Gretchen Mercer, City Clerk City of Canyon City Commission Meeting July 1, 2019 The City Commission of the City of Canyon met in regular session at 6:00 pm in the City Commission Chambers of the Civic Complex. Mayor Gary Hinders presided over the meeting with the following Commissioners in attendance, Mayor Pro-Tem Cody Jones, Roger Remlinger, Paul R. Lyons and Randy Ray. Also present were the following City Staff: Interim City Manager Jon Behrens and City Attorney Chuck Hester. Item 1. Call to Order. Mayor Hinders called the meeting to order at 6:00 p.m. Item 2. Invocation. Mayor Pro-Tem Jones gave the invocation. Item 3. Pledge of Allegiance. The Pledge of Allegiance was led by Commissioner Lyons. Item 4. Approval of Minutes of the City of Canyon Commission Meeting of June 17, 2019. Commissioner Ray moved, duly seconded by Commissioner Lyons to approve the minutes of June 17, 2019 as presented. Motion carried unanimously. Item 5. Public Comment – Comments from Interested Citizens. No comment was made. Item 6. Governor Abbott signed HB 2439 (attached) which becomes effective September 1, 2019. The bill prohibits cities from adopting or enforcing an ordinance that limits the installation a building product approved by a national model code. The City of Canyon has adopted the 2015 model codes as produced by the International Code Council. The 2015 International Building Code (2015 IBC), International Residential Code (2015 IRC), and International Plumbing Code (2015 IPC) as adopted by the City will be affected by this bill. The City of Canyon Zoning Code will also be affected. 1. Chapter 156, Zoning Code, Table 3-2, Building Materials. 90% masonry on the exterior front and side walls abutting public streets. (Any material allowed by the model code will be allowed. Including vinyl siding, hardy board, etc.) 2. Chapter 156, Zoning Code, Table 2-5, Building Materials. The use of metal, plastic, or fiberglass panels is prohibited on exterior wall of residences. (Same as above) 3. Chapter 150, Building Regulations, 2015 IBC, Table 1507.9.6. We have limited taper sawn shake shingles to #1 grade, the code allows #1 or #2 grade. (We also have the same amendment to the 2015 IRC) 4. Section 150.24, 2015 IRC, Tables P3002.1(1), P3002.1(2), and P3002.2. Cellular core PVC pipe is not allowed by our amendments. It is allowed by the model code. (We also have the same amendment to the 2015 IPC) Items 1 and 2 are probably of the most concern. The City has required 90% masonry exterior on walls abutting streets in the RC-1 (Retail), RC-2 (Commercial), and RC-3 (Central Area) Districts for several years. More recently, the City has adopted a rule that prohibits the exterior use of metal, plastic, or fiberglass panels on residences. The intent was to prohibit “Barndominium” or “Barn House” style construction. The Zoning Code will need to be amended to remove these restrictions. This item is for informational purposes only. Ordinances will be prepared and presented at a later date. We have prepared a budget workbook for you to review. We realize there is a lot of information in there to go over. I’ve prepared a PowerPoint presentation and we’ll go over the highlights of the budget during the work session. If you have questions before Monday’s meeting, please feel free to contact Jon or I. May 15 Deadline for submitting appraisal records to ARB July 20 Deadline for ARB to apprice appraisal records July 25 Deadline for chief appraiser to certify rolls to taxing units Certification of anticipated collection rate by collector Calculation of effective and rollback tax rates July 19 72-hour notice for meeting (Open Meetings Notice) July 22 Meeting of governing body to discuss tax rate Publish Notice of 2015 Tax Year Proposed Property Tax Rate for City of Canyon. Use the ad that will correspond to the proposed tax rate; if the proposed rate is at or below the effective tax rate, then use the shorter ad. Use the longer ad if the proposed rate will exceed the effective tax rate. This ad must be published by September 1st and 7 days before August 1 public hearing. It needs to be one quarter page or larger, the headline must be 24-point or larger, and it must not be published in the legal section. You must also post the notice on your website no later than September 1st and keep it posted until you have adopted.
