CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING JUNE 3, 2019 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, June 3, 2019, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Pro Tern Ron Fowler presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were Assistant City. Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Pro Tern Fowler called the meeting to order at 6:00 p.m. and led ORDER the audience in a moment of silence and the Pledge of Allegiance. Mayor Ross is enjoying time with his family and will return for the June 17, 2019 City Council meeting. CONSENT AGENDA Councilmember Edmondson moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Culpepper. • Minutes of the May 20, 2019 City Council Meeting • Resolution No. 29-2019 authorizing a contract with Black & Veatch Management Consulting, LLC in the amount of $51,700 for a consulting services agreement to perform a cost of service study for water and sewer • Resolution No. 30-2019 approving the disposition of Information Technology department records which have met the required retention period • Liquor License for Sun Enterprise LLC dba Happy Hour located at 1801 NW 7 Highway Blue Springs, MO 64015, to sell retail intoxication liquors in the original package, for consumption off premises, to include Sunday retail selling of intoxicating liquors by the drink on the premises, or in original package for consumption on or off premises • Resolution No. 31-2019 a contract in the amount of $148,204.00 with Jackson County Community Backed Anti-Drug Tax (COMBAT), for Drug Abuse Resistance Education (DARE) funding • Resolution No. 32-2019 approving a Memorandum of Understanding with Alternative Wire and Cable, LLC, providing for reimbursement of $30,000 for a portion of its costs to relocate a sewer line at 2900 Hunter Drive, to be paid from CIP Project SAN- 19 Sewer Infrastructure Deployment The Consent Agenda was approved with the following vote: Kaylor-Aye Edmondson - Aye Lievsay - Aye Culpepper - Aye June 3, 2019 City Council Minutes Page 2 Ericson - Aye Mayor Pro Tern Fowler-Aye Mayor Ross - ABSENT CONTINUATION OF Mayor Pro Tern Fowler re-opened the Public Hearing to consider PUBLIC HEARING - amendments to the Unified Development Code related to medical AMENDMENTS TO THE marijuana at 6:01 p.m. This is a continuation of the Public Hearing of a UNIFIED DEVELOPMENT Public Hearing that began at the May 20, 2019 City Council meeting. CODE RELATED TO The minutes of the public hearing were recorded by a certified court MEDICAL MARIJUANA reporter. City Clerk Sheryl Morgan restated the exhibit entered at the May 20, 2019 Public Hearing and entered one additional exhibit into the record. STAFF REPORT City Attorney Jacqueline Sommer stated this is a continuation of the public hearing that began on May 20, 2019, and advised Council take notice of exhibits that were offered and testimony given at the May 20th Council meeting. The only item before the Council for this public hearing is a proposed amendment to Section 404.240.E. Downtown Development Code to add Medical Marijuana Dispensary to the list of permitted uses in mixed-use and commercial building types. Mike Mallon, Assistant Director of Community Development, stated the continuation of the public hearing allowed the Downtown Review Board the opportunity to review the proposed amendments to the Unified Development Code. Mr. Mallon outlined the proposed amendments to the Downtown Development Code of the Unified Development Code related to Medical Marijuana and addressed questions from Council. COUNCIL DISCUSSION Council stated, although these issues do not affect the matter being addressed tonight, there may be requests in the future to reduce the buffer from 0-300 feet for dispensaries in the Downtown area, as well as revisions to setbacks and other restrictions. The Downtown merchants are interested in trying to attract a dispensary in the Downtown area. The Mayor Pro Tern Fowler hearing no further comments for or against, closed the public hearing at 6:06 p.m. INTRODUCTION AND 1 ST Councilmember Culpepper introduced Bill No. 4671 amending Section READING - BILL NO. 404.240.E, Downtown Development Code, of the Unified Development 4671 - AMEND 404.240.E, Code, of the Code of Ordinances of the City of Blue Springs for medical DOWNTOWN marijuana uses and facilities. City Clerk Sheryl Morgan made the first DEVELOPMENT CODE reading of Bill No. 4671 by title; copies of the proposed Bill having OF THE UNIFIED DEVELOPMENT CODE previously been made available to the public. Councilmember Lievsay moved to approve Bill No. 4671 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Edmondson and carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4671 by title. 4671 Councilmember Edmondson moved to adopt Bill No. 4671 upon its second reading and give it ORDINANCE NO. 4829, with a copy June 3, 2019 City Council Minutes Page 3 attached hereto and made a part of the minutes. Motion seconded by Councilmember Culpepper and carried with the following vote: Lievsay - Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Edmondson - Aye Mayor Pro Tern Fowler-Aye Mayor Ross - ABSENT BILL NO. 4672 - AMEND Mayor Pro Tern Fowler stated that City staff has requested Bill No. SECTION 505, STREETS 4672 proposing amendments to Section 505, Streets and Sidewalks, AND SIDEWALKS, of the Code of Ordinances relating to Small Wireless Facilities be RELATING TO SMALL presented to Council for consideration at the June 17, 2019 City WIRELESS FACILITIES Council meeting. No Council action was taken on this Bill. PRESENTATION - PARKS Dennis Dovel, Director of Parks and Recreation presented the FY2017- COMMISSION ANNUAL 18 Annual Report. A copy of the Annual Report and PowerPoint REPORT presentation are attached to these Minutes and incorporated herein. ANNOUNCEMENTS • The Grand Opening of the Burrus Old Mill Park Splash Pad will be on Wednesday, June 12, at 4:00 • The 75 th Anniversary of D-Day will be recognized at the Veterans Way Memorial at Pink Hill Park Thursday, June 6th at 10:30 a.m .
