CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING JULY 19, 2021 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, July 19, 2021, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street., Blue Springs, Missouri with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER pledge of allegiance. CONSENT AGENDA Councilmember Culpepper moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Edmondson. • Minutes of the July 7, 2021 City Council Meeting • Resolution No. 47-2021 approving a purchase in the amount of $63,732.00 from Blue Springs Ford Sales, Inc. for a 2022 1 Ton Extended Cab 4x4 Chassis Cab with Service Body • Resolution No. 48-2021 approving a Change Order in the amount of $50,000.00 with Downey Construction, Inc. for Miscellaneous Concrete Repair/Construction • Resolution No. 49-2021 approving a purchase in the amount of $72,582.90 from FARO Technologies, Inc. for the purchase of a FARO 3D Scanner • Liquor License for Osver LLC dba La Fuente Mexican Street located at 1512 NW Woods Chapel Road, Blue Springs, MO 64015, to sell intoxicating liquors by the drink, on the premises; or in original package for consumption on or off premises to include Sunday selling of intoxicating liquors by the drink, on the premises; or in original package for consumption on or off premises • Resolution No. 50-2021 approving an amendment to contract 2020-120.1 A with OATS, Incorporated to increase the total amount by $18,600, for a total of $54,000 for hot meal transportation service from Vesper Hall to homebound meal recipients • Resolution No. 51-2021 approving a contract with Prime Healthcare Services- Blue Springs, LLC dba St. Mary's Medical Center for the loan and placement of public art entitled "Fire, Earth & Water" The above Consent Agenda items were approved with the following vote: July 19, 2021 City Council Minutes Page 2 Kaylor-Aye Ericson - Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye VISITORS Evelyn Ericson addressed Council regarding Resolution No. 52-2021 on the agenda for consideration. PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider annexing property ANNEXATION OF (approximately 4.48 +/- acres) located at the southeast corner of the PROPERTY LOCATED AT intersection of NE Colbern Rd and SW Highway 7 into the City limits NE COLBERN ROAD AND (ANNX-06-21-7840) at 6:04 p.m. The minutes of the public hearing SW7 HIGHWAY were recorded by a certified court reporter. City Clerk Sheryl Morgan (ANNX-06-21-7840) entered one exhibit into the record. STAFF REPORT Community Development Director Mike Mallon reviewed the details of the proposed annexation. IN OPPOSITION TO Nathan Day of the law firm of Bushyhead, LLC spoke in opposition to the annexation. The Mayor hearing no further comments for or against, closed the public hearing at 6:10 p.m. INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4877 approving an READING - BILL NO. 4877 annexation of property (approximately 4.48 +/- acres) located at the -ANNEXATION OF southeast corner of the intersection of NE Colbern Rd and SW PROPERTY LOCATED AT Highway 7 into the City limits (ANNX-06-21-7840). City Clerk Sheryl NE COLBERN ROAD AND Morgan made the first reading of Bill No. 4877 by title; copies of the SW7 HIGHWAY (ANNX-06-21-7840) proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4877 upon its first reading and proceed with the second reading on August 2, 2021. Motion seconded by Councilmember Lievsay and carried unanimously. INTRODUCTION AND 1 ST Councilmember Culpepper introduced Bill No. 4878 amending READING - BILL NO. 4878 Chapter 500 Building Codes, Sections 500.010, 500.020, 500.090, - AMEND CHAPTER 500 and 500.100 of the Code of Ordinances, City of Blue Springs, OF THE CODE OF Missouri, to adopt International Building Codes and make exceptions ORDINANCES TO ADOPT thereto and to amend the application provisions. City Clerk Sheryl INTERNATIONAL BUILDING CODES Morgan made the first reading of Bill No. 4878 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4878 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4878 by title. 48.78 Councilmember Fowler moved to adopt Bill No. 4878 upon its second reading and give it ORDINANCE NO. 5021, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: July 19, 2021 City Council Minutes Page 3 Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Mayor Ross -Aye PRESENTATION - BLUE Dr. Bob Jerome, Superintendent of Schools of the Reorganized SPRINGS SCHOOL School District No. 4 of Jackson County, Missouri (Blue Springs DISTRICT School District), presented information on the two Questions on the August 3, 2021 Special Election ballot relating to the School District. RESOLUTION NO. 52-2021 Mayor Ross and Councilmember Culpepper made statements regarding the proposed Resolution. Councilmember Culpepper moved to adopt Resolution No. 52-2021 directing staff to initiate steps necessary to implement the LAGERS L- 6 2% employee contributory plan effective October 1, 2021, amend the General Fund Reserve Policy, and appropriate $3 million from General Fund unassigned fund balance to the Pavement Management program ST-06 in the FY 2021-22 budget. Motion seconded by Councilmember Edmondson. MOTION TO DIVIDE THE Council member Ericson moved to Divide the Question to consider and QUESTION- vote on Items 1-5 and Item 6 of Resolution No. 52-2021 separately. RESOLUTION NO. 52-2021 Motion seconded by Councilmember Fowler and, after Council discussion, failed with a vote of 2-5 as follows: Fowler-Aye Culpepper - No Ericson - Aye Kaylor- No Edmondson - No Lievsay- No Mayor Ross - No COUNCIL DISCUSSION Slides presented by Council member Fowler during Council discussion are attached to these Minutes and incorporated herein. RESOLUTION NO. 52-2021, After Council discussion, Resolution No. 52-201, as originally AS PRESENTED presented, carried with a vote of 5-1 as follows: Ericson - Abstained Kaylor-Aye Edmondson - Aye Lievsay - Aye Culpepper - Aye Fowler- No Mayor Ross - Aye MAYORAL Though~toPonde~ ANNOUNCEMENTS "Never, ever, ever, ever, ever give up." ( Winston Churchill) CLOSED SESSION At 6:45 p.m., Councilmember Kaylor moved for the Council go into closed session pursuant to Section 610.021 (9) Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to negotiations with employee groups, and that any minutes, documents and other records discussed or taken during the closed session July 19, 2021 City Council Minutes Page 4 remain closed, and that the special meeting of this body stand adjourned at the completion of such session.
