City Manager Review: SW Council Agenda Item No.: 1 CITY OF BUELLTON CITY COUNCIL MEETING MINUTES Regular Meeting of May 23, 2024 City Council Chambers, 140 West Highway 246 Buellton, California CALL TO ORDER Mayor King called the meeting to order at 6:00 p.m. PLEDGE OF ALLEGIANCE ROLL CALL Present: Council Members Hudson Hornick and John Sanchez, Vice Mayor David Silva, and Mayor King Absent: Council Member Elysia Lewis Staff: City Manager Scott Wolfe, City Attorney Greg Murphy, Public Works Director Rose Hess, Finance Director Shannel Zamora, Planning Director Andrea Keefer, and City Clerk Linda Reid REORDERING OF AGENDA None PUBLIC COMMENTS Scott Bramsen, spoke about excessive speeding on Highway 246 and asked the City Council to consider adding speed bumps near the schools. A.J. Tarman, Buellton, thanked Mayor King and City Manager Wolfe for providing an update regarding excessive speeding through the City. Mr. Tarman also discussed his position on the Urban Growth Boundary (UGB) and requested the City Council not extend the City’s boundaries. CONSENT CALENDAR 1. Monthly Treasurer’s Report – April 30, 2024 4. Resolution No. 24-11 – “A Resolution of the City Council of the City of Buellton, California, Modifying Red Curb on Locations on McMurray Road and Valley Vineyard Circle and Addition of Red Curbs and Green Curbs/2-Hour Parking on Locations on Valley Vineyard Circle” 5. Resolutions Pertaining to General Municipal Election to be Held November 5, 2024 Resolution No. 24-13 – “A Resolution of the City Council of the City of Buellton, California, Calling and Giving Notice of the Holding of a General Municipal Election to be Held on Tuesday, November 5, 2024 for the Election of Certain Officers as Required by the Provisions of the Laws of the State of California Relating to General Law Cities” Resolution No. 24-14 – “A Resolution of the City Council of the City of Buellton, California, Requesting the Board of Supervisors of the County of Santa Barbara to Consolidate a General Municipal Election to be Held on Tuesday, November 5, 2024 with the General Election Pursuant to Section 10403 of the Elections Code” Resolution No. 24-15 – “A Resolution of the City Council of the City of Buellton, California, Adopting Regulations for Candidates for Elective Office Pertaining to Candidate’s Statements, Materials Submitted to the Electorate, and the Cost Thereof, Submitted to the Voters at an Election to be Held on Tuesday, November 5, 2024” MOTION: Motion by Council Member Hornick seconded by Mayor King, approving Consent Calendar Items 1 through 5 as listed. VOTE: Motion passed by a roll call vote of 4-0. Council Member Hornick – Yes Council Member Sanchez – Yes, abstain as to Item 1. Vice Mayor Silva – Yes, abstain as to Item 4. Mayor King – Yes PRESENTATIONS None PUBLIC HEARINGS None City Council Meeting Minutes Page 3 May 23, 2024 COUNCIL MEMBER COMMENTS/ITEMS Council Member Hornick questioned whether the City can do anything about the numerous insects biting people in Buellton. Council Member Hornick questioned staff as to the progress of increasing operating hours at the Buellton Library. Council Member Hornick provided an update regarding refurbishing the Santa Rosa Road Bridge. Council Member Sanchez announced that former Council Member/Mayor Holly Sierra is selling raffle tickets to enter a drawing to win a hand-made quilt, with all proceeds supporting the Buellton Library. WRITTEN COMMUNICATIONS None COMMITTEE REPORTS Council Member Sanchez announced that he attended the Santa Ynez Valley Community Aquatics Foundation meeting and provided an oral report regarding the meeting. Vice Mayor Silva announced that he attended board meetings for Santa Barbara County Association of Governments (SBCAG) and Air Pollution Control District (APCD) and provided oral reports regarding the meetings. Mayor King stated he attended the California Joint Powers Insurance Authority (CJPIA) Elected Leaders Forum in Huntington Beach and it was a great event. Mayor King stated he attended the Coast Rail Coordinating Council (CRCC) meeting and provided an oral report regarding the meeting. BUSINESS ITEMS 6. Resolution No. 24-16 – “A Resolution of the City Council of the City of Buellton, California, Calling and Giving Notice of the Holding of an Election that is Requested to be Consolidated with the General Election to be Held on Tuesday, November 5, 2024 for the Submission to the Qualified