TOWN COUNCIL REGULAR MEETING Thursday, December 19, 2024 at 7:00 PM Council Chamber Bristol Municipal Complex MINUTES CALL MEETING TO ORDER Council President Jeff Beachy called the regular Council meeting to order at 7:17pm PLEDGE OF ALLEGIANCE led by Alex Bowman ROLL CALL Members present: Cathy Burke, Gregg Tuholski, Jeff Beachy Absent: Dean Rentfrow, Doug DeSmith Other members in attendance: Legal Counsel Alex Bowman, Town Marshal Steve Priem, Clerk- Treasurer Cathy Antonelli, Fire Chief Nik Kantz, Town Manager Mike Yoder APPROVAL OF AGENDA stands as published APPROVAL OF INVOICES  Motion to approve the invoices made by Gregg Tuholski, Seconded by Cathy Burke. Voting Yea: Gregg Tuholski, Jeff Beachy. Motion carries. APPROVAL OF MINUTES – no minutes to approve this evening REPORTS Morgan Barger with Spend Bridge joining us via Zoom. Cathy Antonelli started a discussion about the Spend Bridge system It would help to streamline the purchasing process and sets up better pricing with vendors. Approved by State Board of Accounts. Annual cost $6K, implementation fee $5K, cloud based.  Motion to approve the Spend Bridge software made by Gregg Tuholski. Brief discussion and motion modified by Gregg Tuholski to move forward with the Spend Bridge agreement per legal review, Second by Cathy Burke. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. Approval of 2024-2 CCMG INDOT agreement Docu sign agreement recommendation from Mike Yoder for Jeff to sign. 2024-2 Community Crossing Grant is for Twin River Trails and Elm Streets.  Motion to approve Jeff Beachy’s signing of the 2024-2 CCMG agreement made by Gregg Tuholski, Seconded by Cathy Burke. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. Crosby Construction Pay Application #4, corrected (SRF disb request #16)  Motion to approve as corrected SRF disbursement request #16 in the amount of $727,739.90 to contractor and $38,302.10 to retainage fund for a total payment of $766,042.00 made by Cathy Burke, Seconded by Gregg Tuholski. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries.  Motion to approve the Commonwealth Engineers SRF distribution Request #17 in the amount of $61,031 made by Cathy Burke, Seconded by Gregg Tuholski. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries.  Motion to approve Crosby Construction Pay App #5, SRF disbursement Request #18 in the amount of $742,157.01 (payment to the Contractor $705,049.16, amount to retainage $37,107.85) made by Gregg Tuholski, Seconded by Jeff Beachy. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. Change Order #2 Additional contract costs for Crosby, delays caused by removing sludge material and concrete costs incurred due to weather, a change in the driveway to the facility as well.  Motion to approve change order #2 for Crosby, additional contract costs $64,051.30 made by Cathy Burke, Seconded by Gregg Tuholski. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. 2025 Service agreement with Baker Tilly for TIF consulting work recommended by Mike Yoder for Council to sign.  Motion to approve the service agreement with Baker Tilly for TIF consulting work made by Jeff Beachy, Seconded by Gregg Tuholski. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. 2025 Service agreement with Baker Tilly for Town consulting services recommended by Mike Yoder for Council to sign.  Motion to approve the 2025 service agreement with Baker Tilly for Town consulting work made by Cathy Burke, Seconded by Jeff Beachy. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. Projects and other updates Corn Dog Festival changes – Monogram does not want their staff managing the festival. Not wanting to see the festival fade away, Bristol On The River (BOR)has picked up the management of the festival. Monogram for Kids will still support it monetarily. The focus will still remain as a fundraiser for The HUB. BOR has hired Jess Koscher, Write Connections to market and fundraise. BOR is the team of Ron Norman, Linda Powell, Rhonda Collins and one other resident. Working to get a signal at Stonemont and SR 120 - AM General planning to add 22 semis a day to that facility and it is part of our primary detour route. Residential housing seems to be the most interest in town. May include a Residential TIF. CLERK-TREASURER Cathy Antonelli  Motion to adopt the Amended Salary Ordinance No. 12-19-2024-29 to add a new officer made by Cathy Burke, Seconded by Gregg Tuholski. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. Request to amend the salary ordinance and employee handbook by adding language regarding Ghost employment. The idea that an employee of the town is receiving money for salary for work not done. For example, while working as a park employee, actually selling crafts instead.  Motion to add the language of ghost employment to the 2025 employee handbook made by Cathy Burke, Seconded by Gregg Tuholski. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. Legal Counsel noted that Indiana did away with Class D felony concept. Ghost employment is now a Level 6 felony. Cathy A to share with New Focus to update the language again. Marshal Priem spoke to compensatory pay for the officers as it relates to holiday pay and scheduling. Proposing to have the holiday days paid out in December to better budget for it and help with the scheduling. Discussion followed, including review of language changes surrounding vacation, personal leave, holidays for the police department. Motion tabled for further options and review.  