CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING MAY 21, 2018 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, May 21, 2018, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEN IN Jerry Kaylor Dale Carter ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING Mayor Ross called the City Council meeting to order at 6:00 p.m. TO ORDER Scouts from Troop 362 from St. John Lalande led the audience in the Pledge of Allegiance. Mayor Ross announced the Public Official Liability Training will be moved to immediately before the Council goes into the Closed Session. APPROVE CITY COUNCIL Councilman Edmondson moved to approve the Minutes of the May MINUTES 7, 2018 City Council meeting. Motion seconded by Councilman Kaylor and carried with the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye RESOLUTION 32-2018 - Councilman Edmondson moved to adopt Resolution No. 32-2018 CONTRACT TO PAVE approving a contract in the amount of $154,004.00 with Tandem TRAILS AT Paving Company, Inc., for paving of Baumgardner Park and Woods BAUMGARDNER AND Chapel Park trails. Motion seconded by Councilman Kaylor and WOODS CHAPEL PARKS carried with the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye BOARD/COMMISSION Councilman Edmondson moved to approve the following Board/ APPOINTMENTS/ Commission appointments and reappointments: REAPPOINTMENTS Downtown Review Board: New appointment: Ken Billups, Jr. - Planning Comm. May 21, 2018 City Council Meeting Page 2 Human Relations Commission: New appointment: Marjorie Major - Chairman Billy Washington - Vice Chairman Planning Commission: New appointment: LaKeisha Veal Public Safety Citizens' Advisory Board: New appointment: Cynthia Savel - Chairman Motion seconded by Councilman Kaylor and carried with the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye PUBLIC HEARING - Mayor Ross opened the Public Hearing on the de-annexation of DE-ANNEXATION OF property approximately 600 feet east of NE Jellison Road and 400 PROPERTY GENERALLY feet south of East Pink Hill Road (approximately 1.0 +/- acre) from LOCATED AT 1750 E the City limits. (DEAX-04-18-6359) at 6:02 p.m. The minutes of the PINK HILL ROAD (DEAX-04-18-6359) public hearing were recorded by a certified court reporter. City Clerk Sheryl Morgan entered one exhibit into the record for the public hearing STAFF REPORT City Attorney Jacqueline Sommer and Mike Mallon, Assistant Director of Community Development, reviewed the details of the requested de-annexation. APPLICANT Applicant, William Dunning, outlined the history and the details for his request for de-annexation. The Mayor hearing no further comments for or against, closed the public hearing at 6: 11 p.m. INTRODUCTION AND 1sr Councilman Culpepper introduced Bill No. 4573 de-annexing READING - BILL NO. property approximately 600 feet east of NE Jellison Road and 400 4573 - DE-ANNEXATION feet south of East Pink Hill Road (approximately 1.0 +/- acre) from OF PROPERTY the City limits. Settlement Agreement in City of Blue Springs, Missouri v. Great 4574 -AUTHORIZING A Plains Energy Incorporated et al., Case No. 14AC-CC00229, and SETTLEMENT adding Section 645.080 Settlement Agreement to the Code of AGREEMENT AND ADDING SECTION Ordinances, City of Blue Springs, Missouri. City Clerk Sheryl Morgan 645.080 TO THE CODE made the first reading of Bill No. 457 4 by title; copies of the proposed OF ORDINANCES Bill having previously been made available to the public. Councilman Fowler moved to approve Bill No. 4574 upon its first reading and proceed with the second reading. Motion seconded by Councilman Culpepper and carried unanimously. 2No READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4574 by title. 4574 Councilman Carter moved to adopt Bill No. 4574 upon its second reading and give it ORDINANCE NO. 4744, with a copy attached hereto and made a part of the minutes. City SECTION 120.520.E OF Clerk Sheryl Morgan made the first reading of Bill No. 4575 by title; THE CODE OF copies of the proposed Bill having previously been made available ORDINANCES to the public. Councilman Fowler moved to approve Bill No. 4575 upon its first reading and proceed with the second reading. Motion seconded by Councilman Culpepper and carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4575 by title. 4575 Councilman Carter moved to adopt Bill No. 4575 upon its second reading and give it ORDINANCE NO. 4745, with a copy attached hereto and made a part of the minutes. Councilman Edmondson thanked the Public Works Director for the recent Public Works night. Thoughts to ponder: "What the mind of man can conceive and believe, it can be achieved." (Napoleon Hi/0 PUBLIC OFFICIAL City Attorney Jacqueline Sommer presented the Public Official LIABILITY TRAINING Liability Training to the Council. Ms. Sommer specifically addressed secret texting apps which have been in the news recently, ensuring the Councilmembers are using the City email addresses provided , and the use of email in relation to the Sunshine law. CLOSED SESSION At 6:21 p.m ., Councilman Carter moved for the Council go into closed session pursuant to Section 610. 021 , subparagraphs (2) and (9), Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to real estate and negotiations with employee groups, and that any minutes, documents and other records discussed or taken during the closed session remain closed, and that this body stand adjourned at the completion of such session.
