MINUTES OF THE CITY OF BRISTOL, TENNESSEE CITY COUNCIL MEETING April 3, 2012 CALL TO ORDER: The City of Bristol, Tennessee City Council Meeting was called to order by Mayor David Shwnaker on Tuesday, April 3, 2012, at 7:00 p.m. in the Slater Center Auditoriwn. INVOCATION AND PLEDGE OF ALLEGIANCE: Pastor Larry Hall of West Hills Baptist Church gave the Invocation, and Council members' children, Meghan Dolan and Sara Zandi, led the Pledge of Allegiance. ROLLCALL: Present: Mayor David Shwnaker, Vice Mayor Joel Staton, Councilwoman Michelle Dolan, Councilwoman Margaret Feierabend, and Councilman Ben Zandi. Others Present: City Manager Jeff Broughton; City Attorney Jack Hyder; Secretary Terry Copenhaver-Horak; and members of City staff. AGENDA ADDITIONS AND/OR CHANGES: None. PROCLAMATIONS AND RECOGNITIONS: A. Bristol Arbor DaylEarth Day - Vice Mayor Staton read a Proclamation designating April 20,2012, as Bristol Arbor/Earth Day. Mr. Terry Napier and Mr. Kenneth King accepted the proclamation on behalf of the Tree Board. B. Fair Housing Month - Councilman Zandi read a Proclamation designating April 2012 as Fair Housing Month to encourage and promote fair housing opportunities in the community. Ms. Shari Brown, Community Development Director, accepted it and thanked Council for their continued support of fair housing. PRESENTATIONS: None. PUBLIC HEARINGS: None. APPEARANCE OF CITIZENS: None.  City Council Meeting April 3, 2012 Page 2 of3 APPOINTMENTS: Community Development Advisory Committee - Incumbents Ella A. Kane and Sylvia Ketron were reappointed to three-year terms of office ending April 30, 20 I5, by unanimous Council vote. ORDINANCES AND RESOLUTIONS: A. First Reading of New Ordinances: None. B. Adoption of Ordinances (Second Reading): Ordinance 12-2 - An Ordinance to Amend Section 34-26(a) of the Code of Ordinances Regarding Fire Prevention Codes. City Manager Broughton reviewed this Ordinance, which adopts the 2012 edition of the National Fire Protection Association National Fire Codes, and replaces the 2009 edition currently in use. The codes are used in the City's fire prevention and inspection programs to ensure building compliance with code safety. Mayor Shumaker invited comments from the public, and there were none. Vice Mayor Staton moved to approve the Ordinance on first reading, and Councilman Zandi seconded. The motion passed by unanimous roll call vote. C. Resolutions: Resolution 12-25 - A Resolution Authorizing the Purchase of Real Property. City Manager Broughton reviewed this Resolution which authorizes a property purchase from Mark E. Byington in the amount of$61,500, plus an amount to reimburse Mr. Byington for miscellaneous legal and related expenses incurred to acquire the property. The property is comprised of 12.3 acres and is located at the intersection of Georgia Avenue and Oakwood Street and is the former site of Cortrim Harwood Products. Mayor Shumaker invited comments from the public, and there were none. Vice Mayor Staton moved to approve the Resolution, and Councilman Zandi seconded. The motion passed by unanimous roll call vote. CONSENT AGENDA: City Manager Broughton presented the Consent Agenda to Council. Councilman Zandi moved to approve, and Councilwoman Feierabend seconded. The following items were approved by unanimous Council vote: • Minutes - March 6,2012 City Council Meeting; • Minutes - March 20,2012 City Council Work Session; and • Resolution 12-26 - A Resolution Awarding a Contract for Auditing Services.  City Council Meeting April 3,2012 Page 3 of3 CITY MANAGER'S REPORT: Mr. Broughton stated there are still several board and commission openings. MISCELLANEOUS: Director of Schools Gary Lilly spoke about a review of the BTCS strategic plan and other matters. Susan Wolfe, representing the Bristol Library, stated the Avoca Library is trying to emphasize being more of a community library. She mentioned several library activities. CITY COU CIL COMMENTS: Councilman Zandi announced that an AACA car show is scheduled to take place downtown on August 10, 2012. At the request of Councilwoman Feierabend, Director of Community Relations Terrie Talbert spoke of the Paper Windows Project. Mayor Shumaker, on behalf of the Bristol Civitan Clubs, invited the public to State Street on May 5th to help set a record for the Guinness Book of World Records for most people in two states at one time.
