MINUTES OF COUNCIL MEETING
October 3, 2016
A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, October
3, 2016, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100
Smith Street with Mayor Carson Ross presiding.

Also present were City Administrator Eric Johnson, Deputy City
Administrator Adam Norris, City Attorney Nancy Yendes, and City
Clerk Sheryl Morgan.
CALL MEETING Mayor Carson Ross called the City Council meeting to order and led
TO ORDER in the Pledge of Allegiance.
MAYOR COMMENTS Mayor Ross gave a brief recap of the meeting agenda and explained
the Consent Agenda.
APPROVE CITY COUNCIL Councilman Edmondson moved to approve the minutes of the
MINUTES September 19, 2016 meeting of the City Council meeting. Motion
seconded by Councilman Culpepper and carried with the following
votes:

PUBLIC HEARING - Mayor Ross opened the Public Hearings at the request of the
REZONE EAGLES RIDGE Applicant, Blue Springs South Safety Storage, LLC, David Ward , for
ESTATES PR-O AND consideration to ( 1) rezone from "MF-14/PR-0" (Moderate Density
EAGLES RIDGE VILLAS Multi-Family Planned Residential Overlay) and "SF-7/PR-0" (Single
PR-O (RZ-08-16-5436)
Family/Planned Residential Overlay) to "TF/PR-0" (Two-Family/

AMENDED PR-O

ESTATES PR-O AND Eagles Ridge Villas PR-O concurrently at 6:02 p.m. The minutes of
EAGLES RIDGE VILLAS the public hearings were recorded by a certified court reporter. City
PR-O (PROC-08-16-5437) Clerk Sheryl Morgan entered one exhibit into the record for each
public hearing.
STAFF REPORT Scott Allen, Director of Community Development, stated the
development is located East of SW 7 Highway, South of SW
Webster Drive and North of SW Major Road. The Applicant is
requesting to rezone an undeveloped 38.20 +/- acre portion of the
southeast corner of Eagles Ridge subdivision from its current zoning
of MF- 14/PR-0 and SF-7/PR-0 to TF/PR-0. The majority of the

38.20 +/- acre site is currently zoned MF-14/PR-0, with only the
northern portion of the site zoned SF-7/PR-0. If approved, the
proposed plan would reduce the density of the entire Eagles Ridge
subdivision to 540 dwelling units (194 single-family, 314 two-family
units, and 32 four-plex units), down from 580 dwelling units. The
applicant proposes to utilize building designs similar to the existing
Eagles Ridge duplexes. The Planning Commission unanimously
recommended the rezoning for approval.
Mr. Allen stated the Amended PR-O Concept Plan would reduce the
density of the entire Eagles Ridge subdivision to 540 dwelling units;
down from 580 dwelling units as previously approved. The proposed
plan includes 150 single family homes, 117 duplexes (234 units), 2
commercial lots, and a community pool, clubhouse, and other open
space amenities. This is in addition to the currently approved and/or
existing 44 single family homes, 40 duplexes (80 units), and 8 four-
plexes (32 units), and 2 commercial lots. The applicant proposes to
utilize building designs similar to the existing homes within the
Eagles Ridge subdivision. The street layout is altered from the
originally approved plan. The Planning Commission recommended
the Amended PR-O Concept Plan for approval with conditions.
COUNCIL DISCUSSION Council and staff discussed the number and types of units under the
current proposed plan as well as connector streets to Cordill Mason.
APPLICANT Applicant, David Ward, stated amenities such as clubhouse, pool,
etc. would be in the next phase of construction. He will be creating
an access point to 7 Highway off of Major Road . There are plans for
retail and commercial that will be coming before Council next spring.
IN OPPOSITION TO Dan Baylard stated opposition to the plan because it does not
commit the developer to a date in which the pool has to be built. Mr.
Allen confirmed permits for the next phase would not be released
until the pool has been built. City Attorney Nancy Yendes stated the
Ordinance could be amended to outline timing and limiting access
to building permits.
Corinne Arens expressed concern about the timeline for the pool
and pool access for use by others than the single family
homeowners. Mr. Ward stated as long as he has control over the
pool, it will be only accessible by the single family homeowners. If,
after it has been completed and deeded to the current single family
homeowners association, the association could decide whether they
wanted to offer any type of membership to others.
The Mayor hearing no further comments for or against, closed the
public hearing at 6:45 p.m.

Councilman Fowler moved to approve Bill No. 4443 upon its first
reading and proceed with the second reading. Motion seconded by
Councilman Culpepper and carried unanimously.
COUNCIL DISCUSSION Councilmen Lievsay stated as the liaison to the Planning
Commission he sat through all hearings and gave kudos to Mr. Ward
for working with the residents in addressing their concerns.
2ND READING- BILL NO. Ms. Morgan made the second reading of Bill No. 4443 by title.
4443 Councilman Quibell moved to adopt Bill No. 4443 upon its second
reading and give it ORDINANCE NO. 4616 with a copy attached
hereto and made a part of the minutes. Motion seconded by

COUNCIL DISCUSSION Staff confirmed Councilman Carter's understanding that building
permits for Phase 4 are being held until the pool is built.
Councilman Fowler stated he understood the developer's plan to
build the pool prior to Phase 4 construction begins.

were recorded by a certified court reporter. City Clerk Sheryl
Morgan entered one exhibit into the record for each public hearing.
STAFF REPORT Jim Holley, Assistant Director of Community Development, stated
the applicant is proposing to expand the existing retail garden center
and nursery to provide additional retail, services, and agritourism
activities. The total site consists of approximately 30.16 +/- acres
located north of SE Wyatt Road and west of SE Adams Dairy
Parkway. Approximately 21.91 +/-acres will be rezoned to "GB" and
8.25 +/- acres will be rezoned to "RE." This rezoning request is
consistent with the goals of the 2014 Comprehensive Plan. The
Planning Commission unanimously recommended the rezoning for
approval.
Mr. Holley also stated the development, formerly known as Colonial
Nursery, already includes a retail garden center and nursery
business. The applicant would like to expand the existing business
and add additional retail and service options, including agritourism
activities and food services. Colonial Gardens will be developed over
a minimum of three (3) phases, beginning with enhancements to the
existing retail garden center and adjacent buildings and a new cafe.
The Planning Commission unanimously recommended the PO
Concept Plan for approval.
APPLICANT Torey Schwope, owner, described the facility and his plans in detail.
IN SUPPORT OF Sarah O'Brian, owner of the Bean Counter Cafe, spoke in support of
the project; she is planning to have her location at the Colonial
Gardens location focusing on farm-to-table food .

PRESENTATION- MaryAnne Metheny, CEO of Hope House gave a presentation on
CHILDREN'S SERVICES the upcoming Children's Services Fund Coalition ballot initiative.
FUND COALITION The presentation is to inform of an initiative that will be on the ballot
in November to address the unmet needs of children in Jackson
County. There is a large gap in the funding available for chi ldren's
services and this measure allows Jackson County to address that
need and allows more funding for services for children . A copy of
the PowerPoint presentation is attached to these Minutes.
MAYORAL Mayor Ross reminded there are 36 days left to the Presidential
ANNOUNCEMENTS election.

limit at AA Highway at Adams Dairy Parkway.
