CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING MAY 15, 2017 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, May 15, 2017, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building , 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEN IN Jerry Kaylor Dale Carter ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Deputy City Administrator Adam Norris, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING Mayor Carson Ross called the City Council meeting to order and led TO ORDER in the Pledge of Allegiance. APPROVE CITY COUNCIL Councilman Culpepper moved to approve the Minutes of the May 1, MINUTES 2017 meeting of the City Council meeting. Motion seconded by Councilman Lievsay and carried with the following votes : Councilman Kaylor- Aye Councilman Carter- Aye Councilman Lievsay -Aye Councilman Edmondson -Aye Councilman Fowler- Aye Councilman Culpepper - Aye Mayor Ross -Aye RESOLUTION 33-2017 - Councilman Culpepper moved to adopt Resolution No. 33-2017 PURCHASE OF 2017 1.5 approving the purchase of a 2017 1.5 ton 4x4 extended cab truck TON 4X4 TRUCK from Blue Springs Ford in the amount of $63,264.00. Motion seconded by Councilman Lievsay and carried with the following votes: Councilman Kaylor- Aye Councilman Carter- Aye Councilman Lievsay -Aye Councilman Edmondson -Aye Councilman Fowler - Aye Councilman Culpepper- Aye Mayor Ross -Aye RESOLUTION 34-2017 - Councilman Culpepper moved to adopt Resolution No. 34-2017 ELECTRIC VEHICLE approving a contract with Kansas City Power & Light for the SUPPLY EQUIPMENT installation and operation of two Electric Vehicle Supply Equipment STATIONS stations. Motion seconded by Councilman Lievsay and carried with the following votes: Councilman Kaylor - Aye Councilman Carter- Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross -Aye May 15, 2017 City Council Meeting Page 2 RESOLUTION 35-2017- Councilman Culpepper moved to adopt Resolution No. 35-2017 PAYMENT OF PORTION approving the payment of 5% of a TracFone class action lawsuit OF SETTLEMENT settlement to Missouri Municipal League . Motion seconded by PROCEEDS TO MML Councilman Lievsay and carried with the following votes: Councilman Kaylor- Aye Councilman Carter- Aye Councilman Lievsay -Aye Councilman Edmondson - Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross- Aye RESOLUTION 36-2017 - Councilman Culpepper moved to adopt Resolution No. 36-2017 CONTRACT FOR approving a Contract with Fleming Auto Center, Inc. dba Jackson TOWING SERVICES County Tow Service for towing services . Motion seconded by Councilman Lievsay and carried with the following votes: Councilman Kaylor- Aye Councilman Carter- Aye Councilman Lievsay -Aye Councilman Edmondson - Aye Councilman Fowler- Aye Councilman Culpepper -Aye Mayor Ross- Aye APPROVE LIQUOR Councilman Culpepper moved to approve new liquor license for LICENSE FOR MINSKY'S Dew-Raw Inc. dba Minsky's Pizza at 201 N 7 Highway Blue Springs, PIZZA MO 64015 , to sell intoxicating liquors by the drink for consumption on premises to include Sunday retail sales by the drink, on the premises; or in original package for consumption on or off premises. Motion seconded by Councilman Lievsay and carried with the following votes : Councilman Kaylor- Aye Councilman Carter- Aye Councilman Lievsay -Aye Councilman Edmondson - Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross- Aye APPROVE LIQUOR Councilman Culpepper moved to approve a new liquor license for LICENSE FOR PACELINE Paceline KC, LLC at 1112 NE Coronado Drive Blue Springs, MO KC, LLC 64015, to sell beer and wine only by the drink, or in the original package to include Sunday sales. Subway used to occupy this space . Motion seconded by Councilman Lievsay and carried with the following votes: Councilman Kaylor- Aye Councilman Carter- Aye Councilman Lievsay -Aye Councilman Edmondson -Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross -Aye APPROVE LIQUOR Councilman Culpepper moved to approve to change the location on LICENSE FOR EL the current liquor license for El Ranchero Mexican Restaurant LLC RANCHERO MEXICAN from 1605 SW 7 Highway to 1867 SW 7 Highway. Skylight RESTAURANT LLC Restaurant & Sports Bar used to occupy this space . El Ranchero Mexican Restaurant LLC is changing the location for the remainder of the 2016-2017 license year and paid for their license renewal for 2 May 15, 2017 City Council Meeting Page 3 2017-2018 at this time. Motion seconded by Councilman Lievsay and carried with the following votes: Councilman Kaylor- Aye Councilman Carter- Aye Councilman Lievsay- Aye Councilman Edmondson - Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross- Aye 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4487 by title. 4487 -ANNEXING A Councilman Carter moved to adopt Bill No. 4487 upon its second PORTION OF RIGHT-OF- reading and give it ORDINANCE NO. 4662, with a copy attached WAY FOR EASTBOUND hereto and made a part of the minutes. Motion seconded by 40 HIGHWAY (ANNX-09- Councilman Edmondson and carried with the following vote : 16-5512) Councilman Lievsay -Aye Councilman Edmondson -Aye Councilman Fowler- Aye Councilman Culpepper- Aye Councilman Carter- Aye Councilman Kaylor- Aye Mayor Ross -Aye PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider annexation of ANNEXATION OF LOTS 9 Lots 9 and 10, Blue Springs Park subdivision (ANNX-04-17-5773) at AND 10, BLUE SPRINGS 6:05 p.m. The minutes of the public hearing were recorded by a PARK SUBDIVISION certified court reporter. City Clerk Sheryl Morgan entered one (ANNX-04-17 -5773) exhibit into the record. STAFF REPORT Scott Allen reviewed the details of the annexation request. This is a request made by the applicant, Leonard Parker. The Mayor hearing no further comments for or against, closed the public hearing at 6:07 p.m. INTRODUCTION AND 1ST Councilman Culpepper introduced Bill No. 4494 annexing Lots 9 and READING - BILL NO. 10, Blue Springs Park subdivision. City Clerk Sheryl Morgan made 4494- ANNEXATION OF the first reading of Bill No. 4494 by title; copies of the proposed Bill LOTS 9 AND 10, BLUE having previously been made available to the public. SPRINGS PARK SUBDIVISION (ANNX-04- 17-5773) Councilman Fowler moved to approve Bill No. 4494 upon its first reading and proceed with the second reading at the June 5, 2017 Council meeting. Motion seconded by Councilman Carter and carried unanimously. MAYORAL Congratulations to Assistant City Administrator on receiving the ANNOUNCEMENTS Excellence in Government Award from the Government Finance Officers Association of Missouri. "Not everything that is faced can be changed, but nothing can be changed until it is faced" (James Baldwin) VISITORS Ruth Bocchino of the Public Relations Committee of the Missouri City Clerks and Finance Officers Association presented City Clerk 3 May15, 2017 City Council Meeting Page 4 Sheryl Morgan with her Missouri Registered City Clerk certification. ADJOURNMENT At 6:16 p.m., Councilman Carter moved for the Council go into closed session pursuant to Section 610.021 , subparagraphs (1) and (2), Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel including litigation and real estate, and that any minutes, documents and other records discussed or taken during the closed session remain closed, and that this body stand adjourned at the completion of such session.
