FINANCE COMMITTEE APRIL 25, 2019 MINUTES NON-PUBLIC MEETING City Attorney Lance Baker met in a non-public meeting with members of the City of Clarksville Finance Committee regarding the Robinson, et al v. City case on Thursday, April 25, 2018, at 5:21 p.m. in City Council Chambers, 106 Public Square, Clarksville, Tennessee. All members were present with the exception of Councilman Henley. PUBLIC MEETING CALL TO ORDER The public meeting of the Finance Committee was called to order by Chairman Jeff Burkhart at 5:59 p.m. ATTENDANCE PRESENT: Jeff Burkhart, Tim Chandler, Valerie Guzman, Stacey Streetman ABSENT: Jeff Henley CONSIDERATION OF SETTLEMENT Mr. Baker said the City had received two letters from the Robinsons’ attorney, Mark Olson, since the City’s counter offer of $350,000, transfer of the property at issue to FSC/Robinsons, plus other conditions. One letter from Mr. Olson stated the City’s counter offer had been rejected; Mr. Olson’s second letter stated Mr. Robinson’s demand of $650,000, plus transfer of the property, was his final offer. Councillady Streetman made a motion to authorize the City Attorney to make a counter offer in the amount of $650,000, to transfer the property at issue to FSC/Robinsons, including all provisions in the City’s previous counter offer, with the exception of the confidentiality provision, all contingent upon a majority vote of the City Council to approve transfer of the property. The motion was seconded by Councilman Chander. Councillady Guzman read the following email sent on April 25, 2019, the Finance Committee and the City Attorney from Councilman Henley:  All, Unfortunately, due to a prior commitment I will not be able to attend tonights special called finance meeting to reconsider the settlement offer that was previously rejected just a few days prior to tonight’s special meeting. If I was able to attend Ward 9 would register a “No” vote on this reconsideration. This determination does not come lightly, as I surmise yours will not either. The Ward 9 “No” is objectively based on the facts gathered through my two plus years on the Council, information provided by our City’s exemplary legal counsel and deeply rooted in what I feel is morally right.
