CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING May 19, 2025 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, May 5, 2025, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street, Blue Springs, Missouri with Mayor Chris Lievsay presiding. CALL MEETING TO At 5:00 p.m. Mayor Lievsay called the meeting to order. ORDER CLOSED SESSION Councilmember Brummel moved for the Council to go into closed session pursuant to Section 610.021 (3) and (13) Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to personnel, and that any minutes, documents and other records discussed or taken during the closed session remain closed, and that the regular meeting of this body reopen at 6:00 p.m. Motion seconded by Councilmember Tholen and carried with the following votes: Kaylor-Aye Ericson- Aye Tholen-Aye Edmondson - Aye Brummel - Aye Rowan -Absent Mayor Lievsay - Aye COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Katie Tholen Kent Edmondson Nick Brummel Jeremy Rowan Also present were City Administrator Christine Cates, City Attorney Jennifer Baird, and Deputy City Clerk Megan Rodgers. INVOCATION AND Mayor Lievsay led in the pledge of allegiance. PLEDGE CALL MEETING TO Mayor Lievsay called the open session of the City Council meeting to ORDER AND order at 6:01 p.m. The Deputy City Clerk confirmed a quorum of the CONFIRMATION OF Council was present. QUORUM CONSENT AGENDA Councilmember Ericson moved to approve the Consent Agenda and the motion was seconded by Councilmember Brummel. • Minutes of the May 5, 2025 City Council Meeting and May 7, 2025 City Council Strategic Planning Session. • Resolution No. 33-2025 approving a contract in the amount of $107,479 with Progressive Electronics, Inc. for the replacement of the existing Fieldhouse fire alarm system to connect with the Blue Surf Bay fire alarm system. • Resolution No. 34-2025 approving Task Order #14 to Contract No. 2024-166 with SC Engineering, LLC, dba Cochran for Contract  May 19, 2025 City Council Minutes Page 2 Management Services for the Sni-A-Bar Wastewater Treatment Facility. • Resolution No. 35-2025 approving a contract in the amount of $294,100.00 with Stantec Consulting Services Inc. for schematic design architectural services for the construction of Southwest Park, CIP PR-71. • Board and Commission Appointments Community Development Block Grant Advisory Committee: Reappoint: Susan Stokenbury, Planning Commission Rep. Ken Horrell, Park Commission Rep Jaime Russell, Downtown Review Board Rep Lyle Shaver, Downtown Alive! Rep Jaime Russell, Vice Chair Ken Horrell, Chair The Consent Agenda was approved with the following vote: Kaylor-Aye Ericson- Aye Tholen-Aye Edmondson - Aye Brummel - Aye Rowan-Aye Mayor Lievsay - Aye ITEM 3d - RESOLUTION Councilmember Ericson requested Item 3d - Resolution No. 35-2025 35-2025 SOUTHWEST approving a contract in the amount of $294,100.00 with Stantec PARK DESIGN Consulting Services Inc. for schematic design architectural services for SERVICES the construction of Southwest Park, CIP PR-71, be pulled from the Consent Agenda for separate discussion and vote. Councilmember Ericson moved to approve Item 3d - Resolution 35- 2025. Motion seconded by Councilmember Kaylor and carried unanimously. PRESENTATION - Mayor Lievsay and Council recognized Blue Springs School District PROCLAMATIONS FOR Speech and Debate Teams and gave special recognition to the following BLUE SPRINGS SCHOOL State Champions: Diedra Pierre for Dramatic Interpretation, Marin Heide DISTRICT SPEECH for Original Oratory, and Coby Garcia for Storytelling. TEAMS PUBLIC HEARING - Mayor Lievsay opened the Public Hearing to consider amendments to UNIFIED DEVELOPMENT the Unified Development Code related to the definition of body art CODE AMENDMENT services at 6:12 p.m. (UDCT-04-25-9553). The minutes of the public RELATED TO BODY ART hearing were recorded by a certified court reporter. Deputy City Clerk SERVICES Megan Rodgers entered one exhibit into the record. (UDCT-04-25-9553) STAFF