CITY OF BRUSH! MINUTES OF THE MAY 23, 2016 – REGULAR CITY COUNCIL MEETING The City Council of the City of Brush, Colorado met in regular session on May 23, 2016. Mayor Chuck Schonberger called the meeting to order at 6:00 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Present on roll call were: Mayor Chuck Schonberger Councilor Jeanine Anderson Councilor Rick Bain Councilor Marlene Baker Councilor Heath Becker Councilor Kimberly Dykes Councilor Vicky Quinlin Absent: Also present were City Administrator Monty Torres, Assistant City Administrator Karen Schminke, City Attorney Robert Chapin, Public Works Director Dale Colerick, Community Service Director Lance Schwindt, Police Lieutenant Corey Hardy, Marketing Specialist Tyler Purvis, and Deputy City Clerk Deanna Schwindt. MINUTES The minutes of the regular meeting of May 9, 2016, and the Special Meeting of May 16, 2016, were approved as submitted. VISITORS AND DELEGATIONS None. FINANCE City Disbursements Councilor Quinlin moved, second by Councilor Dykes to approve City bills from May 9-23, 2016. The motion was approved unanimously by roll call vote. General Fund $ 65,852.70 Capital Improvement Fund $ 3.00 Fire Equipment Fund $ 2.00 Water Fund $ 29,449.49 Trash and Garbage Fund $ 12,437.79 Waste Water Fund $ 8,883.36 Council Proceedings –May 23, 2016 1 Storm Water Fund $ 6 77.12 Golf Course Fund $ 20,939.76 Community Enhancement Fund $ 11,250.00 Joslin Needham Fund $ 14,203.34 Payroll and Cafeteria $ 72,701.34 Payroll Liability $ 29,582.97 Disbursements Total $ 265,982.87 MANAGEMENT Public Hearing – Final Plat for Love’s Subdivision Mayor Schonberger opened the public hearing at 6:03 p.m. Assistant City Administrator Karen Schminke presented the request from Galloway & Company, Inc., on behalf of Love’s Travel Stops & Country Stores for approval of a final plat for Love’s Subdivision. She stated that it was a re-subdivision of Lot 3 of Castle Rock Subdivision into five lots. The subject property was zoned Commercial, is approximately 30.43 acres in size, and is located at the southeast corner of Hospital road and Interstate 76, also known as 1045 Hospital Road. She summarized the subdivision process and the status of the ordinal conditions of approval that were part of the preliminary plat approval that was granted in February 2016. She added that the notice of public hearing was published on the property and in the Brush News Tribune and to date she had not received any public comments. She informed Council that at the May 16, 2016, the Planning and Zoning Commission meeting they voted to recommend to City Council that the final plat for Love’s Subdivision (a re-plat of Lot 3 of Castle rock Subdivision be approved with conditions identified as: 1. Add a note that the primary access into Lot 1 must be from Cotton Street and one secondary “right in-right out only’ access is allowed from Hospital Road. 2. The city’s NOTICE regarding acceptance of the roads must be added to the plat. 3. Prior to recording of the Love’s Subdivision plat, the Development Agreement must be signed by all parties to the agreement. Both documents will be recorded concurrently. 4. Unless otherwise completed and recorded, approval of this final plat shall expire twenty-four months from the date of Council approval. Dave Pierson representing Galloway& Company, Inc. was present to answer questions. No comments were received from the public. The Mayor closed the public hearing at 6:10 p.m. Councilor Anderson moved, second by Councilor Bain to approve, with the conditions identified by staff, the final plat for Love’s Subdivision. It was approved unanimously by roll call vote. Public Hearing – Amendment to Chapter 16 of the Brush Municipal Code Concerning Temporary Workforce Housing Council Proceedings –May 23, 2016 2 Mayor Schonberger opened the public hearing at 6:11 p.m. Assistant City Administrator Karen Schminke presented an Ordinance that would amend the Land Use Code to allow temporary work force housing in an Industrial and Agricultural Zone by Special Use Permit. From the current Land Use Code she summarized the intent of the Industrial and Agricultural Zone Districts and highlighted the Housing section of the City’s Comprehensive Plan. She noted that this ordinance was developed without input from the community as it was originally requested by Mastronardi Produce and Brushco Farms. To date, the only comments City staff had received regarding this ordinance have come from Brushco Farms. She informed Council that at the May 16, 2016, the Planning and Zoning Commission meeting they voted to recommend to City Council the adoption of the ordinance as presented. She added that the notice of public hearing was published in the Brush News Tribune and to date she had not received any public comments. No comments were received from the public. Councilor Bain stated that Brushco farms had demonstrated a need to provide housing for their workers. The Mayor closed the public hearing at 6:32 p.m. First Reading of Ordinance No. 847-16, An Ordinance Adopting An Amendment To Chapter 16 of the Brush Municipal Code Concerning Temporary Workforce Housing Councilor Dykes introduced the ordinance and read the ordinance by title. Motion by Councilor Quinlin to approve for publication on first reading, Ordinance No. 847-16, An Ordinance Adopting An Amendment To Chapter 16 of the Brush Municipal Code Concerning Temporary Workforce Housing, second by Councilor Baker. It passed unanimously by roll call vote. Multi-Family Dwelling Incentives Marketing Specialist Purvis distributed a policy and application that would provide incentives for multi-family dwellings. Motion by Councilor Dykes, second by Councilor Quinlin to provide incentives as presented. It passed unanimously by roll call vote. Counter Offer Between the City of Brush and the Donald Bostron Estate Public Works Director Dale Colerick presented a counter offer from the Donald Bostron Estate concerning property the City would like to purchase. Motion by Councilor Bain second by Councilor Quinlin to approve the counter offer for the purchase of real estate. Council Proceedings –May 23, 2016 3 It passed unanimously by roll call vote. Oath of Office for Police Chief Travis Anderson Mayor Schonberger administered the oath of office for Police Chief Travis Anderson. His swearing in was followed by a reception attended by his family, City Council, staff and members of the public.
