4 TOWN OF CICERO TOWN COUNCIL MEETING MINUTES October 7, 2014 At 7:00 PM Call To Order: President Dennis Schrumpf called the meeting to order and led the Pledge of Allegiance. President Schrumpf gave the prayer. President Schrumpf called for the roll call and the members of the Town Council were present or absent as follows: Present: Dennis Schrumpf Absent: Jerry Cook Brett Foster Kay Hartley Eric Hayden President Schrumpf declared a quorum present. Others Present: Jan Unger, Clerk Treasurer Pat Comer, Street & Utilities Director Dave Hildebrand, Police Chief Paul Munoz, Cicero Jackson Township Plan Commission Director John Culp, Town Attorney Kelleigh Fagan, Town Attorney Paul Utterback, Storm Water Management Board President Approval of Agenda: Mr. Schrumpf stated that he was removing the discussion on the Docks from the Agenda and under new business he was adding a Discussion On Holiday Lights. Ms. Hartley made a motion to approve the Agenda as stated by Mr. Schrumpf. Mr. Cook seconded, motion passed. Public Hearing On Town of Cicero 2015 Budget. Mr. Hayden made a motion to open the Public Hearing. Mr. Foster seconded, motion passed. Ms. Unger read the proposed Cicero 2015 Budget. Mr. Schrumpf inquired if there were any questions. Mr. Cook stated that he thought the County requested that the budget not be increased over 5%. Ms. Unger stated that in fact the General Fund budget was reduced and that most of the increase was due to CCD and CCI increases because last year very little was budgeted in those funds. Mr. Cook made a motion to close the Public Hearing. Ms. Hartley seconded, motion passed. Mr. Schrumpf inquired if there was further discussion. Mr. Hayden wondered why the Assessed went down. Ms. Unger stated that it actually went up but this was for advertising purposes only so the Town could get the tax rate approved by the state. The Town could always lower the tax rate but it could not be higher than the advertised amount. Public Hearing On Ordinance 10-07-2014-1 Additional Appropriation For Parks. Mr. Hayden made a motion to open the Public Hearing on Ordinance 10-07-2014-1 Additional Appropriation For Parks. Mr. Foster seconded, motion passed. Mr. Schrumpf 1  stated that the reason for this additional appropriation was for the Parks Department to purchase more fuel for sale. Mr. Schrumpf inquired if there were any questions. There were none. Mr. Cook made a motion to close the Public Hearing. Mr. Hayden seconded, motion passed. Approval of Prior Minutes: Town Council Meeting Minutes, September 16, 2014, 7:00 PM – Ms. Hartley made a motion to approve the September 16, 2014 Town Council Meeting Minutes as presented. Mr. Cook seconded, motion passed. Approval of Claims: Mr. Cook made a motion to approve the claims as presented. Ms. Hartley seconded, motion passed. Petitions by Citizens: There were none. President’s Report: President Schrumpf had nothing this evening. Council Committee Reports: EDC - Presentation on the Project at Jackson St. and Main St. Mr. Munoz stated that this was going to be delayed to October 21st. Legal Counsel Report- John Culp 1. Mr. Culp addressed the Jointer Agreement between Cicero and Jackson Township for Zoning, Subdivision, and Planning. Mr. Culp stated that the original agreement was signed in 1975 by the Council and Jackson Township for planning purposes. Mr. Culp stated that the process of the agreement now, by state statute, should be that it goes to the Plan Commission first, then to the Town Council and then to Jackson Township. Mr. Culp informed the Council that Chris Miller, Jackson Township Trustee, called and said she had not seen the agreement before the Plan Commission Meeting which addressed the agreement. Mr. Culp stated that he should have given her a copy. Mr. Munoz informed the Council that he spoke with Ms. Miller today. She was not sure why Hamilton County did not do their planning. Ms. Miller did not know that the 1975 agreement was in place prior to Hamilton County taking on the Cicero/Jackson Township Plan Commission. It was first with Cicero, then Hamilton County and currently back to Cicero. Mr. Culp stated that Jackson Township has representation on the Plan Commission. Mr. Culp stated that he has the statute numbers if anyone would like to see them. Ms. Hartley inquired if this agreement included Arcadia and Atlanta. Mr. Culp stated no, that they had their own Plan Commission which included a 2 mile radius around the incorporated towns. Mr. Culp stated that the Plan Commission has reviewed the agreement and will make a recommendation to the Council at the next meeting. 2. Condo Project – Mr. Culp stated that he would like to request an executive session to address some questions that have come up regarding a settlement on this project. 3. FEMA – Mr. Culp stated that FEMA is not satisfied with the Ordinance the Town signed to receive Flood Insurance. Ms. Fagan and Mr. Culp agreed that our agreement contains all of the substance that is required but the format is not exactly the same. They will contact FEMA tomorrow to get the wording exactly as they want it and the Council can pass at the next meeting. Mr. Munoz stated that particularly the signature page needed to be in the format they request. Cicero/Jackson Township Plan Commission Report 1. Mr. Munoz stated that he did not have anything 2 Town Engineer Report-Mr. Keith Bryant – Mr. Bryant was not available but submitted the following report. : Town of Cicero October 7, 2014 Town Council Meeting Engineer’s Report 1. Jackson Street Pedestrian Path Project –The plantings inspection and final INDOT walk through to be scheduled. A meeting with Mr. Mack with Frontier will be held on October 9 at the Town Hall to discuss their invoice and claim that exceeded their Utility Reimbursement Agreement. 