CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING OCTOBER 7, 2019 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, October 7, 2019, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER Pledge of Allegiance. CONSENT AGENDA Councilmember Fowler requested Item 3c - Street Light Agreement with Lake Side at Chapman Farms Home Owners Association be pulled from the Consent Agenda for discussion and separate consideration. Councilmember Culpepper moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Edmondson. • Minutes of the September 23, 2019 City Council Special Meeting • Resolution No. 57-2019 approving the disposition of Information Technology department records which have met the required retention period • Resolution No. 59-2019 approving a contract renewal in the amount of $210,000.00 with Downey Construction, Inc. for miscellaneous concrete repair/construction • Resolution No. 60-2019 approving an Intergovernmental Agreement with the Land Bank of Blue Springs, Missouri to provide administrative and operational support The Consent Agenda with the exception of Item 3c was approved with the following vote: Kaylor-Aye Ericson - Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye ITEM 3c - CONTRACT Council and staff discussed details of the proposed contract for street FOR STREET LIGHTS lights. Councilmember Culpepper moved to approve Resolution No. 58-2019 approving a contract in the amount of $6,127.90 annually with the Lake Side at Chapman Farms Home Owners Association, October 7, 2019 City Council Minutes Page 2 Inc. for the installation and maintenance costs of a total of 35 ornamental street lights, nullifying and superseding the prior Contract 2017-179.1 R. Motion seconded by Councilmember Fowler and carried unanimously. INTRODUCTION AND 1 ST Councilmember Culpepper introduced Bill No. 4697 approving the READING - BILL NO. Final Plat for Eagles Ridge Villas PR-O 2nd Plat, Lots 44-74 and 4697 - FINAL PLAT FOR Tracts D-E. City Clerk Sheryl Morgan made the first reading of Bill No. EAGLES RIDGE VILLAS 4697 by title; copies of the proposed Bill having previously been made PR-O 2ND PLAT, LOTS 44- available to the public. 74 AND TRACTS D-E (PF- 09-19-7059) Councilmember Fowler moved to approve Bill No. 4697 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Culpepper and carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4697 by title. 4697 Councilmember Fowler moved to adopt Bill No. 4697 upon its second reading and give it ORDINANCE NO. 4854, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Culpepper and carried with the following vote: Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Mayor Ross - Aye INTRODUCTION AND 1 ST Councilmember Culpepper introduced Bill No. 4698 amending Title 111, READING - BILL NO. Schedule Ill. Prohibited Parking - Certain Sections of Designated 4698-CODE Streets, Table 111-A. No parking at any time, of the Code of Ordinances, AMENDMENT RELATING City of Blue Springs, Missouri. City Clerk Sheryl Morgan made the TO PROHIBITED first reading of Bill No. 4698 by title; copies of the proposed Bill having PARKING previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4698 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Culpepper and carried unanimously. 2ND READING- BILL NO. Ms. Morgan made the second reading of Bill No. 4698 by title. 4698 Councilmember Fowler moved to adopt Bill No. 4698 upon its second reading and give it ORDINANCE NO. 4855, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Ericson and carried with the following vote: Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay - Aye Mayor Ross - Aye INTRODUCTION AND 1 ST Councilmember Culpepper introduced Bill No. 4699 repealing and READING - BILL NO. replacing the existing Title Ill, Schedule II, Table II-A, Speed Limits, 4699 - CODE Blue Springs Code of Ordinances. City Clerk Sheryl Morgan made October 7, 2019 City Council Minutes Page 3 AMENDMENT RELATING the first reading of Bill No. 4699 by title; copies of the proposed Bill TO SPEED LIMITS having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4699 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and, after Council discussion, carried unanimously. COUNCIL DISCUSSION - Council directed staff to contact Missouri Department of INCREASE SPEED LIMIT Transportation to request a change in the speed limit on South 7 ON SOUTH 7 HIGHWAY Highway from Moreland School Road or Liggett Road to the southern boundary of Blue Springs from 45 to 50 miles per hour. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4699 by title. 4699 Councilmember Fowler moved to adopt Bill No. 4699 upon its second reading and give it ORDINANCE NO. 4856, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Mayor Ross - Aye INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4700 amending READING - BILL NO. Sections 120.210. 120.220, 120.240 and 120.260 of the Municipal 4700-CODE Code relative to practical updates to the functionality and reporting of AMENDMENT RELATING the Economic Development Council. City Clerk Sheryl Morgan made TO ECONOMIC the first reading of Bill No. 4700 by title; copies of the proposed Bill DEVELOPMENT having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4700 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING -BILL NO. Ms. Morgan made the second reading of Bill No. 4700 by title. 4700 Councilmember Fowler moved to adopt Bill No. 4700 upon its second reading and give it ORDINANCE NO. 4857, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Edmondson and carried with the following vote: Edmondson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Kaylor-Aye Ericson - Aye Mayor Ross - Aye PRESENTATION-PUBLIC Chris Sandie, Director of Public Works, presented the Public Works WORKS ANNUAL REPORT Annual Report for 2018. A copy of the Annual Report is attached to these Minutes and incorporated herein.
