City of Bulverde, Texas City Council Meeting Tuesday, June 11, 2024 Meeting Duration: 6:30 PM to 10:18 PM CALL THE MEETING TO ORDER Mayor Bill Krawietz called the meeting to order at 6:30 PM. Members of City Council Present: Mayor Bill Krawietz Mayor Pro Tem Mark Morkovsky, Place 1 Council Member Yvonne Chapman, Place 2 Council Member Clint Hays Place 4 Council Member Joe Alexandre, Place 5 Council Member Christopher Goth, Place 6 Members of City Council Absent: Council Member Charles Hughes, Place 3 City Staff Present: City Manager Charles West, City Attorney Megan Santee, City Secretary Sandra V. Ham, Chief of Police Gary Haecker, Planning Director Danny Batts, Public Works Director Tim Parker, and Finance Director Sharon Nelson REPORTS AND PRESENTATIONS 2.A. Police Department: Monthly Report Report given by Police Chief Gary Haecker. 2.B. Finance Department: Monthly Report Report given by Finance Director Sharon Nelson. 2.C. Public Works Update Report given by Public Works Director Tim Parker. 2.D. Planning Department Update Report given by Planning Director Danny Batts. 2.E. Parks & Recreation Update Report given by Board Member Katie Sotelo. 2.F. Economic Development Foundation Report given by Executive Director Paula Stakes. REGULAR AGENDA ITEMS 3.A. Consider approval of the City Council Meeting Minutes from May 14, 2024. Motion: Mayor Krawietz made a motion seconded by Council Member, Place 5 Alexandre to approve the City Council Meeting Minutes from May 14, 2024. Vote: Motion carried (6) ayes to (0) nays. 3.B. Consider and take action on an Interlocal Agreement between the City of Bulverde and Comal Independent School District for the provision of law enforcement services. Motion: Council Member, Place 4 Hays made a motion seconded by Council Member, Place 2 Chapman to approve an Interlocal Agreement between the City of Bulverde and Comal Independent School District for the provision of law enforcement services. Vote: Motion carried (6) ayes to (0) nays. 3.C. Discuss the City’s upcoming Charter Review and consider direction to Staff regarding the solicitation of applications from the public for service on the City’s Charter Review Commission. Staff was given direction to begin accepting Council’s nominations for service on the City’s Charter Review Commission. 3.D. Consider an ordinance granting a variance to Section 17.04.003, Code of Ordinances of the City of Bulverde, Texas, pertaining to cut requirements on an approximately 1.936-acre tract of land, located at 21 Inverness Court, Bulverde, Texas 78163. Motion: Mayor Krawietz made a motion seconded by Council Member, Place 4 Hays to approve an ordinance granting a variance to Section 17.04.003, Code of Ordinances of the City of Bulverde, Texas, pertaining to cut requirements on an approximately 1.936-acre tract of land, located at 21 Inverness Court, Bulverde, Texas 78163. Vote: Motion carried (6) ayes to (0) nays. Ordinance #761 3.E. Conduct a Public Hearing and consider an ordinance of the City of Bulverde, Texas approving a Special Use Permit for 31209 Sunlight Drive, Bulverde, Texas 78163 to permit a guest house; amending the zoning ordinance; directing the amendment of the zoning map; repealing conflicting ordinances; and providing a severability clause and an effective date. Mayor Krawietz opened the Public Hearing at 6:57 PM. One comment was received by Council. Mayor Bill Krawietz closed the Public Hearing at 6:58 PM. Motion: Council Member, Place 5 Alexandre made a motion seconded by Council Member, Place 2 Chapman to approve an ordinance of the City of Bulverde, Texas approving a Special Use Permit for 31209 Sunlight Drive, Bulverde, Texas 78163 to permit a guest house. Vote: Motion carried (6) ayes to (0) nays. Ordinance #762 3.F. Conduct a Public Hearing and consider an ordinance of the City of Bulverde, Texas approving a Special Use Permit for 4 Sun Valley Drive, Spring Branch, Texas 78070 to permit theater/stage/live venue performance - outside as an accessory use, amending the zoning ordinance; directing the amendment of the zoning map; repealing conflicting ordinances; and providing a severability clause and an effective date. Mayor Krawietz opened the Public Hearing at 7:12 PM. Seven comments were received by Council. Mayor Bill Krawietz closed the Public Hearing at 7:52 PM. Motion: Council Member, Place 6 Goth made a motion seconded by Mayor Pro Tem, Place 1 Morkovsky to table an ordinance approving a Special Use Permit for 4 Sun Valley Drive, Spring Branch, Texas 78070 to permit theater/stage/live venue performance - outside as an accessory use, until the July City Council meeting in order to allow the applicant to propose noise mitigation measures. Vote: Motion carried (4) ayes to (2) nays, Mayor Krawietz and Council Member, Place 2 Chapman opposed. 