2. Cicero –Downtown Sewer Improvements (I & I): The contractor has been working in the alley south of Jackson Street from Main Street eastward. They are nearly to Pearl Street and anticipate completion of the work next week. They have a lot of claims for unforeseen items that we are evaluating and comparing to the contractual requirements. Once completed, this will be presented to the Town Council. As always, feel free to contact me via phone or email should any questions arise between now and the next Council Meeting. Keith Bryant, PE United Consulting Old Business: Council To Consider Ordinance 10-07-2014-1 Additional Appropriation For Parks. Mr. Schrumpf read the ordinance by number and title. Mr. Foster made a motion to approve Ordinance 10-07-2014-1 Additional Appropriation For Parks in the amount of $20,000 for additional fuel for sale. Mr. Cook seconded, motion passed. Council To Discuss Response Letter From The Indiana Transportation Museum Regarding Crossing Conditions. Mr. Schrumpf informed the Council that they had received a response back from the Indiana Transportation Museum regarding repair of certain crossings on Cicero streets. They are requesting a meeting. Mr. Comer said that he has also spoken with them regarding this issue. Mr. Comer said he told them that the Town could not pay for the repairs. Mr. Comer stated that the project on Brinton Street cost more than was planned for and took money away from other repairs that were needed. There is no budget for these repairs. Mr. Rusty Miller injected that he thought the Port Authority had jurisdiction over the Rail Road. Mr. Culp stated that is correct but letters were sent to both the Indiana Transportation Museum and the Port Authority. Mr. Culp stated that there were three owners of the Port Authority: Fishers, Noblesville, and Hamilton County. Ms. Hartley inquired as to who paid for all of the work on the tracks in downtown Noblesville? Mr. Culp stated that he did not know but he was going to find out. Mr. Schrumpf inquired who should be at the meeting besides he and Mr. Comer. Mr. Culp stated that he would like to be there. Council To Approve Exhibit B Contract For Solid Waste/Recycle Collection And Disposal In The Town of Cicero, Indiana. 3  The Council approved continuing with Republic on June 17th, 2014 but the contract is just now being presented for approval. Mr. Foster made a motion to approve the Contract with Republic for solid waste/recycle collection for 2015, 2016, and 2017. Mr. Cook seconded, motion passed. Council To Consider Agreement With County For Fire Radios. Mr. Hayden made a motion to table. Mr. Cook seconded, motion passed. New Business Council To Consider Offering American Fidelity Products To Employees. Mr. Schrumpf stated that American Fidelity is endorsed by IACT for supplemental benefits. Police Chief Hildebrand informed the Council that a representative from American Fidelity Products reviewed the products with the department heads. AF is similar to IACT and one of the points that seemed interesting was the long term disability. They also offer accident and sickness benefits. Ms. Unger stated that they offer flexible spending accounts and the law has changed so $500 could be carried over to next year. Ms. Unger stated that she and Ms. Denham liked the Section 125 Plan that they would administer for the Town and they also put together an employee benefit guide. Ms. Hartley made a motion to allow American Fidelity Products to be offered to the Town employees. Mr. Foster seconded, motion passed. Council To Consider Town Of Cicero Credit Card Policy To Backup Ordinance 10-07-2008-2 An Ordinance Authorizing The Acquisition of Credit Cards For The Town Of Cicero. There was a discussion and the Council wanted to include additional disciplinary actions in the document. Ms. Hartley made a motion to table for corrections. Mr. Cook seconded, motion passed. Council To Consider Renewal Of Maintenance Contract With ESRI (GIS Program) And Approve Mr. Schrumpf To Sign. Ms. Unger stated that she forwarded the document to the utilities department for review. This is the program for our GIS mapping and utilities stated that they needed the maintenance agreements so they could receive their updates. Mr. Cook made a motion to approve the ESRI Maintenance Contract and approve Mr. Schrumpf to sign the document. Mr. Hayden seconded, motion passed. Council To Discuss Holiday Decorations On the Downtown Light Poles. Ms. Unger informed the Council that she and Mr. Comer discussed the holiday decorations we put on the downtown light poles and Mr. Comer suggested that we purchase 6 new wraps. The current wraps are getting old and we want to make sure we have replacements if needed. Ms. Unger also stated that she and Mr. Comer discussed the new poles across the causeway. The wraps are $105 each. In addition to the issue of money is the logistics of getting the wraps on the poles. Mr. Comer stated that the poles were on the outside of the railing and they would probably have to use a lift from the road. Mr. Foster stated that he thought we should do something. Mr. Hayden stated that he has already been asked about the lights. Ms. Hartley made a motion to approve purchasing 6 wraps as backups for the downtown light poles and wait on the others. Mr. Cook seconded, motion passed. 4 Miscellaneous 1. Mr. Culp informed the Council that IACT was sponsoring a webinar with State Fire Marshal Jim Greeson on October 14th to discuss a variety of fire and Emergency Medical Service issues that impact local elected officials. This webinar will discuss the top 10 points that should be included in a contract with a volunteer fire department, what training is required for firefighters, and the minimal fire protection delivery model and impact on insurance premiums. Additional speakers will be John Buckman, Director of Training, Indiana Department of Homeland Security and Robert Johnson, Assistant State Fire Marshal. 2. Mr. Rusty Miller informed the Council that Tony Cook will be the Grand Marshal for the Christmas Parade sponsored by Cicero Kiwanis on December 6th at 1:00 pm. 3. Mr. Comer informed the Council that the grinding was completed on the sidewalks regarding the trip hazards. Mr. Hayden thought they did a good job. Comments from the Public There were none.
