MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING OCTOBER 23, 2014 CALL TO ORDER CLOSED SESSION CITY COUNCIL MEETING: 5:30 P.M. Roll Call. Present: Denise Loustalot, Mayor Gina Fortino Dickson, Vice Mayor Joey Luiz, Councilmember Joyce Overton, Councilmember Jeri Spittler, Councilmember Staff: Joan Phillipe, City Manager Ryan R. Jones, City Attorney CLOSED SESSION CONFERENCE WITH LEGAL COUNSEL--EXISTING LITIGATION (Paragraph (1) of subdivision (d) of Section 54956.9) Name of cases: Case No. SC702537 Lorenzetti v. City of Clearlake & Bruce McKinney dba McKinney & Co; Case No. EAMS ADJ9170309 Mosqueda v. City of Clearlake PURSUANT TO GOVERNMENT CODE SECTION 54957: Public Employee Discipline, Dismissal, and Release (Added to agenda on October 20, 2014 Amendment No. 1) Closed Session was adjourned at 5:50 P.M. with no action taken by the Council. CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M. Roll Call. Present: Denise Loustalot, Mayor Gina Fortino Dickson, Vice Mayor Joey Luiz, Councilmember Joyce Overton, Councilmember Jeri Spittler, Councilmember Staff: Joan Phillipe, City Manager Craig Clausen, Chief of Police Melissa Swanson, City Clerk Chris Becnel, Director of Finance Ryan R. Jones, City Attorney INVOCATION/MOMENT OF SILENCE Mayor Loustalot held a moment of silence. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS CCM 10-23-14 Page 1 of 3 There were no changes to the agenda. ACTION: It was moved by Councilmember Luiz and seconded by Vice Mayor Fortino Dickson to approve the agenda as submitted. The motion passed with a unanimous roll call vote. PUBLIC COMMENT – Bill Shields spoke on an issue about a piece of paper he brought to the last Council meeting and stated that all actions of city officials reflect on the city. Jim Honegger stated Council can respond to questions and comments during public comment. He stated the Mayor should call a Point of Order when speakers don’t stay on topic. Minutes of the September 10, 2014 Lake Receive and file County Vector Control District Meeting ACTION: It was moved by Councilmember Luiz and seconded by Councilmember Overton to accept the Consent Calendar as presented. The motion passed with a 5-0 roll call vote. BUSINESS 7. Presentation by the Finance Director on the ACS Financial System Finance Director Becnel gave the staff report. No action was taken by Council on this item. 8. Review and Consideration of an Agreement Between the City and Successor Agency to Expend Excess 2006 Bond Proceeds Consistent with the Bond Covenants and In Compliance with the Health and Safety Code Finance Director Becnel gave the staff report. ACTION: It was moved by Councilmember Luiz and seconded by Councilmember Overton to adopt Resolution No. 2014-24, A Resolution of the City Council of the City of Clearlake Approving An Expenditure Agreement Between the City of Clearlake and Clearlake Successor Agency to Transfer and Expend Excess 2006 Bond Proceeds in Compliance with Health and Safety Code Section 34191.4(c), and read it by title only. The motion passed with a unanimous roll call vote. Page 2 of 3 ACTION: It was moved by Member Luiz and seconded by Member Overton to adopt Resolution No. SA_2014-02, A Resolution of the Successor Agency to the City of Clearlake Redevelopment Agency Approving An Expenditure Agreement Between the City of Clearlake and Clearlake Successor Agency to Transfer and Expend Excess 2006 Bond Proceeds in Compliance with Health and Safety Code Section 34191.4(c), and read it by title only. The motion passed with a unanimous roll call vote. 9. Discussion and Consideration of Request from Konocti Unified School District to Rent the City Facility Located at 4700 Golf Avenue for the Purpose of Classroom Space City Manager Phillipe gave the staff report. ACTION: It was the consensus of the Council to direct staff to proceed with development of a rental agreement between the City and School District. 10. Status Report on the Purchase of Police Department Body Cameras Chief Clausen gave the status report. No action was taken by Council on this item. CITY MANAGER AND COUNCILMEMBER REPORTS ACTION: Councilmember Spittler asked for and received the consensus of the Council to put consideration of using the building owned by the City across the street from City Hall as a warming center on the next agenda.
