TOWN OF CICERO TOWN COUNCIL MEETING MINUTES TUESDAY, OCTOBER 17, 2023 at 7:00 PM Call to Order: President Blueher called the meeting to order and led the Pledge of Allegiance. Ms. Gary gave the prayer. President Blueher called for roll call. Members of the Cicero Town Council were present or absent as follows: Present: Chad Blueher Absent: Dennis Johnson Joseph Cox Eric Hayden Christopher Lutz Declare a Quorum Present: President Blueher declared a quorum with four members present. Others Present: Rhonda Gary, Clerk Treasurer Jeff Rednour, Police Chief Lance Overholser, Fire Chief Frank Zawadzki, Cicero/Jackson Township Plan Commission Director Terry Cooper, Street & Utilities Director Jim Hunter, Parks Superintendent Aaron Culp, Town Attorney Keith Bryant, Town Engineer Bruce Freeman, Storm Water Management Board President Dan Strong, Project Coordinator Approval of Agenda: Mr. Hayden made a motion to approve the agenda as written. Mr. Cox seconded, motion carried. Approval of Prior Minutes: Town Council Meeting Minutes, October 3, 2023, 7:00 PM Mr. Hayden made a motion to approve the minutes from the 10/3/23 council meeting. Mr. Lutz seconded, motion carried. Approval of 10/17/23 Claims: Mr. Lutz made a motion to approve the claims dated 10/17/23. Mr. Hayden seconded, motion carried. Council Committee Reports: 1. OTC Report – President Blueher reported that OTC is meeting tomorrow evening (10/18/23). He plans to address policy concerns with them at that time. 2. EDC Report – Mr. Cox stated that EDC did not meet this month. He also stated that there are still two vacant seats available. 3. SWU Management Board Report – SWU President Feeman said that he had nothing new to report and that Mr. Bryant will give an update on Brinton Street in his report. Legal Counsel Report – Mr. Culp had nothing at this time. 1 Cicero/Jackson Township Plan Commission Report – Mr. Zawadzki had nothing at this time. Town Engineer Report – Keith Bryant 1. Tamarack – Mr. Bryant reported that there is no change as the punch list is not complete for Sections 1-3. United is awaiting response and completion confirmation from MI Homes. 2. Auburn Estates – Mr. Bryant reported that he is still waiting for the final maintenance bond as Section 1 is complete. 3. Water – Mr. Bryant stated that there is no update as they are still looking for sites. 4. Wastewater – Mr. Bryant said that he is working with Reynolds on the BOT project. The next meeting will be scheduled soon. 5. Tollgate Road – Mr. Bryant relayed that the trees on the SE side have been cleared. They are waiting for a construction schedule from the contractor. 6. Brinton Street Storm Water Rehab Project – Mr. Bryant stated that he is waiting for information from Insituform on the change request. He also stated that they need to finish paving. 7. Stringtown Pike – Mr. Bryant asked Council’s approval for the final pay application to Grady Brothers. Council inquired about the warranty for the additional work. Mr. Bryant said that there will be a standard one-year warranty for the additional work. Grady Brothers have placed this in writing. Mr. Lutz made a motion to release Final Retainage/Pay Application to Grady Brothers. Mr. Cox seconded, motion carried. Old Business: Approval of Water & Sewer 2024 Budgets – Mr. Hayden made a motion to approve Ordinance 10-17-2023-03 Operating Budgets for the Water and Wastewater Treatment Company for the year 2024. Mr. Cox seconded, motion carried. New Business: a. Approval of 2024 Salary Ordinance 10-17-2023-01 – Mr. Cox made a motion to approve the 2024 Salary Ordinance. Mr. Lutz seconded, motion carried. b. Transfer Ordinance 10-17-2023-02 – Mr. Lutz made a motion to approve Transfer Ordinance 10-17-2023-02. Mr. Cox seconded, motion carried. c. Parade Policy – Mr. Hayden made a motion to accept the Parade Policy. Mr. Lutz seconded, motion carried. Miscellaneous: There was nothing. Comments by Citizens: Ms. Hahn, Cicero resident, addressed the council concerning the proposed subdivision at Anthony Road and 241st Street. More specifically: a. Who will benefit – President Blueher responded that the subdivision is not within the town limits. b. Hamilton Heights School – Ms. Hahn is concerned of the impact on the schools with so much growth. Her fear is that the schools will lose the small- town feel. She doesn’t feel it is good planning. 2  c. Number of Homes – Mr. Hahn inquired about the number of homes in Tamarack and Auburn Estates. Council informed that once Tamarack and Auburn Estates are built out, the total homes will be 268 and 168 respectively. d. Traffic Safety Concerns – Ms. Hahn’s concern is public safety for the new areas. In addition, she has concerns about losing more farmland. Mr. Hayden stated that they are working on a Comprehensive Plan. Council thanked Ms. Hahn for coming to the meeting and sharing her concerns. Motion to Adjourn: Mr. Lutz made the motion.
