CITY OF BRUSH! MINUTES OF THE OCTOBER 10, 2016 – REGULAR CITY COUNCIL MEETING The City Council of the City of Brush, Colorado met in regular session on October 10, 2016. Mayor Chuck Schonberger called the meeting to order at 6:00 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Present on roll call were: Mayor Chuck Schonberger Councilor Jeanine Anderson Councilor Rick Bain Councilor Marlene Baker Councilor Kimberly Dykes Councilor Vicky Quinlin Absent: Councilor Heath Becker Also present were City Administrator Monty Torres, City Attorney Bo Chapin, Public Works Director Dale Colerick, Finance Director Joanne Gosselink, Police Chief Travis Anderson, Community Service Director Lance Schwindt, and City Clerk Andrea Strand. MINUTES The minutes of the regular meeting of September 26, 2016, were approved as submitted. VISITORS AND DELEGATIONS Brush Chamber Executive Director Melody Christensen was present and presented a plaque to the City thanking them for all of their help with the Oktoberfest Car Show and other events throughout the year. MANAGEMENT Second Reading of Ordinance No. 849-16, An Ordinance Amending Section 8-4-30 of Brush Municipal Code Related to Golf Cars Crossing State Highways Councilor Anderson offered a motion, second by Councilor Quinlin to adopt Ordinance No. 849- 16, An Ordinance Amending Section 8-4-30 of the Brush Municipal Code Related to Golf Cars Crossing State Highways on second reading and publish by title only. The roll call vote was unanimous. City Attorney Chapin added that off road vehicles are still not allowed to cross the highways under this ordinance. Council Proceedings –October 10, 2016 1 Second Reading of Ordinance No. 850-16, An Ordinance Amending Article 1, Part 1 of the Model Traffic Code for Colorado (2003) Authorizing the Operation of Off-Highway Vehicles on City Streets and Alleys for Snow Removal Councilor Quinlin offered a motion, second by Councilor Dykes to adopt Ordinance No. 850-16 on second reading and publish by title only. The roll call vote was unanimous. First Reading of Ordinance No. 851-16, An Ordinance Approving the Lease of Certain Real Estate Owned by the City of Brush for Term of Near Five Years Administrator Torres presented the Ordinance for first reading and stated it had been discussed at a previous work session. This would lease the recently purchased Bostron Estate Farm. Councilor Rick Bain introduced Ordinance No. 851-16, An Ordinance Approving the Lease of Certain Real Estate Owned by the City of Brush for Term of Near Five Years. Councilor Dykes offered a motion, second by Councilor Quinlin to adopt on first reading Ordinance No. 851-16, and publish in full. The roll call vote was unanimous. Resolution No. 2016 Supporting the Brush School District Ballot Issues City Administrator Torres read Resolution No. 2016-5, A Resolution Supporting the Brush School District Ballot Issues. Councilor Anderson offered a motion, second by Councilor Bain to approve Resolution No. 2016 Supporting the Brush School District Ballot Issues. The roll call vote was unanimous. Contract between the City of Brush and the State of Colorado for State Highway Maintenance City Administrator Torres presented the Contract for limited maintenance on state highways through Brush, between the City and CDOT. Councilor Quinlin offered a motion, second by Councilor Dykes to approve the Contract between the City of Brush and the State of Colorado for State Highway Maintenance. The roll call vote was unanimous. Final Settlement with Ransom Boone Excavating/Mill Street Project Finance Director Gosselink presented the final settlement for completed work on the Mill Street Project due to Ransome Boone Excavating. She stated that the City had published the final settlement in the paper for two weeks, and had not received a response. Council Proceedings –October 10, 2016 2 Councilor Anderson offered a motion, second by Councilor Dykes to approve the final settlement with Ransome Boone Excavation on the Mill Street Project. The roll call vote was unanimous. FINANCE City Disbursements Councilor Quinlin moved, second by Councilor Anderson to approve City bills from September 26-October 10, 2016. The roll call vote was unanimous. General Fund $ 87,608.33 Capital Improvement Fund $ 50,856.40 Capital Reserve Fund $ 21,153.58 Water Fund $ 31,941.04 Trash and Garbage Fund $ 4,663.85 Waste Water Fund $ 11,800.08 Storm Water Fund $ 1,780.13 Golf Course Fund $ 15,800.83 Community Enhancement Fund $ 86.03 Joslin Needham Fund $ 590.00 Payroll and Cafeteria $ 71,421.54 Payroll Liability $ 43,241.68 Disbursements Total $ 340,943.49 2017 PROPOSED BUDGET PRESENTED BY CITY ADMINISTRATOR City Administrator Torres presented the proposed 2017 Budget and stated that it did not include payroll or capital items. Those would be reviewed and discussed at the Council Budget Retreat on November 14, 2016. and capital outlay projects would be presented at the October 24, 2016, council meeting. STAFF REPORTS Police Chief Anderson • Staff is participating in various community projects. • Reported that $850 had been received from the community for the K9 project. • Reported on activities from the Oktoberfest, had one youth with an air gun and complaints from citizens over the bikini clad staff at a downtown bar. Public Works Director Dale Colerick • Reported that crews are patching pot holes around town Council Proceedings –October 10, 2016 3 City Clerk Strand • Highlighted upcoming meetings • Encouraged everyone to get registered to vote City Administrator Torres • Reported that the City is in discussion with Verizon for a cell and light tower. • Community development is busy with three new homes being built and two duplexes proposed. An application has been received for Temporary Workforce Housing • A Tesla charging station is under review. • The old pork plant is in the process of conversion to a cheese factory. • Eben Ezer has a large expansion planned. • Loves hopes to go out for bid in March of 2017. MAYOR AND COUNCIL Councilor Anderson • Attended a demonstration and open house on Sobriety Court at the Morgan County Justice Center. Brush Police Officer Garrett Hackett is currently volunteering on the panel. Councilor Quinlin • Thanked Dale and Lance for their assistance with the recent high school cross country track meet held at The Course at Pettyes Park. Eleven schools were present.
