MINUTES OF COUNCIL MEETING
OCTOBER 2, 2017
A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, October
2, 2017, 6:00p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100
Smith Street with Mayor Carson Ross presiding.
COUNCILMEN IN Jerry Kaylor Dale Carter - Absent
ATTENDANCE Chris Lievsay Kent Edmondson
Ron Fowler Susan Culpepper
Also present were City Administrator Eric Johnson, Assistant City
Administrator Christine Cates, City Attorney Jacqueline Sommer,
and Deputy City Clerk Dylan Gibson.
CALL MEETING Mayor Ross called the City Council meeting to order, asked for a
TO ORDER moment of silence for the victims of the Las Vegas mass shooting,
and led in the Pledge of Allegiance.
APPROVE CITY COUNCIL Councilman Culpepper moved to approve the Minutes of the
MINUTES September 18, 2017 meeting of the City Council meeting. Motion
seconded by Councilman Edmondson and carried with the following
votes:

RESOLUTION NO. 68-2017 Councilman Culpepper moved to adopt Resolution No. 68-2017
- DISPOSITION OF approving the disposition of Information Technology records. Motion
RECORDS seconded by Councilman Edmondson and carried with the following
votes:

APPROVE LIQUOR Councilman Culpepper moved to approve a new liquor license for
LICENSE FOR JOHNNY'S Johnny's Tavern Blue Springs, Inc. dba Johnny's Tavern located at
TAVERN 1175 SW 7 Highway, to sell retail intoxication liquors by the drink for
consumption on premises, Restaurant-Bar/Lounge-Bar, as well as
Sunday retail selling of intoxication liquors by the drink, on the
premises; or in original package for consumption on or off premises.
Motion seconded by Councilman Edmondson and carried with the
following votes :

RESOLUTION NO. 69-2017 Councilman Culpepper moved to adopt Resolution No. 69-201 7
-RATIFYING CONTRACT ratifying a contract in the amount of $62,879.25 with SAK
FOR EMERGENCY STORM Construction, LLC for emergency storm main repair. Motion
MAIN REPAIR seconded by Councilman Edmondson and carried with the following
votes:

PUBLIC HEARING- Mayor Ross opened the Public Hearing to consider the vacation of
VACATION OF UTILITY a utility easement located generally at the east side of NE Merchison
EASEMENT AT 2004 NE Court at 6:02 p.m. The minutes of the public hearing were recorded
MERCHISON COURT by a certified court reporter. Deputy City Clerk Dylan Gibson entered

one exhibit into the record for the public hearing.
STAFF REPORT Nathan Jurey, Associate Planner, stated the applicant, Jared
Broughton, is requesting a vacation of a utility easement located
generally at the east side of NE Merchison Court. The applicant
wants to construct a deck in the rear of the property, but doing so
would encroach on the easement.
The Mayor hearing no comments for or against, closed the public
hearing at 6:05p.m.
INTRODUCTION AND 1ST Councilman Culpepper introduced Bill No. 4519 vacating an utility
READING- BILL NO. 4519 easement located generally at the east side of NE Merchison Court,
- VACATION OF UTILITY approximately 650 feet south of NE Craig ievar Court with an address

Councilman Fowler moved to approve Bill No. 4519 upon its first
reading . Motion seconded by Councilman Edmondson.
2ND READING- BILL NO. Mr. Gibson made the second reading of Bill No. 4519 by title.
4519 Councilman Culpepper moved to adopt Bill No. 4519 upon its
second reading and give it ORDINANCE NO. 4689, with a copy
attached hereto and made a part of the minutes. Motion seconded
by Councilman Kaylor and carried with the following vote:

acres.at 6:06p.m. The minutes of the public hearing were recorded
by a certified court reporter. Deputy City Clerk Dylan Gibson entered
one exhibit into the record .
STAFF REPORT Nathan Jurey, Associate Planner, stated the applicant, BHC
Rhodes, is requesting the rezoning of St. Mary's 2nd Plat. Nathan
explained that the applicant is wanting to simplify the zoning and
boundaries of the property.
The Mayor hearing no further comments for or against, closed the
public hearing at 6:08 p.m.
INTRODUCTION AND 1ST Councilman Culpepper introduced Bill No. 4520 approving the

Councilman Kaylor and carried unanimously.
2ND READING - BILL NO. Councilman Culpepper moved to adopt Bill No. 4520 upon its
4520 second reading and give it ORDINANCE NO. 4690, with a copy
attached hereto and made ·a part of the minutes. Motion seconded
by Councilman Kaylor and carried with the following vote :

PUBLIC HEARINGS - Mayor Ross opened the Public Hearings to consider the approval of
AMENDED PR-O an amended PR-O Concept Plan for Eagles Ridge PR-O & Eagles
CONCEPT PLAN FOR Ridge Villas PR-O and the Rezoning of Tidal Wave Auto Spa
EAGLES RIDGE PR-O & concurrently at 6:09 p.m. The applicants are requesting the public

hearing be continued to the October 16, 2017 and the November 2,
PR-O (PROC-09-17-6008)
AND REZONING TIDAL
2017 Council meetings respectively. A motion to continue the public

MOTION TO CONTINUE Councilman Edmondson moved to continue the public hearings on
PROC-09-17 -6008 and RZ- the amended PR-O Concept Plan for Eagles Ridge PR-O & Eagles
08-17-5944 Ridge Villas PR-O to the October 16, 2017 Council meeting and the
Rezoning of Tidal Wave Auto Spa to the November 2, 2017 Council
Meeting. Motion seconded by Councilman Kaylor and carried
unanimously.

Councilman Kaylor and carried unanimously.
2ND READING- BILL NO. Councilman Culpepper moved to adopt Bill No. 4521 upon its
4521 second reading and give it ORDINANCE NO. 4691 , with a copy
attached hereto and made a part of the minutes. Motion seconded
by Councilman Edmondson and carried with the following vote :

MAYORAL Mayor Ross informed the audience that the swearing in of the new
ANNOUNCEMENTS Chief of Police for the Blue Springs Police Department, Bob Muenz,
will take place at tonight's meeting.
Mayor then reminded everyone to attend the National Night Out in
Blue Springs the following night.

OATH OF OFFICE City Administrator Eric Johnson gave remarks on the history of the
ADMINISTERED position of the Chief of Police for the City and stated his confidence
in Bob Muenz in serving in the role going forward.
Deputy City Clerk Dylan Gibson administered the Oath of Office to
newly appointed Chief of Police Bob Muenz.
ADJOURNMENT At 6:18 p.m., there was no further business to come before the
Council; Councilman Edmondson moved the meeting be adjourned.
Motion seconded by Councilman Kaylor and carried unanimously.
