City of Bulverde, Texas City Council Meeting Tuesday, November 12, 2024 Meeting Duration: 6:30 PM to 9:29 PM CALL THE MEETING TO ORDER Mayor Bill Krawietz called the meeting to order at 6:30 PM. Members of City Council Present: Mayor Bill Krawietz Mayor Pro Tem Mark Morkovsky, Place 1 Council Member Yvonne Chapman, Place 2 Council Member Clint Hays Place 4 Council Member Joe Alexandre, Place 5 Council Member Christopher Goth, Place 6 Members of City Council Absent: Council Member Charles Hughes, Place 3 City Staff Present: City Manager Charles West, City Attorney Megan Santee, City Secretary Sandra V. Ham, Chief of Police Gary Haecker, Planning Director Danny Batts, Public Works Director Tim Parker, and Finance Director Sharon Nelson REPORTS AND PRESENTATIONS 2.A. Recognition of Court Clerk Olga Loera for five years of service to the City of Bulverde. Mayor Bill Krawietz presented a plaque of recognition to Court Clerk Olga Loera for her five years of service to the City. 2.B. Police Department: Summary of October 2024 Activities Report given by Police Chief Gary Haecker. 2.C. Finance Department: Monthly Financial Report Report given by Finance Director Sharon Nelson. 2.D. Public Works Department: Summary of October 2024 Activities Report given by Public Works Director Tim Parker. 2.E. Planning Department Update: Summary of October 2024 Activities Report given by Planning Director Danny Batts. 2.F. Parks & Recreation: Report from Parks & Recreation Advisory Board Report given by Parks & Recreation Advisory Board Member Daniel Schrubb. 2.G. Economic Development Foundation: Report for October 2024 Report given by Economic Development Foundation Executive Director Paula Stakes. CONSENT AGENDA ITEMS 3.A. Consider approval of the Regular City Council Meeting Minutes from October 8, 2024. 3.B. Consider approval of the Special City Council Meeting Minutes from October 29, 2024. 3.C. Discuss and consider a resolution of the City of Bulverde, Texas adopting an Investment Policy. 3.D. Receive the City of Bulverde Fiscal Year 2024 Investment Summary Report in compliance with the policies and strategies contained in the City of Bulverde’s Investment Policy and the Public Funds Investment Act (Chapter 2256). Motion: Mayor Krawietz made a motion seconded by Council Member, Place 2 Chapman to approve the Consent Agenda. Vote: Motion carried (6) ayes to (0) nays. REGULAR AGENDA ITEMS 4.A. Discussion and consider approval of a request by Mechelle Salmon, on behalf of the H.I.S. Centre, for a Parks Special Use Permits to host a Turkey Trot 5K on November 28th, 2024, at the City of Bulverde Community Park. Motion: Council Member, Place 2 Chapman, made a motion seconded by Council Member, Place 4 Hays, to approve a request by Mechelle Salmon, on behalf of the H.I.S. Centre, for a Parks Special Use Permits to host a Turkey Trot 5K on November 28th, 2024, at the City of Bulverde Community Park. Vote: Motion carried (6) ayes to (0) nays. Ordinance #779 4.B. Discuss and consider an ordinance of the City Council of the City of Bulverde, Texas, adopting the City of Bulverde Comprehensive Plan, Sunrise 2050: A New Day; adopting a severability clause and establishing an effective date. Freese & Nichols presented on the City of Bulverde Comprehensive Plan, Sunrise 2050: A New Day. Mayor Krawietz suggested another joint City Council and Planning & Zoning Commission meeting be held prior to the final approval. Motion: Council Member, Place 6 Goth, made a motion seconded by Council Member, Place 4 Hays, to table an ordinance of the City Council of the City of Bulverde, Texas, adopting the City of Bulverde Comprehensive Plan, Sunrise 2050: A New Day, until further notice. Vote: Motion carried (6) ayes to (0) nays. 4.C. Discuss and consider an ordinance of the City Council amending the City’s Building Codes to remove obsolete provisions and adopt the 2021 versions of the International Code Council’s (ICC) model codes. Motion: Council Member, Place 5 Alexandre made a motion seconded by Mayor Pro Tem, Place 1 Morkovsky to approve an ordinance of the City Council amending the City’s Building Codes to remove obsolete provisions and adopt the 2021 versions of the International Code Council’s (ICC) model codes. Vote: Motion carried (6) ayes to (0) nays. Ordinance #781 4.D. Discuss and consider direction to staff regarding a possible amendment to the development agreement between the City of Bulverde and Gerald H. Laubach, filed as Doc. No. 201606033061 in the records of the Comal County Clerk’s office, related to private street road standards. City Council provided direction to staff to bring forward for Council consideration a possible amendment to the development agreement between the City of Bulverde and Gerald H. Laubach. 4.E. Discuss and consider approval of a Resolution casting votes to elect Directors for the Comal Appraisal District for the years 2025 and 2025-2027. Motion: Council Member, Place 2 Chapman made a motion seconded by Mayor Krawietz to approve a resolution casting votes to elect Directors John Tyler (17 votes) and Robert Slupik (16 votes) for the Comal Appraisal District for the years 2025 and 2025-2027. Vote: Motion carried (6) ayes to (0) nays. Resolution #352 4.F. Presentation, continued discussion, and possible action on the 2025 Street Maintenance Plan. Public Works Director Tim Parker provided a presentation on the 2025 Street Maintenance Plan. Motion: Council Member, Place 4 Hays made a motion seconded by Mayor Kraweitz to approve the listed projects as stated for the 2024 Street Maintenance Plan. Vote: Motion carried (6) ayes to (0) nays. PUBLIC COMMENTS NOT RELATED TO POSTED AGENDA ITEMS Mayor Bill Krawietz opened the meeting for public comments not related to posted agenda items at 8:53 PM. There being no one wishing to speak, the public comments were immediately closed. REPORTS BY ELECTED OFFICIALS AND CITY STAFF ON ITEMS OF COMMUNITY INTEREST Mayor Krawietz praised the Bulverde Jubilee event and commended the parade. Chief Gary Haecker indicated staff were gearing up for the Annual Christmas Tree Lighting event. EXECUTIVE (CLOSED) SESSION At 8:55 PM the City Council convened into Executive Session to discuss the following: 7.A. Pursuant to Government Code 551.074, the City Council will deliberate in Executive Session regarding personnel matters pertaining to City Council Member, Place 3. ACTIONS ITEMS AFTER EXECUTIVE (CLOSED) SESSION At 9:28 PM the City Council reconvened from Executive Session and took the following action on items discussed in Executive Session. 8.A. Consider and take possible action to excuse absences for a member of the City Council. Motion: Mayor Pro Tem, Place 1 Morkovsky made a motion seconded by Mayor Krawietz to excuse absences for Council Member, Place 3 Hughes until further notice.