3.G. Consider and take possible action on appointing / reappointing members to the Planning and Zoning Commission. Mayor Krawietz announced this agenda item would be considered after Executive (Closed) Session. 3.H. Consider and take possible action on appointing / reappointing members to the Parks & Recreation Advisory Board. Mayor Krawietz announced this agenda item would be considered after Executive (Closed) Session. PUBLIC COMMENTS NOT RELATED TO POSTED AGENDA ITEMS Mayor Bill Krawietz opened the meeting for public comments not related to posted agenda items at 7:55 PM. There being no comments, the public comments were immediately closed. REPORTS BY ELECTED OFFICIALS AND CITY STAFF ON ITEMS OF COMMUNITY INTEREST Council Member, Place 2 Chapman extended appreciation to former Planning & Zoning Commissioner Linden Sisk for his service on the Commission. Mayor Bill Krawietz thanked Commissioner Sisk for his time on the Commission and complimented him on the knowledge he brought to the City. EXECUTIVE (CLOSED) SESSION At 7:59 PM the City Council convened into Executive Session to discuss the following: 6.A. The City Council will meet in closed session to deliberate the appointment / reappointment or removal of members of the Zoning Board of Adjustment. 6.B. The City Council will meet in closed session regarding Personnel Matters pertaining to the annual review, evaluation, and goals of the City Manager. 6.C. The City Council will meet in closed session to seek the advice of legal counsel about pending or contemplated litigation, to discuss a settlement offer, or on matters in which the duty of the attorney to the City Council under the Texas Rules of Professional Conduct conflict with the Texas Open Meetings Act; to wit: I. Lynn & Kimberly Phillips vs James Eureste, Alex Garcia, Exp Realty, LLC and City of Bulverde, Texas, Cause No. C2023-1796D, 433rd District Court, Comal County, Texas. II. Bulverde v NSHE Texas Mabank and SCWC Subdivision Issues. III. Catenary Vis, LLC Replatting, Corrective and Settlement Agreement. ACTIONS ITEMS AFTER EXECUTIVE (CLOSED) SESSION At 10:14 PM the City Council reconvened from Executive Session and took the following action on items discussed in Executive Session. 7.A. The City Council will meet in closed session to seek the advice of legal counsel about pending or contemplated litigation, to discuss a settlement offer, or on matters in which the duty of the attorney to the City Council under the Texas Rules of Professional Conduct conflict with the Texas Open Meetings Act; to wit: I. Lynn & Kimberly Phillips vs James Eureste, Alex Garcia, Exp Realty, LLC and City of Bulverde, Texas, Cause No. C2023-1796D, 433rd District Court, Comal County, Texas. No action taken. II. Bulverde v NSHE Texas Mabank and SCWC Subdivision Issues. No action taken. III. Catenary Vis, LLC Replatting, Corrective and Settlement Agreement. Motion: Mayor Krawietz made a motion seconded by Mayor Pro Tem, Place 1 Morkovsky to authorize the City Manager to execute a settlement agreement with Catenary Vis, LLC. Vote: Motion carried (6) ayes to (0) nays. 7.B. Consider and take possible action on appointing / reappointing members to the Planning and Zoning Commission. Motion: Council Member, Place 5 Alexandre made a motion seconded by Council Member, Place 4 Hays to appoint / reappoint the following members to the Planning & Zoning Commission: Reaffirm for second year of appointment Jeffrey Burrier Michelle Molina Ted Hawkins Appoint to two-year term Ashley Cartier Gregory Porter Brad McCollum Appoint for one-year term (filling vacancy) James Flavin Appoint for one-year term (Alternate) Fred Perry Vote: Motion carried (6) ayes to (0) nays. 7.C. Consider and take possible action on appointing / reappointing members to the Parks & Recreation Advisory Board. Motion: Mayor Krawietz made a motion seconded by Council Member, Place 6 Goth to appoint / reappoint the following members to the Parks & Recreation Advisory Board: Appoint for one-year term Daniel Schrubb Rebekah Hays Ted Golsch Katie Sotelo Angie Krawietz Jessica Croll Dominic Perez Vote: Motion carried (6) ayes to (0) nays. 7.D. Consider and take possible action on appointing / reappointing members to the Zoning Board of Adjustment. Motion: Council Member, Place 4 Hays made a motion seconded by Council Member, Place 2 Chapman to appoint / reappoint the following members to the Zoning Board of Adjustment: Reaffirm for second year of appointment Shannon Ewing Appoint to two-year term Kevin Hardwick Laura Kenney Appoint for one-year term Mike Ashmore Alyssa Hix Vote: Motion carried (6) ayes to (0) nays. 7.E. Consider and take action on the appointment of the Zoning Board of Adjustment Chair and Vice Chair. Motion: Council Member, Place 4 Hays made a motion seconded by Council Member, Place 2 Chapman to appoint Kevin Hardwick as Chair and Mike Ashmore as Vice-Chair of the Zoning Board of Adjustment.
