TOWN OF CICERO TOWN COUNCIL MEETING MINUTES TUESDAY, JANUARY 3, 2023 at 7:00 PM Call to Order: Vice President Blueher called the meeting to order and led the Pledge of Allegiance. Ms. Gary gave the prayer. VP Blueher called for roll call. Members of the Cicero Town Council were present or absent as follows: Present: Chad Blueher Absent: Christopher Lutz Jerry Cook Joseph Cox Eric Hayden Declare a Quorum Present: VP Blueher declared a quorum with four members present. Others Present: Rhonda Gary, Clerk Treasurer Jeff Rednour, Police Chief Lance Overholser, Fire Chief Frank Zawadzki, Cicero/Jackson Township Plan Commission Director Terry Cooper, Street & Utilities Director Jim Hunter, Parks Superintendent Aaron Culp, Town Attorney Keith Bryant, Town Engineer Bruce Freeman, Storm Water Management Board President Approval of Agenda: Mr. Cook made a motion to approve the agenda as amended. Mr. Cox seconded, motion carried. 1. Election of Officers: a. President of the Council – Motion to Open Nominations – Mr. Hayden, 2nd – Mr. Cook, motion carried. Mr. Cook nominated Mr. Blueher for Cicero Town Council President, Mr. Blueher accepted. There were no other nominations. Motion to Close Nominations – Mr. Hayden, 2nd – Mr. Cook, passed. Mr. Hayden made a motion to elect Mr. Blueher as Cicero Town Council President. Mr. Cox seconded, motion carried. b. Vice President of Council – Motion to Open Nominations – Mr. Hayden, 2nd – Mr. Cook, passed. Mr. Cox made a motion to nominate Mr. Lutz for Cicero Town Council Vice President. Mr. Cook seconded, motion carried. There were no other nominations. Motion to Close Nominations – Mr. Hayden, 2nd – Mr. Cook seconded, motion carried. Mr. Cox made a motion to elect Mr. Lutz as Cicero Town Council Vice President. Mr. Cook seconded, motion carried. 1 c. Appoint 2023 Department Heads – Town Council Appointments: President Blueher made a motion to retain all department heads from 2022. Mr. Cook seconded, motion carried. They are as follows: Fire Chief – Mr. Overholser Police Chief – Mr. Rednour Street/Utilities Director – Mr. Cooper Plan Commission Director – Mr. Zawadzki Parks Superintendent – Mr. Hunter Town Council President Liaison Appointments: President Blueher appointed the following liaisons: Fire Department – Mr. Hayden Police Department – Mr. Cox Street/Utilities – Mr. Cook Plan Commission – Mr. Lutz Parks Superintendent – President Blueher Other Appointments Appointments to the Cicero Fire Commission – 4-year term. - President Blueher reappointed Mr. Bowman to the Cicero Fire Commission. - Mr. Hayden made a motion to reappoint Mr. Heaver to the Cicero Fire Commission. Mr. Cook seconded, motion carried. - Fire Department Appointment – Chief Overholser will follow up with Mr. Whitehead. The Cicero Metropolitan Police Commission – 3-year term Mr. Cook made a motion to reappoint Mr. Miller to the Cicero Metropolitan Police Commission. Mr. Cox seconded, motion carried. Plan Commission – 4-year term - Mr. Cox made a motion to appoint Mr. Scrumpf, Mr. Lutz and Mr. Hayden to the Cicero Plan Commission. Mr. Cook seconded, motion carried. - President Blueher then appointed Mrs. Burkhardt, Mr. Diller, Mr. Massonne and Mr. Strong to the Cicero Plan Commission. BZA Appointment – 4-year term - Mr. Cook made a motion to appoint Mr. Zell to the BZA. Mr. Cox seconded, motion carried. - President Blueher appointed Mr. Schrumpf to the BZA. Cicero Economic Development Committee (EDC) – 2-year term - President Blueher appointed Mr. Mann to the EDC. - Mr. Hayden made a motion to appoint Mr. McDonald and Ms. Zupin to the EDC. Mr. Cook seconded, motion carried. 2 Cicero Redevelopment Commission- 3 presidential appointments/2 council appointments Chad Blueher – President Appointment Jerry Cook – President Appointment Joe Cox – Council Eric Hayden – Council Chris Lutz – President Appointment Appointment to Storm Water Management Board – 3-year term Mr. Mehlan was retained for a three year term at the SWU Meeting last week. Appointment to the Hamilton County Emergency Management Advisory Council. Mr. Hayden made a motion to retain Chief Overholser as the Hamilton County Emergency Management Advisory Council. Mr. Cook seconded, motion carried. Approval of Prior Minutes: Town Council Meeting Minutes, December 28, 2022, 9:30 AM Mr. Cook made a motion to approve the 12/28/2022 Town Council meeting minutes. Mr. Hayden seconded, motion carried. Approval of Claims: There were no claims. Council Committee Reports: 1. OTC Report – President Blueher stated that he has nothing new at this time. He also stated that OTC would like to thank the town for the support during the Christmas festivities. 2. EDC Report – Mr. Cox reported that they are meeting on 1/4/23 to elect a new president and vice president. He also reported that they will be reviewing the RFIs from the parking study. 3. SWU Management Board Report – SWU President Freeman stated that he has nothing new to report. Legal Counsel Report – Mr. Culp had nothing at this time. Cicero/Jackson Township Plan Commission Report – Director's Report - December 2022 Permit Revenue: December 2022 = $5,279 YTD: $175,329 December 2021 = $11,982YTD: $152,859 Difference: Month = -$6,703 YTD: $22,470 A total of 18 building permits were issued in December, 2022. Twelve were inside corporate limits (of which three were for new homes). Six permits were issued in Jackson Township (of which, 0 new homes). Estimated Cost of projects permitted $904,815 Additional updates – a. Auburn Estates – 62 lots in section 1, all have been permitted. b. Tamarack Section 4 – 69 lots, 15 left to be permitted. 3 Town Engineer Report – 1. Tamarack – Mr. Bryant stated that there is nothing new with Tamarack or Auburn Estates since the last meeting. 2. Water – Mr. Bryant reported that they are still waiting to do testing on the third wellsite. 3. Wastewater – Mr. Bryant said that they are proceeding with the design. Mr. Hayden inquired about a construction period for the new plant. Mr. Bryant guessed about a year to 18 months. Mr. Culp inquired about the bonding process. Mr. Bryant guessed sometime in March would be the appropriate time to begin the process. Old Business: 1. BerryComm – Mr. Lambert was present to address concerns about disrepair and sink holes believed to be caused by BerryComm. Mr. Lambert was apologetic and assured the council that they will address concerns as soon as possible. He also asked that the town contact him immediately when there is a concern. Moving forward, Mr. Cooper will be the first line of communication to report any issues. Mr. Lambert believes that the lag in service was mostly due to miscommunication. He assured the council that he plans to oversee the remaining installation. In addition, he also believes that Mr. Lynch with BizServ is involved and probably should have been from the beginning. His involvement has made this a smoother process. New Business: 1. Encumbrances – Ms. Gary distributed a memo to the council for the encumbrances from the 2022 appropriations. a. General 1101370404 Vehicle Equipment $5,700.00 b. General 1101069443 Phone System $24,000.00 c. General 1101370403 Police Vehicles $6,653.57 2. Appointment – Mr. Cox made a motion to appoint Mr. Strong to the position of Cicero Project Coordinator. Mr. Cook seconded, motion carried. Miscellaneous: There was nothing.
