CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING AUGUST 2, 2021 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, August 2, 2021, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street., Blue Springs, Missouri with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, City Attorney Jacqueline Sommer, and Deputy City Clerk Julia Porter. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER pledge of allegiance. CONSENT AGENDA Councilmember Edmondson moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Ericson. • Minutes of the July 19, 2021 City Council Meeting • Resolution No. 54-2021 approving the disposition of Information Technology department records which have met the required retention period as prescribed by the Blue Springs Records Retention, Management, and Destruction Policy dated November 28, 2016 and in accordance with the Missouri Secretary of State's records retention guidelines • Resolution No. 55-2021 approving a purchase in the amount of $717,739.78 from Motorola Solutions, Inc. for new portable radios and encryption upgrades to mobile radios as part of Capital Improvement Plan #PS-09-19 • Resolution No. 56-2021 entering into a contract in the amount of $173,358.00 with Blue Springs R-IV School District for police officers at BSSD schools and dispatching services for the 2021- 2022 school year • Resolution No. 57-2021 approving a contract in the amount of $273,144 with Vance Brothers, Inc. for 2021 Micro Surfacing The above Consent Agenda items were approved with the following vote: Kaylor-Aye Ericson - Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye VISITORS Scott Casey, Shelby Norman, Zoe Dunning, and Zachary Mallory addressed Council requesting a ban on conversion therapy within the City limits. August 2, 2021 City Council Minutes Page 2 PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider a approval of the 2021-22 CDBG ANNUAL 2021-2022 Community Development Block Grant Annual Action Plan ACTION PLAN at 6:09 p.m. The minutes of the public hearing were recorded by a certified court reporter. Deputy City Clerk Julia Porter entered one exhibit into the record. STAFF REPORT Assistant Community Development Director Matt Wright reviewed the details of the 2021-2022 Community Development Block Grant Annual Action Plan and addressed questions from Council. The Mayor hearing no further comments for or against, closed the public hearing at 6:16 p.m. RESOLUTION 58-2021 Councilmember Edmondson moved to adopt Resolution No. 58-2021 approving the 2021-2022 Community Development Block Grant Annual Action Plan. Motion seconded by Councilmember Culpepper and carried unanimously. PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider a General GENERAL DEVELOPMENT Development Plan for the development of a 2,618-sf. Mo' Bettahs PLAN FOR MO' BETTAHS restaurant with a drive-thru on a 0.67 +/- acre property at 806 NW 7 RESTAURANT Highway (GDP-06-21-7846) at 6:17 p.m. The minutes of the public (GDP-06-21-7846) hearing were recorded by a certified court reporter. Deputy City Clerk Julia Porter entered one exhibit into the record. STAFF REPORT Associate Planner Shana Kelly reviewed the details of the proposed General Development Plan and addressed questions from Council. APPLICANT Lynsi Neve with Savory Development LLC FBO Mo' Bettahs addressed questions from Council. The Mayor hearing no further comments for or against, closed the public hearing at 6:29 p.m. INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4879 approving a READING - BILL NO. 4879 General Development Plan for the development of a 2,618-sf. Mo' -GENERAL Bettahs restaurant with a drive-thru on a 0.67 +/- acre property at 806 DEVELOPMENT PLAN NW 7 Highway (GDP-06-21-7846). Deputy City Clerk Julia Porter FOR MO' BETTAHS made the first reading of Bill No. 4879 by title; copies of the proposed RESTAURANT (GDP-06-21-7846) Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4879 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Ericson and carried unanimously. 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4879 by title. 4879 Councilmember Fowler moved to adopt Bill No. 4879 upon its second reading and give it ORDINANCE NO. 5022, with a copy attached hereto and made a part of the minutes. Deputy PLAT- FINAL PLAT (PF- City Clerk Julia Porter made the first reading of Bill No. 4880 by title; 06-21-7790) copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4880 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Edmondson and carried unanimously. COUNCIL DISCUSSION 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4880 by title. 4880 Councilmember Fowler moved to adopt Bill No. 4880 upon its second reading and give it ORDINANCE NO. 5023, with a copy attached hereto and made a part of the minutes. Deputy City Clerk Julia Porter made the first reading of Bill PLAT, LOT A No. 4881 by title; copies of the proposed Bill having previously been "WHATABURGER" (PF-04-21-7743) made available to the public. Councilmember Fowler moved to approve Bill No. 4881 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Lievsay and carried unanimously. 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4881 by title. 4881 Councilmember Fowler moved to adopt Bill No. 4881 upon its second reading and give it ORDINANCE NO. 5024, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Lievsay and carried with the following vote: Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Mayor Ross - Aye 2ND READING - BILL NO. Deputy City Clerk Julia Porter made the second reading of Bill No. 4877 4877 annexing property (approximately 4.48 +/- acres) located at the southeast corner of the intersection of NE Colbern Rd and SW Highway 7 into the City limits (ANNX-06-21-7840). The public hearing and first reading of Bill No. 4877 were held on July 19, 2021. August 2, 2021 City Council Minutes Page 4 Councilmember Fowler moved to adopt Bill No. 4877 upon its second reading and give it ORDINANCE NO. 5025, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Culpepper and carried with the following vote: Edmondson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Kaylor-Aye Ericson - Aye Mayor Ross - Aye PRESENTATION - HUMAN Dr. Warren Haynes, Chair of the Human Relations Commission Task RELATIONS COMISSION Force, presented the Task Force's findings, recommendations for TASK FORCE Code amendments, and items for Council consideration. A copy of the PowerPoint presentation is attached to these Minutes and incorporated herein. MOTION DIRECTING Councilmember Culpepper moved to direct the City Attorney to draft STAFF TO DRAFT CODE a Bill amending Article VIII Human Relations Commission of the Blue AMENDMENT RELATING Springs Municipal Code of Ordinances. Motion seconded by TO HUMAN RELATIONS Councilmember Edmondson and carried unanimously. COMMISSION INTRODUCTION AND 1ST Councilmember Ericson introduced Bill No. 4882 amending Chapter READING - BILL NO. 4882 620 Massage Therapists and Massage Facilities of the Code of - AMEND CHAPTER 620 Ordinances, City of Blue Springs, Missouri. Deputy City Clerk Julia OF THE CODE OF Porter made the first reading of Bill No. 4882 by title; copies of the ORDINANCES RELATING proposed Bill having previously been made available to the public. TO MASSAGE THERAPISTS AND MASSAGE FACILITIES Councilmember Fowler moved to approve Bill No. 4882 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Culpepper and carried unanimously. COUNCIL DISCUSSION 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4882 by title. 4882 Councilmember Fowler moved to adopt Bill No. 4882 upon its second reading and give it ORDINANCE NO. 5026, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Lievsay and carried with the following vote: Culpepper - Aye Fowler-Aye Kaylor-Aye Ericson - Aye Lievsay - Aye Edmondson - Aye Mayor Ross -Aye INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4883 amending the READING - BILL NO. 4883 2020-21 annual budget increasing the previously adopted and - FY 2020-21 BUDGET amended budget of $74,259,787 by $2,129,332 to 76,389,119. AMENDMENT Deputy City Clerk Julia Porter made the first reading of Bill No. 4883 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4883 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Culpepper and carried unanimously.
