October 7, 2021 Meeting Minutes [21-0849] A motion was made by Wortman, seconded by Godfrey, to approve the October 7, 2021 meeting minutes. The motion carried by a unanimous vote. Old Business New Business 2. Down Time Franklin Street, LLC Appeal of Staff Decision [21-0850] Anderson, Town Attorney, presented the Town Staff's case, including a motion to dismiss the case based on a lack of jurisdiction over building code violations. Mansor, the applicant, presented the argument for his appeal. A motion was made by Wortman, seconded by Hito, to adopt Resolution D, a resolution granting the Town Staff's motion to dismiss the appeal based on jurisdiction. The motion carried by the following vote: Aye: 7 - Chair Geoffrey Green, Vice-Chair Brian Godfrey, Thomas Grasty, Enton Hito, Katherine Murphy, Michael Murphy, and Thomas Wortman 3. Rules of Procedure Update [21-0851] McDonnell, Staff Liaison to the Board, presented an overview of proposed updates to the Board's Rules of Procedure. A motion was made by Godfrey, seconded by Grasty, to continue the item to the December 2, 2021 meeting. The motion carried by a unanimous vote.
