MINUTES CITY OF CHEROKEE VILLAGE, ARKANSAS REGULAR CITY COUNCIL MEETING 6: 30 P. M., THURSDAY, DECEMBER 17, 2020 CHEROKEE VILLAGE CITY HALL Meetings are video recorded) Mayor Stokes called the regular meeting of the City Council to order at 6: 30 p. m. on Thursday, December 17, 2020. Mayor led the Pledge of Allegiance followed by a moment of prayer. Roll was called by Clerk Deb Weichinger. Present were Jerry Adams, Les Covington, Carr Hill, Chuck Kristopeit, Thomas Rupard, Rob Smith, Steve Thompson, Mayor Russ Stokes and City Attorney Jon Abele. Present via Zoom: Pamela Rowland. APPROVAL OF THE AGENDA: Council Member Smith moved to approve the agenda, second by Council Member Adams and passed unanimously. David Woods asked to be removed from agenda new business and retained on old business. PUBLIC COMMENTS ON AGENDA ITEMS: ( limit 3 minutes per person) APPROVAL OF THE MINUTES ( November 19, 2020 and Special Budget Meeting December 10, 2020): Council Member Covington moved to approve the both council meeting minutes, second by Council Member Adams and passed unanimously. CORRESPONDENCE: None FINANCIAL REPORT: Council Member Smith moved to approve the November 2020 financials to be filed for audit, second by Council Member Adams. Roll call vote passed unanimously. MAYOR' S REPORT: Active virus cases in CV last week was 15; today there are 31 active cases The city has received $ 185, 000 in CARES Act money applied to purchase of: Fire Truck in 2023 Police Department vehicles in 2021 Christmas lighting contest is ongoing Welcome center will be open briefly between now and Christmas City received Grant of $ 32, 000 for Tohi Trail expansion. Council Member Adams, Karen Page, Street Superintendent Kyllo, Street and Committee Chairman Chuck McMahon will be working on and monitoring until project completion. Mayor recognized Council Member Les Covington who has served 8 years, and presented him with a plaque and bat. Les installed the TV and sound system at no cost to the city. COMMUNITY SERVICE: ( no file) DISTRICT COURT: ( report on file) FIRE: ( report on file) P & Z / CODE ENFORCEMENT: ( report on file) Notice of hearing: Hearing for Raze and Removal of Lot 12, Block 3, Lake Addition. City Inspector Thomas Swiatkowski stated no response has been received to three ( 3) notices sent. Mayor asked for a motion to resolve Raze and Removal. Council Member Adams moved to adopt resolution to raze and remove, seconded by Council Member Covington. Roll call vote passed unanimously. Resolution to order the Razing and Removal of a Nuisance on the Property City of Cherokee Village, Regular City Council Minutes of December 17, 2020 Lot 12, Block 3, Lake Addition to Cherokee Village Subdivision ( 23 Arrowhead Dr, Cherokee Village), Sharp County, Arkansas ( Leon Dallaiyan, owner). This will be Resolution 2020 - 15. Notice of hearing: Attorney Jon Abele asked council to approve resolution to collect for raze and removal of Lot 37, Block 13, Dakota Second Addition along with fines and fees. Mayor asked for a motion to approve resolution. Council Member Smith moved to adopt resolution to collect costs for raze and removal ($ 5, 021. 54), seconded by Council Member Adams. Roll call vote passed unanimously. Resolution to Authorize the Collection of Costs for the Razing and Removal of a Nuisance on the Property Lot 37, Block 13, Dakota Second ( 20 Pequot Dr) to Cherokee Village Subdivision, Sharp County, Arkansas ( Andrea Wolverton, owner). This will be Resolution 2020- 16. Reduction of OEM property Assets: Steve Thompson discussed recommendation; per the budget committee, three asset items to be removed from the city asset list: budget meetings; 32' trailer; boat and 2007 Dodge Charger. After much discussion, three different motions were made and voted upon: a. Motion by Council Member Thompson to sell 32' trailer, second by Council Member Covington. Roll call vote: Ayes: Covington, Rupard, and Thompson. Nayes: Adams, Hill, Kristopeit, Rowland, Smith. MOTION FAILED. b. Motion by Council Member Thompson to sell Skiff Boat, second by Council Member Covington. Roll call vote: Ayes: Adams, Covington, Hill, Rupard and Thompson. Nayes: Kristopeit, Rowland, and Smith. MOTION PASSED. c. Motion by Council Member Thompson to sell 2007 Dodge Charger, second by Council Member Covington. Roll call vote passed unanimously. Resolution 2020 - 17: A Resolution to Declare An Item Surplus Property and to Remove from City of Cherokee Village Property Asset List ( 1993 Munson 18' Skiff Boat w /Motor & 2007 White Dodge Charger): Items are to be sold as is by competitive bid Motion was made by Council Member Adams, second by Council Member Covington to approve Resolution No 2020- 17. Roll call vote passed unanimously. NEW BUSINESS: Proposed Ordinance 2020 -xx: An Ordinance to Amend Zoning Code ( 2017 - 06A) and for Other Purposes: The proposed ordinance was read in full by the Clerk. After some discussion Council Member Covington motioned recommending the ordinance to be sent back to Planning & Zoning, second by Council member Thompson. Roll call vote passed unanimously. Noted changes: Parking proportioning to landscaping excess. 2'— 3' is adequate in item # 2 Reconsider 18' canopy with the last sentence of item # 3 City of Cherokee Village, Regular City Council Minutes of December 17, 2020 Need to delete item # 8 as it is repetitive.
