• MINUTES OF THE CITY OF BRISTOL, TENNESSEE CITY COUNCIL MEETING March 6, 2012 CALL TO ORDER: The City of Bristol, Tennessee City Council Meeting was called to order by Mayor David Shumaker on Tuesday, March 6, 2012, at 7:00 p.m. in the Slater Center Auditorium. ROLLCALL: Present: Mayor David Shumaker, Vice Mayor Joel Staton, Councilwoman Michelle Dolan, Councilwoman Margaret Feierabend, and Councilman Ben Zandi. Others Present: City Manager Jeff Broughton; City Attorney Jack Hyder; Secretary Terry Copenhaver-Horak; and members of City staff. INVOCATION AND PLEDGE OF ALLEGIANCE: Scout Master Chuck Williams of Cold Springs Presbyterian Church's Boy Scout Troop 107 gave the Invocation, and the YMCA Tech Girls, under the direction of Tammy Hinkle, led the Pledge • of Allegiance. AGENDA ADDITIONS AND/OR CHANGES: None. PROCLAMATIONS AND RECOGNITIONS: Citizens Municipal Academy - City Manager Broughton spoke of the Citizens Municipal Academy. He congratulated the graduates while Mayor Shumaker and Community Relations Director Terry Talbert presented certificates to the 2012 graduates. Graduates from the program included David Akard III, Nancy Cook, David "Spence" Flagg, Cindy Green, Matthew Mills, Lea Powers, George Rogers, and Walt Stickley. PRESENTATIONS: None. PUBLIC HEARINGS: None. APPEARANCE OF CITIZENS: Marty Lowry, Bristol, Virginia, spoke of the treatment of animals and questioned why there is • not an animal welfare officer in either the City of Bristol, Tennessee or City of Bristol, Virginia. L_ • City Council Meeting March 6, 2012 Page 2 of4 Stanley Harrelson stated that he does not feel the judiciary system in Bristol is working. He requested Council assistance in resolving some problems he has encountered. APPOINTMENTS: Housing and Redevelopment Authority - Donna Felty was appointed to a five-year term of office ending March 31, 2017, by unanimous Council vote. ORDINANCES AND RESOLUTIONS: A. First Reading of New Ordinances: Ordinance 12-2 - An Ordinance to Amend Section 34-26(a) of the Code of Ordinances Regarding Fire Prevention Codes. City Manager Broughton reviewed this Ordinance, which adopts the 2012 edition of the National Fire Protection Association National Fire Codes, and replaces the 2009 edition • currently in use. The codes are used in the City's fire prevention and inspection program to ensure building compliance with code safety. Mayor Shumaker invited comments from the public, and there were none. Vice Mayor Staton moved to approve the Ordinance on first reading, and Councilwoman Feierabend seconded. The motion passed by unanimous roll call vote. B. Adoption of Ordinances (Second Reading): Ordinance 12-1 - An Ordinance to Abandon an Unimproved Portion of Sprint Drive as a Public Right-of-Way. City Manager Broughton reviewed this Ordinance. The proposed area for abandonment extends 373 feet north from the Spring Drive cul-de-sac, and surrounding development renders future need to extend a public roadway obsolete. Mayor Shumaker invited comments from the public, and there were none. Councilman Zandi moved to approve the Ordinance on second reading, and Vice Mayor Staton seconded. The motion passed by unanimous roll call vote. C. Resolutions: Resolution 12-23 - A Resolution Approving Tax Equivalent Payments. City Manager Broughton reviewed this Resolution which authorizes the distribution of tax equivalent payments from Bristol Tennessee Essential Services in the grand total of • • City Council Meeting March 6, 2012 Page 3 of4 $2,136,792.93 including $2,011,482.67 for electric facilities, $82,512.19 for tele- communication facilities, and $42,798.07 for cable/internet facilities. Each payment is based on a statutory formula and is the maximum amount allowed by law. The City will receive $1,646,674.81, a slight increase ($248) over last year. Mayor Shumaker invited comments from the public, and there were none. Councilwoman Feierabend moved to approve the Resolution on first reading, and Councilwoman Dolan seconded. The motion passed by unanimous roll call vote. CONSENT AGENDA: City Manager Broughton presented the Consent Agenda to Council. Mayor Shumaker requested Resolution 12-21 be removed from the Consent Agenda. Councilwoman Feierabend moved to approve the remaining items, and Vice Mayor Staton seconded. The following items were approved by unanimous Council vote: • Minutes - February 7, 2012 City Council Meeting; • • Minutes - February 21, 2012 City Council Work Session; • Resolution 12-14 - A Resolution Approving a Grant Contract with the State of Tennessee for Storm Damage Assistance; • Resolution 12-15 - A Resolution Authorizing Payment for Environmental Engineering and Disposal Services Associated with an Underground Storage Tank; • Resolution 12-16 - A Resolution Authorizing the Submittal of an Application for Grant Funding to the Tennessee Department of Environment and Conservation under the Clean Tennessee Energy Grant Program; • Resolution 12-17 - A Resolution Awarding a Bid for a Roof Replacement Project; • Resolution 12-18 - A Resolution Authorizing the Submittal of an Application for Grant Funding under the Safe Routes to School Program; • Resolution 12-19 - A Resolution Awarding a Bid for the Purchase of Radar Units; • Resolution 12-20 - A Resolution Awarding a Bid for an Elevator Upgrade; • Resolution 12-22 - A Resolution Awarding Bids for Water Plant Treatment Chemicals; and • • City Council Meeting March 6, 2012 Page 4 of 4 • Resolution 12-24 - A Resolution Awarding Bid for the Purchase of Fire Equipment and Turnout Gear. Considered separately was: • Resolution 12-21 - A Resolution Awarding Bid for the Purchase of Police Pursuit Vehicles City Manager Broughton reviewed this item which awards a bid for the purchase of police cars to the low bidder, Sam Swope Auto Group LLC. Upon inquiry, he provided information regarding engine size and fuel efficiency. Councilwoman Feierabend moved to approve, and Councilman Zandi seconded. The Resolution passed by unanimous roll call vote. CITY MANAGER'S REPORT: None. CITY COUNCIL COMMENTS: • Councilwoman Feierabend congratulated the Citizens Municipal Academy graduates and City staff on the program's success. Councilwoman Dolan recognized the U.S. Army and stated they are interested in becoming more active in the community. She encouraged people to consider this career challenge.
