, - - - - - - - - - - --- ------- MINUTES OF THE CITY OF BRISTOL, TENNESSEE CITY COUNCIL MEETING November 6, 2012 CALL TO ORDER: The City of Bristol, Tennessee City Council Meeting was called to order by Mayor Joel Staton on Tuesday, November 6, 2012, at 7:00 p.m. in the Slater Center Auditorium. ROLLCALL: Present: Mayor Joel Staton, Vice-Mayor Ben Zandi, Councilwoman Margaret Feierabend and Councilman David Shumaker. Absent: Councilwoman Michelle Dolan Others Present: City Manager Jeff Broughton; City Attorney Jack Hyder; City Recorder Tara Musick; and members of City staff. INVOCATION AND PLEDGE OF ALLEGIANCE: Mr. Wayne Sheridan with the Haven of Rest gave the invocation, and Mayor Staton led the pledge of allegiance. AGENDA ADDITIONS AND/OR CHANGES: None. PROCLAMATIONS AND RECOGNITIONS: None. PRESENTATIONS: None. PUBLIC HEARINGS: None. APPEARANCE OF CITIZENS: None. APPOINTMENTS: A. Board of Building Appeals - Rita Hawkins was appointed to the Board of Building Appeals (Code Appeals) for a five-year term ending June 30, 2017, by a majority vote as follows: Mayor Staton Rita Hawkins Vice-Mayor Zandi Rita Hawkins Councilwoman Feierabend None of the above Councilman Shumaker Rita Hawkins City Council Meeting November 6, 2012 Page 2 of4 B. Board of Zoning Appeals - No person was appointed upon the following vote: Mayor Staton None of the above Vice-Mayor Zandi None of the above Councilwoman Feierabend Rita Hawkins Councilman Shumaker None of the above C. Parks and Recreation Commission - Vivian Tester was appointed to the Parks and Recreation Commission for a three-year term ending June 30, 2015, by a unanimous vote. D. Tree Board - Paul Hawkins was appointed to the Tree Board for a four-year term ending June 30, 2016, by a unanimous vote. ORDINANCES AND RESOLUTIONS: A. First Reading of New Ordinances: Ordinance 12-16 - An Ordinance to Amend Section 404.2 of the Zoning Ordinance Relating to Uses Allowed Under Special Use Permit in the B-3 General Business District City Manager Broughton reviewed this Ordinance, which would amend section 404.2 of the Zoning Ordinance regarding the warehouse use group classification in the B-3 District. This amendment will replace warehouse use group 23622 with warehouse use group 531130 which reflects the use code rather than an occupation or construction activity code. Councilman Shumaker moved to approve the Ordinance on first reading, and Vice-Mayor Zandi seconded. The motion passed by unanimous roll call vote. B. Adoption of Ordinances (Second Reading): Ordinance 12-15 - An Ordinance to Amend Chapter 74, Article V, of the Code of Ordinances Relating to Control of Erosion and Sediment into the Stormwater System City Manager Broughton reviewed this Ordinance that amends Chapter 74, Article V, of the Code of Ordinances regarding erosion and sediment contro!' The City Manager explained that the amendment will address recent modifications made by the State regarding erosion prevention associated with construction sites. It will also incorporate the necessary changes to allow the City to participate in the Qualified Local Program, which places full authority for regulation of the stormwater program in the City. Vice-Mayor Zandi moved to approve the Ordinance on second reading, and Councilwoman Feierabend seconded. The motion passed on second reading by unanimous roll call vote. Resolutions: Resolution 12-108 - A Resolution Approving the Use ofthe National Citizen SurveyTM City Manager Broughton reviewed this Resolution that will approve the use of the National Citizen Survey ™ to conduct a community survey which was included as an objective in the Fiscal 2013 Goals Program. Councilman ShumakeT moved to approve, and Vice-Mayor Zandi seconded. The motion passed by unanimous roll call vote. CONSENT AGENDA: City Manager Broughton presented the Consent Agenda to Council. Vice-Mayor Zandi moved to approve, and Councilwoman Feierabend seconded. The following items were approved by unanimous Council vote: • Minutes - October 2,2012, City Council Meeting; • Minutes - October 16, 2012, City Council Work Session; • Resolution 12-103 - A Resolution Authorizing the Submittal of an Application for Grant Funding to the Tennessee Department of Agriculture under the TAEP Farmers Market Grant Program; • Resolution 12-104 - A Resolution Approving a Grant Agreement with the Virginia Department of Rail and Public Transportation for the Utilization of Federal Transit Administration Section 5303 Funds for the Bristol Metropolitan Planning Organization; • Resolution 12-105 - A Resolution Authorizing the Acceptance of a Grant from the U.S. Department of Justice under its Bulletproof Vest Partnership Program; • Resolution 12-106 - A Resolution Authorizing the Acceptance of a Grant from the Tennessee Department of Agriculture under its Urban Forestry and Grants Program; • Resolution 12-107 - A Resolution Authorizing the Acceptance of a Grant from the Tennessee Department of Agriculture under its Tennessee Agricultural Enhancement Program; • Resolution 12-109 - A Resolution Awarding a Bid for Ball Park Fencing; • Resolution 12-110 - A Resolution Awarding a Bid for a Front End Mower; City Council Meeting November 6, 2012 Page 4 of4 • Resolution 12-111 - A Resolution Authorizing the Purchase of Microsoft Office 2010; • Resolution 12-112 - A Resolution Awarding a Bid for a Water System Correlating Radio Leak Noise Logger System; and • Resolution 12-113 - A Resolution Approving an Easement Agreement with Lumos Networks, Inc. CITY MANAGER'S REPORT: None. CITY COUNCIL COMMENTS: Councilwoman Feierabend thanked Mr. Wayne Sheridan for his invocation and recognized the use of the Slater Center as a polling place in this year's presidential election. Councilman Shumaker spoke on the upcoming election and of the importance for political parties to corne together for the sake of the nation.
