TOWN OF CICERO TOWN COUNCIL MEETING MINUTES TUESDAY, JULY 7, 2020 at 7:00 PM Call to Order: President Strong called the meeting to order and led the Pledge of Allegiance. Mr. Taylor gave the prayer. President Strong continued with roll call. Members were present or absent as follows: Present: Jerry Cook Absent: Chad Amos Chris Lutz Jack Russell Dan Strong President Strong declared a quorum present. Others Present: Rhonda Gary, Clerk Treasurer Terry Cooper, Street & Utilities Director Lance Overholser, Fire Chief C.J. Taylor, Cicero/Jackson Township Plan Commission Director Aaron Culp, Town Attorney Keith Bryant, Town Engineer Approval of Agenda: Mr. Russell made a motion to approve the agenda as amended. Mr. Lutz seconded, motion passed. Approval of Prior Minutes: Staff Meeting Minutes June 11, 2020, 6:00 PM – Mr. Cook made a motion to approve the 6/11/ 2020 Staff Meeting Minutes. Mr. Lutz seconded, motion passed. Town Council Meeting June16, 2020, 7:00 PM – Mr. Lutz made a motion to approve the 6/16/2020 Council Meeting Minutes. Mr. Cook seconded, motion passed. Approval of Claims: Mr. Russell made a motion to approve claims dated 7/7/2020. Mr. Lutz seconded. Motion passed. Council Committee Reports: 1. OTC Report – Nothing 2. EDC Report – Nothing 3. SWU Management Board Report – Nothing Legal Counsel Report- Aaron Culp: 1. Mr. Culp advised that a property owner is appealing their stormwater assessment. He stated that the appeal would be reviewed by the Stormwater Utility Board which would then issue a written determination. If the appealing party disagrees with the Board's determination, the matter could then be appealed to the town council. Mr. Culp stated that it might be necessary to engage outside counsel to assist during this process. He advised that the appealing party has requested a continuance meaning the matter would not be considered until a later date. 2. Mr. Scearce is trying to sell the property but has had no luck. At this point, he is not in 1 a position to do anything. Mr. Scearce was given more time to rectify the situation. If not able to rectify, the council will consider demolition. Reset this for August meeting. Cicero/Jackson Township Plan Commission Report-C.J. Taylor Permit Revenue: June 2020 = $6,611 YTD: $39,305 June 2019 = $7,414 YTD: $37,086 Difference: Month = $803 YTD: $2,219 A total of 24 building permits were issued for June 2020, eighteen inside the corporate limits (four were new homes) and 6 in Jackson Township (one was a new home). Plan Commission has been working with Mr. Culp to get some unsafe buildings removed. There will be more to come soon. In addition, we have started sending non-compliance letters to some properties that need cleaned up. Town Engineer Report-Mr. Keith Bryant – 1. Update on E. Jackson Street Project – Mr. Lutz made a motion to approve Pay Application #11, Change Order #3 and allow Mr. Strong to sign completion form. Mr. Russell seconded, motion passed. 2. Tamarack – Construction in Section 3 continues, but the drainage issue has not been addressed. 3. I & I Project – Mr. Lutz made a motion to approve Pay Application No. 6. Mr. Russell seconded, motion passed. Mr. Lutz made a motion to approve Change Order #1. Mr. Cook seconded, motion passed. 4. SRF – Mr. Bryant distributed and briefly discussed an Asset Management Plan for the wastewater system. Mr. Lutz made a motion to approve the agreement with United Consulting but would like for Mr. Culp and Mr. Cooper to review the plan. Mr. Russell seconded, motion passed. Old Business: 1. Ordinance No 06-16-2020-01 PUD amendment – Council awaits clarification on the trail going across Mr. Wilson’s property. Mr. Russell made a motion to table. Mr. Cook seconded, motion passed. New Business 1. Resolution 07-07-2020-1 – Transfer funds from MVH to WW (vehicle purchase). Mr. Cook made a motion to approve Resolution 07-07-2020-1. Mr. Russell seconded, motion passed. 2. Ziptility – CJ – Budget Increase (Police, Fire, Council) - Mr. Taylor gave a brief description of the proposed GIS software. Town Council will also contribute $1,000.00 towards Ziptility purchase. Mr. Lutz made a motion to approve budget increases for the purchase of Ziptility contingent on Mr. Culp and Mr. Bryant’s review. Mr. Russell seconded, motion passed. 3. Parks Dept – Budget Transfer – Transfer to Playground Equipment is allowed in the 2021 proposed budget. Mr. Russell made a motion to approve the quote from NM Builders for the park building as well as the quote from Prater & Sons for the concrete slab. Mr. Cook seconded, motion passed. 4. Mr. Green – back yard flooding – Mr. Green was present to inform the town of the flooding in his back yard which he believes to be caused by the work that 3D is doing. Mr. Bryant will investigate and hopefully have answers at the next council meeting. 5. Shae – COVID-19 Resolution – Signed by President Strong. 2 6. Railroad Crossing – Mr. Cook noted that the railroad crossing on Jackson Street could use some attention. Mr. Russell will take a look at it and get back with the council. 7. Pool – Mr. Cook noted that he’s been keeping an eye on the pool, and it doesn’t seem to have lost any water. He didn’t know if that is a result of the heavy rains that we’ve had or it’s just not losing any water. Mr. Schrumpf stated that the reason could be that nothing is running right now. 8. Community Park Task Force – Mr. Russell stated that he has a task force in place for the good of the park. They will put together a master plan for the Parks Department. Miscellaneous 1. Interlocal Agreement – Mr. Culp presented a revised Interlocal Agreement for the town’s approval. Mr. Lutz made a motion to approve the revised Interlocal Agreement. Mr. Cook seconded, motion passed. 2. Arcadia would like to send a letter to the Town of Cicero thanking us for the mutual aid provided by the town’s Water and Wastewater Utility workers.
