CITY OF BRUSH! MINUTES OF THE NOVEMBER 26, 2018 – REGULAR CITY COUNCIL MEETING The City Council of the City of Brush, Colorado met in regular session on November 26, 2018. Mayor Charles R. Bain called the meeting to order at 6:00 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Present on roll call were: Mayor Charles R. Bain Councilor Jeanine Anderson Councilor Marlene Baker Councilor Vicky Quinlin Councilor Daniel R. Scalise Councilor Dana Sherman Absent: Councilor Heath Becker Also present were City Administrator Monty Torres, Police Lieutenant Corey Hardy, Finance Director Joanne Gosselink, Public Works Director Dale Colerick and City Clerk Andrea Strand. MINUTES The minutes of the regular meeting of the November 5, 2018, were approved as submitted. VISITORS AND DELEGATIONS The Mayor stated that citizens are invited to speak to the Council on items that are not on the agenda. There is a 3 minute time limit per person, unless otherwise noted by the Mayor. Please note that no formal action will be taken on these items during this time due to the open meeting law provision; however, they may be placed on a future posted agenda if action is required. There were no comments from the public. MANAGEMENT Second and Final Reading of Ordinance No. 874-18 to Repeal the Prohibition of Loitering for Purpose of Begging Set Out in Section 10-4-40(b)(1) of the Brush Municipal Code Councilor Quinlin offered a motion, second by Councilor Anderson to adopt Ordinance No. 874- 18 to Repeal the Prohibition of Loitering for Purposes of Begging Set Out in Section 10-4- 40(b)(1) of the Brush Municipal Code on second reading and publish by title only. It was adopted unanimous roll call vote. Council Proceedings – November 26, 2018 1 Request by Eben Ezer to Waive Building Permit Fees Administrator Torres presented a request submitted by Eben Ezer to waive building permit fees on their expansion project for Phase 2 and Phase 3A. He provided a summary of approved requests from 2009 to date. Councilor Sherman offered a motion, second by Councilor Baker to approve the building fee permit waiver for Eben Ezer at 50% of the amount due for Phase 2 which was $25,344.30; and 50% of the amount due for Phase 3A which was $11,879.45 It was approved unanimously by roll call vote. CITY DISBURSEMENTS Councilor Quinlin moved, second by Councilor Sherman to approve City bills from November 5- 26, 2018. The motion was approved unanimously by roll call vote. General Fund $ 52,992.29 Capital Improvement Fund $ 36.84 Fire Equipment Fund $ 375,227.20 Water Fund $ 8,996.92 Trash and Garbage Fund $ 17,850.65 Waste Water Fund $ 7,897.75 Storm Water Fund $ 837.73 Golf Course Fund $ 14,257.99 Police Forfeiture & Confiscation fund $ 56.77 Joslin Needham Fund $ 8,693.22 Payroll $ 67,409.73 Payroll Liability and Cafeteria $ 28,409.20 Disbursements Total $ 582,666.29 Councilor Anderson would like further explanation of the training expenses. STAFF REPORTS Finance Director Gosselink  Reported that she received an amended assessed value which was lower by $1500. Public Works Director Colerick  Staff is working on catch basins at Princeton, Cambridge and Stanford Streets, next year they will work on Harvard Street.  Boring crews for Charter and CenturyLink have been requesting locates. City Clerk Strand  Announced upcoming meetings and other announcements. Council Proceedings – November 26, 2018 2  A Special Election for Ward 3 will be held on December 11, 2018. Absentee ballots can be requested through the City Clerk’s Office. Administrator Torres  Reported that the water attorney for the city is working on the wells for the Brush Agri Park being placed in the augmentation plan for the City. This will be presented to the Water Advisory Board and then brought to council.  The emergency interconnects agreement with Morgan County Quality Water will also be brought forward to the Water Advisory Board then to council. MAYOR AND COUNCIL REPORTS Councilor Anderson  Reported on the lawsuit that she has against the City. Mayor Bain cautioned her about talking about it. She continued by encouraging everyone to read a book entitled “Supremes Greatest Hits” She stated that her case had been filed in Morgan County District Court then was transferred to Federal District Court in Denver. She wanted to make note that her observation of the City’s CIRSA attorney’s was not favorable. She spoke of the need to decide to resign from Council or continue with her law suit as it is a conflict of interest to do both. Mayor Bain Reported that Small Business Saturday events were sponsored by the City. A breakfast was held for business owners and a few awards were given out for Community Support and Significant Improvements. Chili was served at lunch for shoppers. Executive Session for the purpose of the annual review of the City Administrator pursuant to C.R.S. 24-6-402(4) (f). At 6:20 p.m. Councilor Scalise offered a motion to enter into executive session for the purpose of the annual review of the City Administrator pursuant to C.R.S. 24-6-402(4)(f). His motion was seconded by Councilor Quinlin and was approved unanimously. Upon returning to the open session, Mayor Bain announced that the time was 7:02 p.m., and the executive session had been concluded. The participants in the executive session were: Mayor Bain, Councilors Anderson, Baker, Quinlin, Scalise, Sherman and Administrator Monty Torres. Mayor Bain stated for the record, if any person who had participated in the executive session believed that any substantial discussion of any matters not included in the motion to go into the executive session occurred during the executive session in violation of the Open Meetings Law, to state their concerns for the record. Councilor Quinlin offered a motion, second by Councilor Sherman to approve the salary increase at 2%. It was approved unanimously by roll call vote. Council Proceedings – November 26, 2018 3 Executive Session for the purpose of the annual review of the City Clerk pursuant to C.R.S. 24-6-402(4) (f). At 7:03 p.m. Councilor Scalise offered a motion to enter into executive session for the purpose of the annual review of the City Clerk pursuant to C.R.S. 24-6-402(4)(f). His motion was seconded by Councilor Quinlin and was approved unanimously. Upon returning to the open session, Mayor Bain announced that the time was 7:17 p.m., and the executive session had been concluded. The participants in the executive session were: Mayor Bain, Councilors Anderson, Baker, Quinlin, Scalise, Sherman and Clerk Andrea Strand. Mayor Bain stated for the record, if any person who had participated in the executive session believed that any substantial discussion of any matters not included in the motion to go into the executive session occurred during the executive session in violation of the Open Meetings Law, to state their concerns for the record.
