CITY OF BLUE SPRINGS, MISSOURI . MINUTES OF COUNCIL MEETING NOVEMBER 19, 2018 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, November 19, 2018, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEN IN Jerry Kaylor Dale Carter ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING Mayor Ross called the City Council meeting to order at 6:00 p.m. TO ORDER CONSENT AGENDA Councilman Fowler moved to approve the Consent Agenda and the motion was seconded by Councilman Kaylor. • Minutes of the November 5, 2018 City Council meeting • Resolution No. 95-2018 approving a contract in the amount of $83,142.00 with Custom Lighting Services, L.L.C. dba Black & McDonald for traffic signal/street light maintenance and repair • Resolution No. 96-2018 approving an agreement with the Mid- America Regional Council's Solid Waste Management District in the amount of $58,791.15 to participate in the 2019 Regional Household Hazardous Waste Collection Program • Resolution No. 97-2018 approving a purchase in the amount of $15,417.10 from Clark Equipment Company dba Bobcat Company for GIP project SAN-17 one (1) 2019 E55 T4 Bobcat Compact Excavator • Resolution No. 98-2018 approving the purchase, delivery, and installation of furniture for City Hall in the amount of $57,666.01 from Color Art Integrated Interiors of Kansas City, LLC dba Scott Rice Office Works, GIP project #BF-19 • Resolution No. 99-2018 adopting a Statement of Common Purpose emphasizing government innovation and collaborative problem solving with the cities of Independence, Lee's Summit and Blue Springs The Consent Agenda was approved with the following vote: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler -Aye Councilman Culpepper - Aye Mayor Ross - Aye PUBLIC HEARING - Mayor Ross opened the Public Hearings on the rezoning, the appeal REZONE CHARLIE'S CAR of the Planning Commission's denial of a Conditional Use Permit and November 19, 2018 City Council Minutes Page 2 WASH, LLC (RZ-09-18- Master/Alternative Sign Plan for Charlie's Car Wash located at 1110 6578), APPEAL CH.ARLIE'S NW 7 Highway from "GB" (General Business) to "RC" (Regional CAR WASH CONDITIONAL Commercial) at 6:03 p.m. The minutes of the public hearings were USE PERMIT (CUP-09-18- 6581) AND MASTER/ recorded by a certified court reporter. City Clerk Sheryl Morgan ALTERNATIVE SIGN PLAN entered two exhibits into the record for each public hearing. (ASP-09-18-6580) STAFF REPORT Matt Wright, Senior Planner, reviewed the details of the rezoning and appeals, and addressed questions from Council. City Attorney Sommer confirmed the appeal process has been followed. APPLICANT Don Boos spoke on behalf of the applicant, Blue Beacon Car Wash, and reviewed a PowerPoint presentation. Mr. Boos answered questions from Council. IN OPPOSITION TO Julius Oswald, Eleanor Frasier, Lyle Shaver, Bob Vezeau, Jerry Witherspoon, and Mike Lynn spoke in opposition. IN SUPPORT OF - Ken Garten, attorney for the applicant, responded to the comments in REBUTTAL. opposition. COUNCIL DISCUSSION Council asked staff to clarify the placement of the sidewalks and address additional questions. The Mayor, hearing no further comments for or against, closed the · public hearing at 7:27p.m. INTRODUCTION AND 1sr Councilman Culpepper introduced Bill No. 4616 rezoning Charlie's Car READING - BILL NO. 4616 Wash, LLC development from "GB" (General Business) to "RC" - REZONE CHARLIE'S (Regional Commercial). City Clerk Sheryl Morgan made the first CAR WASH LLC (RZ-09- 18-6578) reading of Bill No. 4616 by title; copies of the proposed Bill having previously been made available to the public. Councilman Fowler moved to approve Bill No. 4616 upon its first reading and proceed with the second reading. Motion seconded by Councilman Lievsay and the motion failed with the following vote after Council comments: Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - NO Councilman Culpepper - NO Councilman Carter - Aye Councilman Kaylor - NO Mayor Ross - NO WITHDRAWN - BILL NO. Bill No. 4617 approving a Conditional Use Permit for a car wash use at 4617 - CHARLIE'S CAR 1110 NW 7 Highway was withdrawn by the applicant. WASH CONDITIONAL USE PERMIT (CUP-09-18-6581) WITHDRAWN- Resolution No. 100-2018 approving a Master/Alternative Sign Plan for RESOLUTION 100-2018 - Charlie's Car Wash at 1110 NW 7 Highway was withdrawn by the CHARLIE'S CAR WASH applicant. MASTER/ALTERNATIVE November 19, 2018 City Council Minutes Page 3 SIGN PLAN (ASP-09-18- 6580) INTRODUCTION AND 1sr Councilman Culpepper introduced Bill No. 4612 approving a Funding READING-BILL NO. 4612 Agreement with Missouri Highways and Transportation Commission FUNDING AGREEMENT (MoDOT) for sidewalks along State Route 7 from 1-70 to NW Pink Hill WITH MoDOT FOR Road (CIP ST-43), STP 1200 (408). City Clerk Sheryl Morgan made SIDEWALKS the first reading of Bill No. 4612 by title; copies of the proposed Bill having previously been made available to the public. Councilman Fowler moved to approve Bill No. 4612 upon its first reading and proceed with the second reading. Motion seconded by Councilman Carter and carried unanimously. 2" 0 READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4612 by title. 4612 Councilman Carter moved to adopt Bill No. 4612 upon its second reading and give it ORDINANCE NO. 4777, with a copy attached hereto and made a part of the minutes. City Clerk Sheryl Morgan made the first reading of Bill No. 4618 by title; copies of the proposed Bill having previously been made available to the public. Councilman Fowler moved to approve Bill No. 4618 upon its first reading and proceed with the second reading. Motion seconded by Councilman Lievsay and carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4618 by title, 4618 Councilman Fowler moved to adopt Bill No. 4618 upon its second reading and give ii ORDINANCE NO. 4778, with a copy attached hereto and made a part of the minutes. City Clerk Sheryl Morgan made the first reading of BLUE SPRINGS CARWASH 1sr PLAT (PF- Bill No. 4619 by title; copies of the proposed Bill having previously been ( made available to the public. 10-18-6633) November 19, 2018 City Council Minutes Page 4 Councilman Fowler moved to approve Bill No. 461 9 upon its first reading and proceed with the second reading . Motion seconded by Councilman Edmondson and carried unanimously. 2N□ READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4619 by title. 4619 Councilman Carter moved to adopt Bill No. 4619 upon its second reading and give it ORDINANCE NO. 4779, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilman Culpepper and carried with the following vote: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye COUNCIL DISCUSSION - At the request of Councilmen Lievsay and Edmondson, Council WAIVING COMMUNITY discussed a policy exempting other public entities/political DEVELOPMET FEES subdivisions, such as School, Fire and Library Districts, from paying Community Development fees on projects in Blue Springs. No action was taken or motion made to propose changing the existing policy. MAYORAL Go Chiefs!