Motion to approve the 2025 Salary Ordinance No. 12-19-2024-28 on second reading made by Gregg Tuholski, Seconded by Jeff Beachy. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. Resolution 12/19/2024-13 is for appointing commissioners to the Redevelopment Commission. These are one-year terms to begin January 1, 2025. By statute Town Council President appoints three members and a non-voting member (Jeff Bliler, who is in place until March, 2025) and the council members appoint two members. Council President Jeff Beachy appointed Gregg Tuholski, Cathy Burke and Doug DeSmith. Council members appoint Jeff Beachy and Dean Rentfrow.  Motion to approve Resolution No. 12.19.2024-13 A Resolution of the President of the Town Council and the Town Council of the Town of Bristol, Indiana for Appointments to the Bristol Redevelopment Commission made by Cathy Burke, Seconded by Gregg Tuholski. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. Note for the meeting minutes that the 2025 submitted budget was approved by DLGF. Request for the Annual Certification of Elected Officials to Sign the Town’s Anti-Nepotism Policy Invovling Direct Line Supervision to be signed.  Motion to pay year-end bills made by Cathy Burke, Seconded by Gregg Tuholski. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. TOWN MARSHAL Steve Priem Marshal Steve Priem reviewed the monthly operations and code enforcement reports Spoke to previously approved (8) taser purchases. Invoice received (8) $23,520 ($20LIT/and LIT training supplies) Request to purchase three new in-car video systems for the new police vehicles. Cost of three units is $33,690. This includes unlimited Cloud video storage, which is required by law to maintain for a specific time frame. Digital Ally is the vendor. Cost broken into a 5-year plan ($6,906 for the first year and $6,696 for each of the remaining years)  Motion to approve the purchase of (3) in-car video filing systems ($33,690) made by Gregg Tuholski, Seconded by Cathy Burke. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries.  Motion to approve the purchase of the (3) in-car radar units $6,390) made by Jeff Beachy, Seconded by Cathy Burke. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. FIRE CHIEF Nik Kantz Fire Chief Nik Kantz reviewed the monthly operations report. Staffing – short one fulltime firefighter/EMT and one fulltime firefighter/Paramedic The Tower 83 – passed the pump test on December 16th. Christmas tree lighting went well! The fire department appreciated being a part of the event. Toys for Tots – The parade delivery took place on Saturday, December 7. Tied with Osolo EMS this year, so agreement for Bristol to have the trophy for the first six months and Osolo for the second six months. BIG thanks to the community for helping with this project! Picture fundraiser – last picture day January 18, 2025. Donations still being accepted. Merry Christmas and Happy New Year to all! 2025 Agreement for Services by the Bristol Fire Department is in the amount of $920,114. This will be paid from the South and East TIF Funds.  Motion to approve the fire department contract $920,114 made by Jeff Beachy, Seconded by Cathy Burke. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries.  Motion amended by Jeff Beachy to approve pending legal review, Seconded by legal counsel. PARK BOARD  Motion to appoint Mikel Ropp to another term to the park board made by Gregg Tuholski, Seconded by Cathy Burke.Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. TOWN ATTORNEY Alex Bowman Second reading of Ordinance No. 12/19/2024-27 Off-Road Vehicles – Alex spoke to details of the Ordinance and the process to include a public hearing. Public Hearing opened at 9:03p. Hearing no public comment the hearing was closed at 9:03p  Motion to adopt on second reading Ordinance No. 12/19/2024-27 An Ordinance of the Town Council of the Town of Bristol, IN Authorizing Off-Road Vehicles on Highways Under the Jurisdiction of the Town of Bristol, IN and Imposing Requirements, Conditions, and Restrictions for Such made by Gregg Tuholski, Seconded by Cathy Burke. Voting Yea: Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. PRIVILEGE OF THE FLOOR (Public Comments to Council) Lester Otto, 18686 County Road 23 – Currently experiencing vibration at his home due to Valmont productions, this was not happening three weeks ago and it’s bad. Mike Yoder to follow up on that. TOWN COUNCIL DISCUSSION ITEMS Doug DeSmith - absent Dean Rentfrow - absent Cathy Burke -Thanks to Wendell for changing the bad streetlight. Gregg Tuholski – no comments this evening. Jeff Beachy – Shared thanks to everyone, lots of change and challenges, and many good things happening in the community. New police chief, new businesses in town, waste water treatment plant and water upgrades. Thanks to all for the work done in Town. Resident Maxine Foster thanked the Council for the work that they do.
