Council of the Town of Brentwood Town Hall, Brentwood, Maryland Council Meeting Hearing of the Mayor and Council of Brentwood Date: March 30, 2016 Council: X Vice Mayor Jeffrey Clark X Council Member Tonya Harrison X Council Member Regina Morlan X Council Member Victor Olano X Mayor Rocio Treminio-Lopez Town Staff: X Reginald Bagley, Town Administrator X Magdalena Rojas, Town Clerk X Martha Nichols, Code Enforcement Officer Mayor Treminio-Lopez called the meeting to order at 7:05 pm _________________________________________________________________________________ APPROVAL OF AGENDA: Motion by Vice Mayor Clark to approve the agenda, second by Council Member Harrison. Approved by voice vote all in favor. Code Enforcement Dr. Vehery has asked for a hearing to speak about the fence that was built next to her home without a Town Permit. Dr. Vehery believes that her neighbor is building on her property and the Town is concerned that the fence was completed without a permit as well as the fence currently has the good side facing in, regulation states that the good side must facing out. The fence faces in because Dr. Vehery would not allow the builders to come into her property no matter what and in order to have the fence facing out they would have to have had gone onto the neighbor’s driveway. Another concern from the code enforcement office is that this house is being fixed to be re-sold and this issue if not resolved will still be an issue with the new owners. Stop work order was placed on the fence construction as soon as it was known that the fence was being built but there was a violation because they did not actually stop. The violation is the only thing that the Town can handle not the work itself or the plot plans. PUBLIC INPUT / COMMENTS: COMMENT: Dr. Vechery, Tilden Street Concerned that the fence comes into the property line by 8 inches, by the end of her driveway. Also the tree line is now on her side of the property, and is concern about being made responsible for caring for these trees since they are still in her neighbor’s property. She has attempted to talk to the homeowner and the realtor but did not have successful communication. 1 Council of the Town of Brentwood Town Hall, Brentwood, Maryland Council Meeting RESPONSE: Council Member Olano, states that the best way to handle this is for the homeowners to communicate. Mayor suggests that if no resolution can be found that the County Code Enforcement should be contacted so they can come and look. COMMENT: Rubens Josefino, Tilden Street He is the owner, and he is also the owner of the construction company Josefino homes that did the building of the fence. The workers measured twice and have not done anything wrong, he is willing to work with the county if need be. RESPONSE: Council Member Morlan asked why he didn’t stop once the stop work order was given, he mentioned he didn’t know but is willing to pay any fine. The Town will reach out to the County to try to help the homeowners resolve the issue. Meeting adjourned at 7:32pm Motion to adjourn the hearing and go into the Special meeting by Council Member Harrison seconded by Council Member Morlan. Approved by voice vote, all in favor.
