CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING MAY 20, 2019 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, May 20, 2019, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and Deputy City Clerk Julia Porter. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and Boy Scout ORDER Troop 1306 of the Church of the Resurrection led in the pledge of allegiance. CONSENT AGENDA Councilmember Culpepper moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Lievsay. • Minutes of the May 20, 2019 City Council Meeting • Resolution No. 24-2019 approving a purchase and contract in the ( amount of $82,229.99 from Hilton Displays, LLC for signage at Burrus Old Mill Park, CIP project PR-01-19 • Resolution No. 25-2019 approving a lease/purchase agreement with VGM Financial Services, for the Lease/purchase of a Jacobsen HR600 Wide Area Mower for Adams Pointe Golf Club • 2019 Board and Commission Appointments - The list of the Mayor's appointments are as follows: CDBG Advisory Committee: New appointment: Jason Ellis, Downtown Review Board Rep. Deputy City Clerk Julia Porter made the WATERLINE EASEMENTS first reading of Bill No. 4663 by title; copies of the proposed Bill having (VAC-03-19-684 7) previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4663 upon its first reading and proceed with the second reading. Deputy City Clerk Julia Porter entered one exhibit into the record. STAFF REPORT Teresa Evans, Economic Development Coordinator, outlined the proposed tax abatement. APPLICANT Mike Yancik, Dwellings by Design, KC spoke on behalf of the applicant. The Mayor hearing no further comments for or against, closed the public hearing at 6: 19 p.m. INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4665 approving the READING - BILL NO. 4665 Jones Place Project under the Amended and Restated Main Center - TAX ABATEMENT FOR Redevelopment Plan and approving an abatement agreement for the PROPERTY AT 106 AND project. Deputy City Clerk Julia Porter made the first reading of Bill No. 108 SW 8TH STREET 4665 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4665 upon its first reading and proceed with the second reading. Deputy City Clerk Julia Porter entered one exhibit into the record. STAFF REPORT Mike Mallon, Assistant Director of Community Development, outlined the proposed Community Improvement District. APPLICANT Rich Wood, Polsinelli presented on the proposed Community Improvement District and addressed questions from the Council, the presentation is attached to these minutes. COUNCIL DISCUSSION Councilmember Fowler expressed his disapproval of authorizing ( services in the Community Improvement District and discussion followed.  May 20, 2019 City Council Minutes Page 5 APPLICANT Sid Douglas, Gilmore and Bell, and Rich Wood, Polsinelli, spoke on ( behalf of the applicant and addressed questions from Council related to authorizing services in the Community Improvement District. The Mayor hearing no further comments for or against, closed the public hearing at 6:38 p.m. INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4666 establishing the READING - BILL NO. 4666 North Blue Springs Community Improvement District and approving a - NORTH BLUE SPRINGS Cooperative Agreement among the City, the North Blue Springs CID Community Improvement District, and Enterprises Cosco, LLC. Deputy City Clerk Julia Porter made the first reading of Bill No. 4666 by title; copies of the proposed Bill having previously been made available to the public. MOTION TO AMEND BILL Councilmember Fowler concurrently moved to approve Bill No. 4666 NO. 4666 upon its first reading, and to Amend Bill No. 4666 by striking of items 8 and 9 under Exhibit D in the Cooperative Agreement and proceed with the second reading. COUNCIL DISCUSSION The Council discussed unfunded projects in the Capital Improvements Program. Deputy City Clerk Julia Porter entered one exhibit into the MEDICAL MARIJUANA record. STAFF REPORT Mike Mallon, Assistant Director of Community Development, outlined the proposed amendments to the Unified Development Code related to ( Medical Marijuana and addressed questions from Council. MOTION TO CONTINUE Councilmember Fowler concurrently moved to divide the Ordinance PUBLIC HEARING TO (sic) into two parts, to separate out Section 7 of the Ordinance (sic) JUNE 3, 2019 AND TO amending Section 404.240.E of the Downtown Development Code and AMEND BILL NO. 4668 to continue the public hearing on the amendment of Section-404:240-:-1::--------- of the Downtown Development Code to the June 3, 2019 City Council Meeting. Motion seconded by Councilmember Culpepper and carried unanimously after Council discussion. The Mayor hearing no further comments for or against, closed the public hearing at 7:06 p.m. INTRODUCTION AND 1 ST Councilmember Culpepper introduced Bill No. 4668 amending various READING - BILL NO. 4668 Sections and Subsections of Title IV, Chapters 401-411, Unified AMENDMENTS TO THE Development Code, of the Code of Ordinances of the City of Blue UNIFIED DEVELOPMENT Springs to adopt regulations for the Zoning, Land Use, and CODE RELATED TO Development Standards related to medical marijuana uses and MEDICAL MARIJUANA facilities. Deputy City Clerk Julia Porter made the first reading of Bill No. 4668 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4668, with previous amendment (sic) to divide the Ordinance into two parts upon its first reading and proceed with the second reading. Motion seconded by Councilmember Culpepper. The second part of the Public Hearing and  May 20, 2019 City Council Minutes Page 7 Ordinance amending the Code will be presented to the Council on June 3, 2019. ( 1st MOTION TO AMEND Councilmember Edmondson moved to amend Bill No. 4668 by adding BILL NO. 4668 Regional Commercial under permitted use for Medical Marijuana testing facilities. Motion was seconded by Councilmember Lievsay and carried unanimously. 2nd MOTION TO AMEND Councilmember Edmondson moved to amend Bill No. 4668 by BILL NO. 4668 changing Section 405.050.A.36.b to reduce the buffering from 1000 feet to 300 feet for Marijuana Testing Facilities. Motion was seconded by Councilmember Lievsay and carried unanimously after discussion.
