Village Board of Trustees Regular Meeting September 2, 2025 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 2nd of September, 2025 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee via Zoom Also Present Josh Ringel, Village Manager Christine Dennett, Village Clerk/Assistant Village Manager Josh Subin, Village Attorney Kevin Leddy, Village Engineer via Zoom Absent Malcolm Netburn, Trustee Pledge of Allegiance Swearing in and Appointment of a Police Officer Chief Bueti stated he highly recommended Officer Denis who would be coming to the Village with four years of experience and deep ties to the community. He stated Officer Denis had specialized training and was also Spanish speaking. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that Fernando Denis of Katonah, New York is hereby appointed, effective September 3, 2025, to the position of Police Officer Grade 4 to be paid at an annual salary of $102,564.96 as per the Village of Briarcliff Manor PBA Collective Bargaining Agreement salary scale effective June 1, 2025. BE IT FURTHER RESOLVED that the Village Manager will undertake the necessary administrative steps to get Officer Denis appointed. Mayor Vescio swore in Officer Denis and congratulated him along with the Board. Continued Public Hearing to Amend Chapter 220-2, Definitions and 220-10, Affordable Housing 1 Deputy Mayor Chatzky explained the proposed legislation. The Board had general discussion regarding the comments submitted by the County and stated other communities had similar provisions in their existing laws. Trustee Mallett and Village Attorney Subin stated they’d add some further language into the draft and would circulate it. There were no public comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to adjourn the public hearing to September 16, 2025. Public Hearing Chapter 186-7, Streets and Sidewalks, Protection of Existing Facilities Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to open the public hearing. Deputy Mayor Chatzky explained the proposed legislation. The Board requested the Village Manager send the draft law to all utility companies that operate in the Village for their review. There was no public comment. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to adjourn the public hearing to October 7, 2025. Public Hearing Chapter 178, Solar and Alternative Energy, Article II, Battery Energy Storage Systems Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to open the public hearing. Deputy Mayor Chatzky explained the proposed legislation. The Board thanked the BESS Committee and the Village Engineer, Kevin Leddy for their hard work and recommendations. The Board had general discussions on the different tiers of systems. Mayor Vescio stated he was not in favor of Tier II systems. Mr. Sal Maglietta of Schrade Road and Holbrook Road stated he strongly opposed BESS in the Village. 2 Mr. Michael Mezzacappa of 3 Shadowbrook Lane stated Tier I systems were controllable but the others were not. He stated he handled fire injury cases and people don’t understand the severity and toxicity of them. He further stated the technology wasn’t there and there was no safe setback in the Village for them. Village Engineer Leddy reviewed the proposed local law. The Board stated they would revise the local law to not allow for Tier II systems. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to adjourn the public hearing to October 7, 2025. Board of Trustees Announcements  Community Day is scheduled for September 6th.  The Comprehensive Plan Committee will have a table at Community Day. Village Manager’s Report  Community Day may be postponed due to weather related impacts. It will be decided by noon on Friday. An ice cream truck will be in the Central Business District and a vine squad will assist with removing invasive species as part of the day’s events.  The Library is closing on September 15th through October 1st to allow for their temporary move to 555 Pleasantville Road to take place. Committee Report  No report. Public Comments Mr. Sal Maglietta of Schrade Road and Holbrook Road stated a subsidiary of YSG was one of the company’s that had their license to do business revoked by the Public Service Commission. DTS Provident Design Engineering, LLP Parking Utilization Study Presentation Mr. Brian Dempsey of DTS Provident Design Engineering, LLP gave a presentation on the parking study. Ms. Sarah Yackel, Village Planning Consultant, reviewed her memorandum. The Board had general discussion regarding the study and memorandum and requested parking time limits be reviewed. Schedule Public Hearing to Add Chapter 10, Auditor, Office of Village Manager Ringel explained the draft legislation. 3 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to adopt the following resolution as amended: BE IT RESOLVED that a Public Hearing is hereby scheduled for the September 16, 2025 Board of Trustees meeting at 7:30pm at the William J. Vescio Community Center located at 1 Library Road, Briarcliff Manor, New York to hear and discuss a proposed local law to add a new Chapter 10, Auditor’s Office to the Code of the Village of Briarcliff Manor. Roll Call: Trustee Hunt Aye Trustee Mallett Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Schedule Public Hearing Proposed Franchise Renewal Agreement with Cablevision of Wappingers Falls, Inc. Trustee Hunt gave a brief overview of the proposed contract terms. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adopt the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the September 16, 2025 Board of Trustees meeting at 7:30pm at the William J. Vescio Community Center located at 1 Library Road, Briarcliff Manor, New York for all interested persons to be heard in favor of or in opposition to the proposed renewal of the Cablevision of Wappingers Falls, Inc. franchise for a period of 5 years. Award of Bid – VM2324-7 Chappaqua Road – Route 100 Water Main Replacement Village Manager Ringel explained two to three very expensive water main breaks occurred in this area necessitating the main replacement. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to adopt the following resolution: WHEREAS the Village received 2 bids for the Chappaqua Road – Route 100 Water Main Replacement Project (VM2324-7); and NOW, THEREFORE, BE IT RESOLVED that the bid for the Chappaqua Road – Route 100 Water Main Replacement Project (VM2324-7) is hereby awarded to Aqua Works, Inc per their bid of $485,213 from budget code H8397.201.25481; and 4 BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with Aqua Works, Inc for said project.
