Brown Public Safety Building, located at 1100 SW Smith Street, Blue Springs. CONSENT AGENDA APPROVAL Chairperson Byron Craddolph requested action on the Consent Agenda with a motion by Commissioner Mitchell Peil a second from Commissioner Susan Stokenbury and a unanimous vote, the minutes of December 12, 2022, were approved. PC Minutes 12.27.2022 AK Page 1 of 9 AGENDA ITEM 2 / PUBLIC HEARING / The public hearing for Agenda Item 2 was opened at 6:31 p.m. with a request for CONDITIONAL USE exhibits from the City Attorney, Sarah Carnes introduced Exhibits 1 through 8 into the PERMIT / CUP-12-22-8553 public record on behalf of the applicant. / “Mel-Row Place” / 2131 Exhibits: NW 7 Highway 1. Staff Report with attachments 2. Applicant Plans with attachments & 3. Affidavit of Publication in The Examiner on December 10, 2022 4. 185 ft. Notification Map AGENDA ITEM 3 5. Mike Mallon, Director, presented the request to the Planning Commission. Commissioner Peil questions the location of where the stormwater runoff will go. QUESTIONS Mr. Mallon states there is an existing drainage way to the north of the property as well as an existing detention pond to the west. Jim Burges, City Engineer, states Mr. Mallon’s statement is correct. Commissioner Peil questions if Staff has spoke to the applicant about the storage of hazardous materials. Mr. Mallon states the storage will be looked at the building permit stage. Commissioner Stokenbury questions how long the site has been vacant. Mr. Mallon states he is not completely sure, but he does believe at least five years. APPLICANT Anthony Melton, 30210 E Hanna Road, Buckner, MO. Mr. Melton states for transparency he will be adding six feet to the back of the building to allow room for tools and passageway. Commissioner Peil questions if the existing car wash drains will be capped. Mr. Melton states yes, the drains will be capped, graveled and concreted over. WITNESSES None. IN FAVOR WITNESSES None. COMMENT Commissioner Billups thanks the applicant for coming to Blue Springs and using an existing empty building. PUBLIC HEARING The Public Hearing closed at 6:45 p.m. CLOSED MOTION Commissioner Peil moved to approve Conditional Use Permit / CUP-12-22-8553 / CONDITIONAL USE “Mel-Row Place” / 2131 NW 7 Highway with five staff conditions. Approval based on the representations of any drawings presented as part of this application does not waive any requirements or development standard STAFF CONDITIONS contained in the UDC unless otherwise specified by the Alternative Development Standards. 2. The Conditional Use Permit allows the “Vehicle Repair (Limited)” use in a “GB (General Business District) zoning district at 2131 NW 7 Highway. 3. All conditions adopt under the Unified Development Code for a vehicle repair, limited, establishment shall be met at all times. 4. No exterior storage of parts inventory or equipment is permitted. 5. No exterior loudspeakers may be installed, and all exterior doors and bays shall remain closed if any interior speaker is in use and audible from an abutting residential property. Approval of the Preliminary Plat is not in effect until the City Council has approved the Conditional Use Permit (CUP-12-22-8553). Approval of the Preliminary Plat is rescinded if the Conditional Use Permit is denied by the City Council. REVIEW / SPDR-12-22- 8556 / “Snak Atak” / 8251 Adair Bright, Associate Planner, presented the request to the Planning Commission. SW 6th Street QUESTIONS Commissioner Billups Jr. questions the building orientation. Ms. Bright states the orientation reflects the same as the entrances and building being addressed off SW 6th Street. APPLICANT Dana Blay, DBL Architecture, 8031 Wenonga Road, Leawood, KS. QUESTIONS Mr. Blay states when this idea was first brought to him, he was not sure how it was going to be achieved with all the easements. Through some wrangling and calculations, Mr. Blay achieved success and the building orientation is as such due to the easements and lot. Mr. Blay states originally the project had EV charging stations, but Evergy denied such request in the easement. Mr. Blay describes the building as attractive and states it will be nice to have in the neighborhood. PC Minutes 12.27.2022 AK Page 4 of 9 Commissioner Sanderson questions about the traffic signal. Mr. Blay states the traffic signal is required because a building is being put in. WITNESSES None. IN FAVOR WITNESSES None. QUESTION Commissioner Billups thanks the applicant for coming to Blue Springs and the project will be a nice additive to that part of the City. Reduce the minimum side setback from 20-ft. to 11.375-ft. 2. The Conditional Use Permit allows the “Service Station, general (7 to 16 pumps)” use in the “GB” (General Business) zoning district at 8251 SW 6th Street. Approval by the Planning Commission based on the representations of any STAFF CONDITIONS drawings presented as part of this application does not waive any requirement or development standard contained in the UDC, unless otherwise specified by the Alternative Development Standards. A. Decrease the minimum lot width from 65-ft. min. to 55-ft. min. 2. Prior to the issuance of a building permit, the developer must provide documentation of the vehicle charging stations being allowed in the Overhead Powerline Easement. 3. The photometric plan must meet all UDC requirements and will be reviewed during the building permit process along with the pole height and degree of cutoff. 4. The following must occur prior to the issuance of a Certificate of Occupancy: A. Landscaping shall be installed and pass a final inspection or financially guaranteed. B. The 5-ft. ADA compliant sidewalks shall be installed and pass a final inspection AGENDA ITEM 6 FINAL PLAT / PF-12-22- 8557 / “Willow Creek Shana Kelly, Associate Planner, presented the request to the Planning Commission. Estates” / Parcel# 41-530-01- 99-01-0-00-000 PC Minutes 12.27.2022 AK Page 6 of 9 QUESTIONS Commissioner Peil questions who is paying for the water and sewer main extensions. Ms. Kelly states the property owner will be paying for the infrastructure improvements. APPLICANT Not present. DISCUSSION Commissioner Peil states usually when the applicant is absent the case is continued to allow the applicant to present and suggest we go forward with the project, as the Commission has seen this project previously. Mr. Mallon agrees. MOTION FINAL PLAT / PF-12-22- 8557 / “Willow Creek Estates” / Parcel# 41-530-01- Commissioner Peil moved to approve Final Plat / PF-12-22-8557 / “Willow Creek 99-01-0-00-000 Estates” / Parcel# 41-530-01-99-01-0-00-000 with five staff conditions. SECOND Commissioner Stokenbury seconded. STAFF CONDITIONS 1. Approval by the Planning Commission based on the representations of any drawings presented as part of this application does not waive any requirement or development standard contained in the UDC. 2. Driveway and sewer easements shall be recorded prior to the recording of the Final Plat and the Instrument Numbers shall be included on the Final Plat. 3. Prior to building permit issuance, the Final Plat must be recorded with Jackson County and returned to the City. 4. Prior to Occupancy, the site must pass a Landscape Inspection, which will require a total of 45 Plant Units (PUs). Existing PU’s can be counted towards this total. 5. Construction of the required sewer and water infrastructure must be completed and pass inspection prior to Occupancy. PC Minutes 12.27.2022 AK Page 7 of 9 OTHER BUSINESS The next scheduled meeting is Monday, January 9, 2023. Chairperson Craddolph presented Commissioner Mitchell Peil with a plaque thanking him for his service to the Planning Commission for the last seven years. Commissioner Peil will be missed, but we all wish him well in his future endeavors. Mike Mallon states Planning Commission meetings will be moving to Tuesday nights starting with the March 14, 2023, meeting. This change is to help accommodate the City Council and allow them to meet more frequently in work sessions or planning sessions.