REPORT Senior Director of City Development Mike Mallon reviewed the details of the proposed Unified Development Code amendments and addressed questions from the Council. Deputy City Clerk Megan Rodgers made the first reading of Bill DEVELOPMENT CODE No. 5315 by title; copies of the proposed Bill having previously been AMENDMENT made available to the public. REGARDING BODY ART SERVICES Councilmember Edmondson moved to approve Bill No. 5315 upon its (UDCT-04-25-9553) first reading and proceed with the second reading. Motion seconded by Councilmember Tholen and carried with Councilmember Ericson voting no. 2ND READING - BILL Ms. Rodgers made the second reading of Bill No. 5315 by title. NO. 5315 Councilmember Edmondson moved to adopt Bill No. 5315 upon its second reading and give it ORDINANCE NO. 5418, with a copy attached hereto and made a part of the minutes. The (CUP-04-25-9533) minutes of the public hearing were recorded by a certified court reporter. Deputy City Clerk Megan Rodgers entered one exhibit into the record. STAFF REPORT Associate Planner Shantele Frie reviewed the details of the proposed Conditional Use Permit and addressed questions from the Council. APPLICANT Applicant Brittany Manney was present and addressed questions from the Council. INTRODUCTION AND Councilmember Edmondson introduced Bill No. 5317 approving a a 1ST READING - BILL NO. contract with the Blue Springs R-IV School District for police officers at 5317 - CONTRACT WITH Blue Springs School District High Schools and dispatching services for BLUE SPRINGS R-IV the 2025-2026 school year. DISPATCHING SERVICES Councilmember Ericson moved to approve Bill No. 5317 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Tholen. MOTION TO ADD Councilmember Ericson moved that an Ordinance prepared by staff be BACKYARD HENS TO placed on the next possible upcoming election ballot and that staff make THE NEXT ELECTION any necessary adjustments to make sure the Ordinance conforms to all BALLOT ballot language requirements and to allow 60 days for Council discussion or change of ballot language. Motion seconded by Councilmember Kaylor. Motion failed with the following vote: Edmondson - No Tholen - No Rowan -No Brummel - No Kaylor-Aye Ericson - Aye Mayor Lievsay - No MOTION TO AMEND BILL Councilmember Brummel moved to amend Bill No. 5318 and Senior 5318 Director of City Development Mike Mallon outlined the proposed amendments to Section 215.127 Regulation of Backyard Hens: • P.1 Permit Required - amended to remove the requirement for an annual permit, remove references to specific City departments and replace with "the City" and add language regarding permits being valid in perpetuity if continued compliance is demonstrated • P.2 Applications - amended to remove non-refundable fee • P.3 Conditions for Approval - amended to remove section title, remove requirement for evidence, remove evaluation requirements and remove letters i-I • P.4 Permit Fee - remove section four (requirement for permit fees) A copy of the redlined Amended Bill 5318 with all proposed changes is attached to these Minutes and incorporated herein. Deputy City Clerk Megan Rodgers made the AMENDMENT first reading of Bill No. 5319 by title; copies of the proposed Bill having REGARDING previously been made available to the public. COMMERCIAL VEHICLES MOTION TO CONTINUE Councilmember Edmondson moved to continue Bill 5319 to the June 16, 2025 City Council meeting. Motion seconded by Councilm ember Tholen and carried with Councilmember Ericson voting no . COUNCIL COMMENTS Councilmember Ericson recognized his 52 nd wedding anniversary to wife Evelyn on May 19, 2025. MAYORAL • Recogn ized Public Works week and extended appreciation to ANNOUNCEMENTS staff for hard work and dedication • Blue Surf Bay opens May 23, 2025 at noon • Memorial Day is Monday, May 26, 2025 • Bite of Blue Springs food trucks will be in Downtown Blue Spring s on May 24, 2025 and on fourth Saturdays throughout the summer.