Voters of the Question: Should the Buellton General Plan be Amended, Until December 31, 2036, to Prohibit (With Limited Exceptions) Changes to Existing City Limits or the Provision of Water or Sewer Services Beyond an Amended Urban Growth Boundary Line, Except by Another Initiative Election?” RECOMMENDATION: That the City Council consider the adoption of Resolution No. 24-16. City Council Meeting Minutes Page 4 May 23, 2024 STAFF REPORT: City Manager Wolfe presented the staff report. DOCUMENTS: Staff report with attachments as listed in the staff report. SPEAKERS/DISCUSSION: Correspondence regarding this item was received and made part of the record from the following individuals: • Len Fleckenstein • Theresa Reilly • We Watch Board of Directors • Larry Bishop The City Council discussed the following issues: • The Urban Growth Boundary process • Potential Memorandum of Understanding with Santa Barbara County to preserve open-space south of the City limits • The UGB allowing the City to have some control over growth • Removing Sites D and E from the proposed map and keeping Sites A, B, and C on the proposed map, so voters will likely approve the Measure in November • Modifying the title of the Measure to provide clarity and understanding, as proposed by City Attorney Murphy Scott Bramsen, spoke about the impacts of expanding the Urban Growth Boundary in Buellton. Theresa Reilly, requested the City Council look at the impacts of expanding the City limits. Ms. Reilly stated the Measure title is awkward and should be amended. Ms. Reilly then spoke on behalf of We Watch Board of Directors and read the Board’s input letter into the record. Larry Bishop, Buellton, discussed how the City would be affected by an amended UGB. Len Fleckenstein, Buellton, stated he would vote against the proposed UGB and the only expansion that should be considered is Site A, north of the City limit. Candice Signa, Buellton, requested the City Council remove proposed Sites D and E on the map and stated she does not believe the current Measure will be approved by the voters. DIRECTION: The City Council agreed by consensus to revise the Measure’s title and update the map (Exhibit 1) to include Sites A, B, and C and remove Sites D and E and bring back the UGB Measure for approval at the June 13th Council meeting. Resolution No. 24-17 – “A Resolution of the City Council of the City of Buellton, California, Calling and Giving Notice of the Holding of an Election to be Consolidated with the General Election To Be Held On Tuesday, November 5, 2024 for the Purpose of Submitting a Measure to the Qualified Voters of Buellton Regarding Raising the Transient Occupancy Tax Rate” RECOMMENDATION: That the City Council consider the adoption of Resolution No. 24-17. MOTION: Motion by Council Member Sanchez, seconded by Council Member Hornick, adopting Resolution No. 24-17 – “A Resolution of the City Council of the City of Buellton, California, Calling and Giving Notice of the Holding of an Election to be Consolidated with the General Election to be held on Tuesday, November 5, 2024 for the Purpose of Submitting a Measure to the Qualified Voters of Buellton Regarding Raising the Transient Occupancy Tax Rate” as amended. Award of Contract for Water and Sewer Rate Study RECOMMENDATION: That the City Council award the contract for the Water and Sewer Rate Study in the amount not to exceed $55,950 to Willdan Financial Services and authorize the City Manager to execute that contract. MOTION: Motion by Vice Mayor Silva, seconded by Council Member Hornick, authorizing the City Manager to execute a contract with Willdan Financial Services, for a Water and Sewer Rate Study, not to exceed $55,950. Mid-Cycle Budget Study Session Related to Fiscal Year 2024-25 RECOMMENDATION: That the City Council discuss the Fiscal Year 2024-25 proposed adjustments to the adopted City budget and direct staff regarding any budget adjustments. STAFF REPORT: Finance Director Zamora presented the staff report and went through the entire Fiscal Year 2024-25 proposed adjustments to the adopted City budget. DOCUMENTS: Staff report with attachments as listed in the staff report. DIRECTION: The City Council agreed by consensus to direct staff to bring back a resolution solidifying the Mid-Cycle Budget for Fiscal Year 2024-25, with proposed revisions. CITY MANAGER’S REPORT City Manager Wolfe provided an informational report for the record.
