4 TOWN OF CICERO TOWN COUNCIL MEETING MINUTES September 16, 2014 At 7:00 PM Call To Order: President Dennis Schrumpf called the meeting to order and led the Pledge of Allegiance. Brett Foster gave the prayer. President Schrumpf called for the roll call and the members of the Town Council were present or absent as follows: Present: Dennis Schrumpf Absent: Jerry Cook Brett Foster Kay Hartley Eric Hayden President Schrumpf declared a quorum present. Others Present: Jan Unger, Clerk Treasurer Charlie Cambre, Park Superintendent Pat Comer, Street & Utilities Director Dave Hildebrand, Police Chief Paul Munoz, Cicero Jackson Township Plan Commission Director Kelleigh Fagan, Town Attorney Keith Bryant, Town Engineer Approval of Agenda: Mr. Schrumpf stated that the Interlocal Agreement By And Between The Town Of Cicero And Jackson Township was not ready yet and he is removing that item from the agenda. Mr. Hayden made a motion to approve the Agenda as amended. Mr. Foster seconded, motion passed. Public Hearing On Ordinance 08-05-2014-1 Establishing Municipal Water Rates. Ms. Hartley made a motion to open the Public Hearing on Ordinance 08-05-2014-1 Establishing Municipal Water Rates. Mr. Hayden seconded, motion passed. Mr. Schrumpf inquired if there were any public comments or questions and there were none. Mr. Foster made a motion to close the Public Hearing. Mr. Cook seconded, motion passed. Public Hearing On Ordinance 08-05-2014-2 Establishing Municipal Wastewater Rates. Mr. Hayden made a motion to open the Public Hearing on Ordinance 08-05-2014-2 Establishing Municipal Wastewater Rates. Mr. Foster seconded, motion passed. Mr. Schrumpf inquired if there were any public comments or questions. Mr. Bruce Freeman inquired as to what the increase would be. Mr. Schrumpf stated that the rate for up to 5,000 gallons would go from $8.17 to $8.29 per 1,000 gallons. There were no further questions. Ms. Hartley made a motion to close the Public Hearing. Mr. Hayden seconded, motion passed. 1 Public Hearing On Ordinance 08-05-2014-4 Establishing Trash Rate. Mr. Hayden stated that the Trash bill would be going from $11.00 per month to $11.50 per month. Ms. Unger stated that we looked into trying to keep the cost the same but did not want to reduce benefits and there just was no way to do it. Mr. Hayden made a motion to open the Public Hearing on Ordinance 08-05-2014-4 Establishing the Trash Rate. Mr. Foster seconded, motion passed. Mr. Schrumpf inquired if there were any public comments or questions and there were none. Mr. Hayden made a motion to close the Public Hearing. Mr. Cook seconded, motion passed. Approval of Prior Minutes: Town Council Meeting Minutes, September 2, 2014, 7:00 PM – Mr. Hayden made a motion to approve the September 2, 2014 Town Council Meeting Minutes as presented. Ms. Hartley seconded, motion passed. Approval of Claims: Mr. Cook made a motion to approve the claims as presented including the claims for the Sewer Construction Bond Account. Mr. Foster seconded, motion passed. Petitions by Citizens: There were none. President’s Report: President Schrumpf had nothing this evening. Council Committee Reports: There were none. Legal Counsel Report- Kelleigh Fagan: Ms. Fagan stated that she didn’t have anything Cicero/Jackson Township Plan Commission Report 1. Mr. Munoz informed the Council that his secretary was reviewing their files and found that they did not have a Certificate of Appointment for Art Hall, which should have been reappointed in January 2014 and for Dan Strong which should have been appointed in January 2011. Mr. Munoz stated that he would like to have signed Certificates of Appointment for both and both were appointed by executive of the council. Mr. Schrumpf stated that he agreed with those appointments and would sign the certificates. Town Engineer Report-Mr. Keith Bryant – Mr. Bryant addressed the following: 1. Cicero Jackson Street Pedestrian Walkway – Mr. Bryant stated that next week United would inspect the plantings to see if they were all okay and then they would proceed with the final inspection for the project. 2. I & I Project – CAT Excavating was to be back in town this week but have rescheduled their final section to be started next week. 3. CVS – Mr. Bryant stated that they have met with CVS and they will be fixing the shoulder and repairing the asphalt. This will finish up that project. 4. HAND – Mr. Bryant stated that they have met with HAND and went over the punch list. There are three items left and when they are completed the project will be finished. 2 Old Business: Council To Consider Ordinance 08-05-2014-1 Establishing Municipal Water Rates. Mr. Schrumpf read the Ordinance by number and title. Mr. Hayden made a motion to approve Ordinance 08-05-2014-1 Establishing Municipal Water Rates. Mr. Cook seconded, motion passed. Council To Consider Ordinance 08-05-2014-2 Establishing Municipal Wastewater Rates. Mr. Schrumpf read the Ordinance by number and title. Ms. Hartley made a motion to approve Ordinance 08-05-2014-2 Establishing Municipal Wastewater Rates. Mr. Foster seconded, motion passed. Council To Consider Ordinance 08-05-2014-4 Establishing Trash Rate Mr. Schrumpf read the Ordinance by number and title. Mr. Foster made a motion to approve Ordinance 08-05-2014-4 Establishing The Trash Rate. Mr. Cook seconded, motion passed. New Business There was none. Miscellaneous 1. Mr. Cook asked Major Hunter to address the new Cross at the Cicero Cemetery. Major Hunter informed the Council that the Cross was from the old St. Vincent’s Hospital. The Cicero Catholic Church approached the Cemetery Board and asked if they would be interested. They worked together to accomplish the project. 2. Mr. Hayden stated that the reason for the increases in the water and wastewater rates was to keep up with inflation and so there would not be an increase in rates all at once. Mr. Schrumpf stated that Deen Rogers with Umbaugh was present this evening and stated one community had a 104% increase because they had not kept up with their increased costs. Mr. Rogers stated that additionally this community did not get a very good bond rating. Mr. Rogers stated that he thought Cicero has setup a model for keeping rates current. 3. Mr. Rusty Miller informed the Council that Cicero Kiwanis will be having the Christmas Parade on December 6th at 1:00 PM. Mr. Miller stated that the police have been notified and that they are good to go. 4. Mr. Cambre reminded the Council of the State Chili Cook Off on September 20th. They still need judges and if anyone is interested, they should show up at noon. They expect 20 State Chili Cookers. Comments from the Public There were none. Signatures on Official Documents!
