CITY COUNCIL MINUTES August 26, 2014 Continued Meeting of the Carterville City Council (Continued from August 12, 2014) The meeting was held in the Council Chambers with Mayor Bradley M. Robinson presiding. He called the meeting to order at 7:02 p.m. ROLL CALL Bradley M. Robinson Mayor Present Michele A. Others present were: Bill Kirk, Planning/Zoning Committee; Retia Watson, Clerk; Marvin Oetjen, Kamper Supply; Clifford Brady, 211 Scout Cabin Road; Michael and Pamela Greene, 302 Scout Cabin Road; Bruce Talley, Fire Chief; Ralph Graul, Building Inspector; Bud Edwards, Maintenance Superintendent; Bryn O’Neil, Christina Diamond, and Jason Sheraden, Fire Department Personnel; and Josh Bradley, City Attorney. The Mayor explained that the Council should make a decision regarding the two variance hearings that were held this evening. Clifford Brady, 214 Scout Cabin Road, is requesting a variance to place a double-wide mobile home in an R-1 zone. Michael and Pamela Greene, 302 Scout Cabin Road, are requesting an upgrade from single-wide to double-wide mobile home in an R-1 zone. Motion 35: Gentry moved and Emery seconded to allow the placement of a manufactured home on the empty lot owned by Clifford Brady at 214 Scout Cabin Road. A roll call vote was taken, and all present voted yea. The Mayor declared the motion carried. Continued Meeting of the Carterville City Council August 26, 2014 Page 2 Motion 36: Emery moved and Trombino seconded to allow the upgrade from a single-wide mobile home to a double-wide mobile home on property owned by Michael and Pamela Greene at 302 Scout Cabin Road. A roll call vote was taken, and all present voted yea. The Mayor declared the motion carried. The Mayor asked Clifford Brady and Michael and Pamela Greene to follow through with our Building Inspector to make sure they complete this process correctly. The Mayor introduced the new Williamson County Enterprise Zone ordinance for approval. This ordinance will extend the Enterprise Zone to 2021 (an additional five years). Motion 37: Gentry moved and Ellet seconded to pass Ordinance No. 1361-14, AN ORDINANCE TO EXTEND AND CLARIFY INCENTIVES OF THE WILLIAMSON COUNTY ENTERPRISE ZONE (CITY OF CARTERVILLE). All present voted yea, and the Mayor declared the motion carried. The Mayor asked Curt Oetjen to explain the review he completed on the diesel vs. gasoline for the new brush truck that the Fire Department is building. Oetjen agreed that a diesel engine is best for this vehicle. Bryn O’Neil explained that the total cost to date will be $77,259.00 and the department is asking for a contingency of 10% in case there are shipping charges they are not aware of, so they are asking for approximately $80,000.00. Helfrich asked why the increase from the last estimate of $73,300.00 and O’Neil explained that they found some additional charges because of paint, a receiver hitch, a spare time and some other incidentals. Motion 38: Oetjen moved and Ellet seconded to advertise for bids for the Ford F550 cab and chassis and approve up to $80,000.00 to complete this component of the new brush truck. A roll call vote was taken, and all present voted yea. The Mayor declared the motion carried. (Curt Oetjen asked that we run this ad on August 29, 30 and 31 if we can get bid specifications ready with bids due by September 15, 2014). The old brush truck has had tires replaced and is back in service. The Mayor circulated two ordinances for review on fences and pools and discussed the substance of the ordinances. The fence ordinance, for example, affects new fences and we cannot regulate fences that are already installed. There is a $20.00 permit required for both a fence and/or pool which will be issued by the Building Inspector. If the fence and pool are being installed at the same time there is only one $20.00 permit fee. No fence is required for above ground pools if the walls of the pool are at least 40” tall. If there is an existing pool that does not meet the new ordinance requirements, the owner will be given a deadline to comply with these new regulations. There is also a provision for fines from $1.00 to $500.00 if a homeowner does not comply with these regulations. Motion 39: Ellet moved and Trombino seconded to pass Ordinance No. 1362-14, AN ORDINANCE REGARDING SWIMMING POOLS. All present voted yea. And the Mayor declared the motion carried. Motion 40: Trombino moved and Emery seconded to pass Ordinance No. 1363-14, AN ORDINANCE REGARDING FENCE CONSTRUCTION, PLACEMENT, PERMIT FEES AND OTHER REQUIREMENTS.. All present voted yea, and the Mayor declared the motion carried. Continued Meeting of the Carterville City Council Tuesday, August 26, 2014 Page 3 Bud Edwards, Maintenance Superintendent, explained progress on the Wheelchair accessible swings. We received a grant in the amount of $7.392.71 for this project from the “Let Them All Swing” organization. The cost of the swings is $2,613.00, the ADA compliant concrete pad costs $6,504.00, and the ADA compliant padding required for this playground area costs $8,247.30 for a total of $$17,364.86. This means that we are $9,972.68 short of installation costs for these swings. Kyle Houseright has done a really good job of researching the ADA requirements for this project. Motion 41: Emery moved and Trombino seconded to proceed with the installation of the wheelchair accessible swings by contributing $9.972.65 to the project. A roll call vote was taken, and all present voted yea. The Mayor declared the motion carried. [Funds to be taken from the Park Fund and work should not begin until after the Carterville Free Fair]. Mayor Robinson told the Council that Bud Edwards and his crew have already received the swings and have primed and painted them to match our park equipment. Phyllis Emery asked about the carpeting at the Community Center and the Mayor responded that he is waiting to have a conversation with a donor to see if we can get this finalized. Phyllis Emery asked about the 409 Barr Street property and Josh Bradley stated that the judge has signed the order and is waiting for the order to be entered. The Mayor indicated that the Corbell buildings will be demolished by McVicker Excavating and is scheduled for later this week and it should be a two day job.
