of Blaine. Informational: no action required 5.-2 PROC 13-07 PROCLAMATION EAGLE SCOUT MATTHEW CHOQUETTE Mayor Ryan proclaimed Matthew Choquette an outstanding citizen and thanked him for his project, which contributed to the attractiveness of six City parks, and congratulated him on receiving his Eagle Scout Award. Informational: no action required 5.-3 TMP 13-1267 Police Chief Olson thanked the Council for their support of the Explorer Program. Sargeant Owens introduced Explore Captains Charlie Bloomer and Carey Davis and gave an overview of the Explorer Program. He noted Blaine has 40 Police Explorers who have donated over 7,860 hours in the community along with 23 Police Advisors. Sargeant Owens thanked the sponsors Wal-mart (Hwy 65 and Pheasant Ridge) and 3M Championship who support the Explore Program. Charlie Bloomer gave an overview of the Blaine Explorers’ performance at the State Conference. Carey Davis gave an overview of the upcoming National Explorers Conference and her participation at the National Leadership Academy. Informational: no action required 6. OPEN FORUM FOR CITIZEN INPUT Mayor Ryan opened the Open Forum at 7:54 p.m. There being no input, Mayor Ryan closed the Open Forum at 7:54 p.m. Mayor Ryan moved agenda item 12.2 to be heard first on the agenda. 8. ADOPTION OF AGENDA 12.-2 MO 13-122 PROVIDING HOST CITY AUTHORIZATION FOR THE ISSUANCE OF REVENUE BONDS ON BEHALF OF BETHESDA LUTHERAN COMMUNITIES, INC. Sponsors: Huss Attachments: Bethesda 13 Minnesota (Blaine) Memorandum to City Council Blaine Host TEFRA Approval, BLC Bethesda 13 Minnesota (Blaine) Certificate of Executive Director to City Bethesda 13 Minnesota (Blaine) TEFRA Notice of Public Hearing Moved by Mayor Pro Tem Swanson, seconded by Councilmember Kolb, that this Motion be Removed from the Table. The Motion was adopted unanimously. Finance Director Huss stated the Wisconsin Health and Educational Facilities Authority is requesting Blaine provide host city approval for the issuance of revenue bonds on behalf of Bethesda Lutheran Communities, Inc. to finance the purchase of a van. He noted the applicant needs host city approval and the bonds issued will not be obligations of the City. He stated that the Council had questioned the amount of the bond was greater than the amount of the use for the residence listed on the bond. He noted that the home is leased by Bethesda. Councilmember Swanson questioned the $600,000 bond. Finance Director Huss stated the bond would be reduced to the actual purchase. Monica Schmidt, Bethesda Area Director, stated she is overseeing the operations in Minnesota and noted there are seven properties within three communities in Minnesota that will share the funding. She stated Bethesda purchased Community Living, Inc. on August 1, 2013. Moved by Councilmember Bourke, seconded by Mayor Ryan, that this Motion be Approved. The Motion was adopted unanimously. Motion adopted unanimously. 10. ADMINISTRATION 12.-1 ORD 13-2273 AN ORDINANCE AMENDING CHAPTER 42, HEALTH AND SANITATION, ARTICLE II, TOBACCO, DIVISION 1, GENERALLY, SEC. 42-32, DEFINITIONS AND INTERPRETATIONS, OF THE MUNICIPAL CODE OF THE CITY OF BLAINE City of Blaine Page 5 City Council Minutes - Final October 17, 2013 Sponsors: Cross City Clerk Cross stated the Tobacco Modernization and Compliance Act of 2010 expanded the definition of what is regulated as tobacco and because of the expanded definition, cities may now regulate e-cigs the same way as cigarettes, cigars, snuff and chew. Declared by Mayor Ryan that Ordinance 13-2273, “An Ordinance Amending Chapter 42, Health and Sanitation, Article II, Tobacco, Division 1, Generally, Sec. 42-32, Definitions and Interpretations of the Municipal Code of the City of Blaine,” be introduced and placed on file for second reading at the November 7, 2013 Council meeting. 13. OTHER BUSINESS Moved by Councilmember Herbst, seconded by Councilmember Kolb, to order a Closed Special Council Meeting to reconvene and discuss open labor contracts on November 7, 2013 at 6:30 p.m. Motion adopted unanimously. 14.
